The article discusses the problem of creating a flexible adjustment of tax liability. Choosing this option provides a barrier to the regulation of numerous changes in tax law, and will serve to ensure the effective tax law. This is a difficult issue which requires both determining of the sources of flexibility of the tax liability and the assessment of current regulations in this area.
The subject of the article is to discuss the premise for the suspension of the limitation period for a tax liability, concerning the initiation of proceedings in the case of a tax offense, about which the taxpayer has been notified, if the suspicion of committing a crime or offense is related to failure to fulfill this tax liability. The authors analyzed the latest jurisprudence of administrative courts, judgments of the Constitutional Tribunal, and scientific literature devoted to the indicated topic. Attention was drawn to practical problems with applying the provisions of the Tax Ordinance, including those related to providing taxpayers with constitutional guarantees, such as respecting the principle of trust in the state and the law. Doubts related to the instrumental use of the law when instituting penal fiscal proceedings by tax authorities, aimed solely at suspending the limitation period, as well as the issue of implementing the institution of fiscal penal law into tax regulations, were discussed. The article ends with conclusions and an attempt to evaluate the current legal regulations in the light of the resolution of the Supreme Administrative Court of May 24, 2021, file ref. act I FPS 1/21.
The judgement of the Supreme Administrative Court referred to in the document relates to the issue of the statute of limitations of a tax liability, which is a construction of tax law. The legal question that raised serious doubts in a specific case was whether tax law is part of administrative law or constitutes a separate branch of law. The problem arose in connection with Article 15zzr(1)(3) of the COVID-19 Act. The result of the analysis confirms the thesis that the statute of limitations on tax liabilities cannot be regulated by provisions of administrative law, as tax law does not fall within the category of administrative law but constitutes a separate branch of law.
Spółka z ograniczoną odpowiedzialnością powstaje w momencie rejestracji w Rejestrze Przedsiębiorców Krajowego Rejestru Sądowego prowadzonego przez Wydział Gospodarczy Sądu Rejonowego, właściwego dla miejsca siedziby spółki. Pomiędzy rejestracją spółki a podpisaniem aktu erekcyjnego spółki przez wspólników istnieje spółka w organizacji. Jeśli zarząd spółki nie dokona zgłoszenia do Rejestru Przedsiębiorców KRS w terminie sześciu miesięcy od chwili zawarcia aktu, spółka nie może zostać zarejestrowana i należy ją zlikwidować. W sytuacji, gdy sp. z o.o. w organizacji, