The purpose of the article is to present solutions in Polish criminal fiscal law aimed at protecting the mandatory use of the split payment mechanism. The analysis is preceded by a brief overview of instruments aimed at counteracting tax fraud as well as the effects of tax fraud. The main element of the article are considerations regarding article 57c of the Criminal Fiscal Code penalising making payments without using the split payment mechanism.
Making a clear distinction between tax fraud and activities related to the so called tax optimisation, appears to be most relevant in the fight against fiscal offences. VAT leaking is not only a problem for Polish state authorities, but also for all countries with value added tax in their fiscal system. The paper attempts to define tax fraud and present its consequences for the state budget, it also offers description of system procedures of VAT fraud prevention.
This paper contains a study regarding the effectiveness of the system of value added tax (VAT), especially in terms of increasing scale of tax frauds. The main aim of this article is to present whether the polish VAT system is working properly. The conclusion were based on the analysis of economic data (including economic growth, unemployment, price index and consumption) tax budget revenues, tax gap and the results of tax audits. Conclusion is that the Polish VAT system is in crisis and requires corrective action. In the opinion of the author, in the current situation there is no reason to change the system of taxation of consumption. There are indicated examples of corrective actions, along with the attempt to be evaluated. Some of them have already been implemented (i.e. warning letter, the joint action of whole administration), part of it is still in the planning phase (i.e. changes to the reverse charge mechanism, the measurement of the tax gap) and the other are being author's proposal (i.e. the elimination of tax rates and the introduction of a single rate for all products).
This paper presents a classroom experiment, the simulations, and a research which familiarize the students with the Benford’s Law. This law is widely used in a tax fraud detecting procedures. This paper shows that: i) the Benford’s Law can be useful in extending the simple perception of the probability which is presented at the lectures concerning the risk, ii) can be an excellent example of using data processing for the classroom tasks, iii) by the experience of the fraud detecting technique the students might change their attitude to cheating. The experiment and the prepared R codes can be used in the numerous courses, such as accounting, applied microeconomics, and quantitative methods.
The aim of the paper is to identify shortcomings in the regulatory framework regarding the legal response to non-disclosure of subject of taxation under tax law and fiscal penal law in Poland. The authors first describe the historical background and discuss current legal arrangements. Next, they provide some recommendations on new regulatory measures that should be implemented in order to stay in compliance with the standards of the rule of law.
The paper deals with the topic of economic crime with the emphasis on tax crime, which can be considered one of the most important subcategories of economic crime. In the theoretical part of the paper, the authors highlight the significance of tax crime, set out basic terminological framework and analyze some of the issues stemming from differences between criminological and legal approach to subject-matter. Subsequently, the reader is provided with a brief statistical analysis of the levels, structure and dynamics of tax crime in the scope of the Slovak Republic during a specified period of time. The analysis is based on data from the electronic system of registered criminality operated by the Police force.
Podstawowym celem niniejszej publikacji jest statystyczne przedstawienie skali oszustw podatkowych województwa pomorskiego i Polski w odniesieniu do mandatów karnych, ilości i wysokości kar grzywnych wymierzonych przez sąd, a także w drodze dobrowolnego poddania się odpowiedzialności. Opracowanie podejmuje problematykę przestępstw podatkowych wskazując wielkość i złożoność uszczupleń wpływających na budżet państwa, a także określa obszary wysokiego ryzyka, które spowodowały największe straty.

The main aim of this publication is the statistical exposure of the level of tax fraud in the Pomeranian Voivodship and in Poland in comparison to the penalties, concretely to the quantity and the amount of financial penalties imposed by judicial authorities or by voluntary surrender of responsibility. The study deals with the issue of tax fraud showing the size and complexity of the depletion of the public budget and it also specifies high-risk sectors which caused the greatest losses.
Artykuł został poświęcony tematyce przestępstw podatkowych w zakresie podatku VAT. Przedstawienie wielkości problemu oszustw podatkowych w Polsce zostało poprzedzone wstępem teoretycznym opisującym charakter zobowiązania podatkowego oraz mechanizm funkcjonowania polskiego systemu podatkowego, który ze względu na specyficzną konstrukcję umożliwia podejmowanie ryzyka popełnienia przestępstw podatkowych przez przedsiębiorców. Autor charakteryzuje również zjawisko określane mianem luki VAT.

The article was devoted to tax offenses in respect of VAT. Presentation of the size of the problem of tax evasion in Poland was preceded by a theoretical introduction describing the nature of the tax liability and the mechanism of functioning of the Polish tax system, which allows risk-taking by entrepreneurs in order to commit the offense. The author is also characterized by a phenomenon called VAT gap.
Fiscal crimes (tax crimes) penalized in the Fiscal Penal Code constitute a specific area of criminal law, as they lie at the junction between criminal law and tax law. Criminal fiscal law plays a key role in protecting the tax interest of a public-law entity, and more broadly, the financial interest of the state. The article comments on the crimes of tax evasion and fraud, doing business under another’s company and presents statistical data on them.

Przestępstwa skarbowe penalizowane w kodeksie karnym skarbowym stanowią specyficzny obszar prawa karnego, leżą one bowiem na styku prawa karnego z prawem podatkowym. Prawo karne skarbowe odgrywa kluczową rolę w ochronie interesu podatkowego podmiotu publicznoprawnego, a szerzej interesu finansowego państwa. W artykule skomentowano delikty uchylania się od obowiązków podatkowych, firmanctwa oraz oszustwa podatkowego, a także przedstawiono dane statystyczne ich dotyczące.
Celem niniejszego opracowania jest analiza korelacji zachodzącej między pojęciami: „uchylanie się od opodatkowania” i „oszustwo podatkowe” oraz relacji między czynami zabronionymi polegającymi na uchylaniu się od opodatkowania i oszustwie podatkowym, penalizowanymi w Kodeksie karnym skarbowym. Ustalenie pełnej i precyzyjnej treści znamion czynów zabronionych z art. 54 k.k.s. i 56 k.k.s. wymaga uwzględnienia przepisów podatkowych konkretyzujących znamiona tych czynów zabronionych. Delikty z art. 54 k.k.s. i 56 k.k.s. powiązane są z takimi instytucjami prawa podatkowego jak obowiązek ujawnienia przedmiotu i podstawy opodatkowania, obowiązek złożenia deklaracji podatkowej oraz samoobliczenie podatku do zapłaty. Naruszenie norm podatkowych nakładających obowiązek zgłoszenia organowi podatkowemu przedmiotu i podstawy opodatkowania (uchylanie się od opodatkowania) jest prawnokarnie relewantne i decyduje o bycie oszustwa podatkowego. Uchylając się od opodatkowania, podatnik wykorzystuje dla własnej korzyści błędne przekonanie organu podatkowego, że obowiązek podatkowy w ogóle nie powstał. Jeżeli chodzi o relację między czynami z art. 54 k.k.s. i 56 § 1–3 k.k.s., to pierwszy z nich dotyczy niedopełnienia obowiązku ujawnienia przedmiotu i podstawy opodatkowania, drugi zaś – rzetelnego (prawdziwego i prawidłowego) ich ujawnienia. Całkowite nieujawnienie przedmiotu i podstawy opodatkowania jest jednocześnie zaniechaniem obowiązku rzetelnego ich ujawnienia. Na tej podstawie można uznać, iż zachowanie opisane w art. 54 k.k.s (uchylanie się od opodatkowania) jest rodzajem czynu penalizowanego w ramach art. 56 k.k.s. (oszustwo podatkowe), a oba te zachowania można zaliczyć do szerszej kategorii oszustw.

The article presents some reflections on the essence of tax evasion offence and tax fraud offence, in the light of references to the tax system. Fiscal penal law is intended to protect a fiscal system of a state. Penal law consequences of tax evasion and tax fraud are linked with tax duties, namely an obligation to reveal an object of taxation and tax base, as well as an obligation to file the tax return with the state or local tax collection agency. Tax evasion entails misrepresenting the true state of taxpayers’ affairs to the tax authorities to eliminate their tax liability. Such conduct leads to deprive the State Treasury of tax revenue. As fraud is deliberate deception to secure unfair or unlawful gain, or to deprive an entity of a legal right, analysis led to form the conclusion that tax evasion is a kind of tax fraud. Tax evasion is penalized within Art. 54 of the Fiscal Penal Code. Under this article, a taxpayer who by evading tax obligations does not reveal to a competent authority an object of taxation or tax base or does not file a declaration, which may result in tax reduction, shall be subject to the penalty [...]. Art. 56 is tax fraud. Under Art. 56 of the Fiscal Penal Code, the crime is committed by the taxpayer if he or she files a tax return containing misleading or false information and in this way exposes the tax on diminution. Thus, a taxpayer shall be subject to the penalty if they declare false data or conceal the truth or do not fulfil an obligation to inform about the change of data included therein, to cause an illegal tax reduction. Taking above mentioned into account, not revealing an object of taxation and tax base (tax evasion) is a kind of not concealing the truth to the tax authority (tax fraud).
The article considers the essentials behind a reasonable model of split payment. To properly analyse the issue in question, the criteria and legal features of reasonability/rationality are evoked. Special focus is on the model’s Polish version, based whereupon its voluntary aspect is compared against the compulsory option. The article is based on a forthcoming monograph on the legal issues regarding the split payment mechanism (publisher: C.H. Beck).

W celu właściwej analizy omawianego zagadnienia, w treści tekstu przywołane zostają kryteria racjonalności razem z jej cechami prawnymi. Autor zwraca szczególną uwagę na rozwiązanie dotyczące polskiej wersji modelu podzielonej płatności, na podstawie której porównuje aspekt jej dobrowolności z rozwiązaniem o charakterze obowiązkowym. Artykuł powstał na podstawie monografii „Mechanizm podzielonej płatności. Problematyka prawna”, która ukaże się nakładem Wydawnictwa C.H. Beck.
Two years have now passed since the adoption of split payment for value-added tax as part of the Polish legislation, so the moment is just right for initial conclusions and summaries. Rather than analysing the functioning of the model in Poland in vast amounts of detail, this study seeks to present the Polish mechanism against its evolution and functions to be fulfilled in the future, including in the context of its underlying international models. In 2021, a re-consultation is expected of the Polish construction of the mechanism in question with the competent EU bodies. The time is now appropriate for the first reflection, before entering the dialogue with the European Commission over the form of split payment to be binding in Poland in the years to come.

Dwa lata obowiązywania w polskim porządku prawnym metody podzielonej płatności (MPP, ang. split payment) w VAT to dobry moment na pierwsze wnioski i podsumowania. Celem niniejszego opracowania jest nie tyle szczegółowa analiza kształtu MPP w Polsce, a przedstawienie polskiego modelu na tle jego ewolucji i funkcji jakie ma spełniać w przyszłości również w kontekście jego międzynarodowych wzorców. W przyszłym roku rozpocznie się proces ponownej konsultacji polskiej konstrukcji MPP z organami UE. To dobry czas na pierwsze refleksje zanim podejmiemy kolejny dialog z KE w zakresie dalszego kształtu MPP w Polsce.
Penal law regulation concerning the problem of falsifying VAT invoices in Poland evolved over the years, yet latest changes that were introduced sharpened regulations that were in effect. In the beginning, author discusses rules concerning issuing and using VAT invoices and pays attention to law that is used against crimes concerning invoices. Next part is focused on mechanisms used by criminals and changes, that were implemented in march of 2017. At the end are shown situations, where in similar cases, courts have different opinions and sentences.
The aim of the article is to evaluate provisions concerning a split payment mechanism. At first, the nature and models of this mechanism were discussed. Then, the regulations applicable in this respect in different countries were presented. What is more, provisions implementing the split payment to Polish VAT were analysed. Finally, the advantages and risks connected with the split payment mechanism were pointed out.

Następnie wskazano na regulacje w tym zakresie obowiązujące w innych państwach. Analizie zostały poddane także przepisy wprowadzające split payment w Polsce. Na koniec zwrócono uwagę na korzyści i zagrożenia związane z mechanizmem podzielonej płatności.
The paper addresses the highly controversial problem, both in theory and in practice, of the confluence of a tax offence and a crime. The author considers this construction as harmful and violating the ne bis in idem principle. Pointing to the view, dominant in case law, that the rules of exclusion of plurality of assessments apply only in the case of a coincidence of provisions of an act, while they do not apply in the case of an ideal coincidence of offences referred to in Article 8 § 1 of the Fiscal Penal Code, the author points to its negative consequences in the procedural perspective. They manifest themselves primarily in the possibility of conducting criminal proceedings twice against a person recognised as the perpetrator of a prohibited act realising the statutory attributes of a prohibited act stipulated both in the Fiscal Penal Code and in another criminal law. This may have particularly negative consequences for persons who admit to having committed a tax offence only in order to benefit from the institution of abandoning the punishment of the perpetrator and thus end the proceedings against them as soon as possible. In turn, such persons may not only be taxpayers or managers of taxpayers that are organisational units, but also accountants or tax advisors.

W artykule podjęto bardzo kontrowersyjny, zarówno w teorii, jak i w praktyce, problem zbiegu przestępstwa skarbowego i przestępstwa. Autor uważa tę konstrukcję za szkodliwą i naruszającą zasadę ne bis in idem. Wskazując na dominujący w orzecznictwie pogląd, że reguły wyłączania wielości ocen mają zastosowanie jedynie w wypadku zbiegu przepisów ustawy, natomiast nie stosuje się ich w razie idealnego zbiegu czynów zabronionych, o którym mowa w art. 8 § 1 k.k.s., autor przedstawia jego ujemne następstwa w perspektywie karnoprocesowej. Ujawniają się one przede wszystkim w możliwości dwukrotnego prowadzenia postępowania karnego przeciwko osobie uznanej za sprawcę czynu zabronionego, realizującego ustawowe znamiona czynu zabronionego stypizowanego w Kodeksie karnym skarbowym i w innej ustawie karnej. Może to mieć szczególne negatywne skutki dla osób, które przyznają się do popełnienia przestępstwa skarbowego dlatego, że chcą skorzystać z instytucji zaniechania ukarania sprawcy i tym samym jak najszybciej zakończyć prowadzone przeciwko nim postępowanie. Osobami takimi mogą być zaś nie tylko podatnicy lub osoby zarządzające podatnikami będącymi jednostkami organizacyjnymi, lecz także księgowi czy doradcy podatkowi.
One of the phenomena that can be observed in the economy is income tax evasion. Its occurrence can be reduced, inter alia, by estimating taxpayers’ taxable income. Tax legislation specifies methods that can be used to this end, however methods other than statutory ones can also be employed. The article aims to evaluate the need for developing tax base estimation methods other than those specified in the legislation by analysing their use by tax authorities. The analysis focuses on cases that the Supreme Administrative Court considered in 2013. Its results show that in nearly 80% of the cases taxable incomes were estimated using methods other than those recommended by law, some of which (e.g. the production method) were never used, one of the reasons being the lack of data necessary to make comparisons. Based on the findings, changes are proposed to make the tax base estimation methods more specific.

Jednym ze zjawisk obserwowanych w gospodarce są oszustwa podatkowe w podatkach dochodowych. Zjawisko to można ograniczać, między innymi, poprzez szacowanie podstawy opodatkowania. Przepisy wskazują różne metody szacowania podstawy opodatkowania. Pozwalają również na stosowanie metod innych niż wymienione w przepisach. Celem pracy jest ocena konieczności opracowania metod szacowania podstawy opodatkowania innych niż wymienionych w przepisach. Przeprowadzono analizę wykorzystania takich metod szacowania podstawy opodatkowania. Przedmiotem analizy były orzeczenia Naczelnego Sądu Administracyjnego wydane 2013 r. Organy podatkowe w prawie 80% przypadków zastosowały metody szacowania dochodu niewskazane w regulacjach. Niektóre metody szacowania dochodu (np. produkcyjna) określone w przepisach nie były w ogóle wykorzystywane przez organy podatkowe. Wynika to między innymi z braku porównywalnych danych. Zaproponowano zmiany dotyczące uszczegóło-wienia metod szacowania podstawy opodatkowania.
This article deals with tax fraud under German and Polish criminal law. Under German law this crime belongs to a small group of delicts which are threatened with punishment. However, in the German legal system, tax fraud is criminalised narrowly, contrary to the Polish solution. Under Polish law there is a separate legislative act covering several dozen infringements of publicfinances which provides for penalisation of them all. This paper seeks to establish to what extent the features that amount to tax fraud under the Polish Criminal-Fiscal Code and German Tax Law relate to the features of a classical crime of fraud under the Polish and German criminal codes, respectively, and what are the consequences.

Artykuł dotyczy przestępstwa oszustwa podatkowego w niemieckim oraz w polskim prawie karnym. Przestępstwa te należą do nielicznej grupy czynów stanowiących delikty podatkowe, które zagrożone są karą kryminalną w ustawodawstwie niemieckim. W niemieckim porządku prawnym bowiem ustawodawca zdecydował się na kryminalizację tego obszaru patologii jedynie w wąskim zakresie, w przeciwieństwie do naszego rozwiązania, w którym funkcjonuje odrębna ustawa karna penalizująca kilkadziesiąt naruszeń dotyczących finansów publicznych. Przedmiotem rozważań jest ustalenie, w jakim zakresie znamiona przestępstwa oszustwa podatkowego z Kodeksu karnego skarbowego oraz niemieckiej Ordynacji podatkowej pokrywają się ze znamionami klasycznego przestępstwa oszustwa, określonego w polskim oraz niemieckim Kodeksie karnym, a także jakie wynikają z tego konsekwencje.
W artykule została przeprowadzona analiza znamion przestępstwa defraudacji podatkowej stypizowanego w art. 305 hiszpańskiego kodeksu karnego. Defraudacja polega na uchylaniu się m.in. od zapłaty podatków lub nieuprawnionym korzystaniu z ulg podatkowych. Istotną przesłanką odpowiedzialności za to przestępstwo jest pozostawanie sprawcy w stosunku prawnopodatkowym z administracją podatkową. Zdaniem autora dla bytu tego przestępstwa nie jest konieczne wprowadzenie w błąd administracji podatkowej, a wystarczające jest naruszenie obowiązku formalnego, który materializuje się w ukryciu lub defiguracji podstawy opodatkowania, co uniemożliwia określenie kwoty podatku. Przedmiotem analizy w zakresie tego przestępstwa są także sprawstwo, współsprawstwo, współsprawstwo konieczne, podżeganie, pomocnictwo, zdefraudowana kwota podatkowa, administracyjne wyliczenie kwoty i jej określenie sądowe, nieuzasadniony wzrost majątku w kontekście odpowiedzialności za defraudację podatkową, nielegalne dochody, a także odpowiedzialność doradców prawnych, podatkowych lub księgowych.

The paper analyses essential features of the crime of tax fraud laid down in Article 305 of the Spanish Criminal Code. The fraud consists in tax evasion or use of undue tax exemptions. The important element of liability for this crime is the legal-tax relation between the perpetrator and the tax administration. The author emphasizes that it is not necessary to deceive the tax administration; it is sufficient not to fulfil the formal duty, which materialises in hiding or disfiguring the tax base, making the determination of tax impossible. The analysis covers also perpetration, co-perpetration, necessary co-perpetration, aiding and abetting, defrauded tax amount, administrative calculation of the due amount and its judicial determination, illegal increment in property in the context of liability for tax fraud, illegal income, as well as the liability of legal counsels, tax advisors or accountants.
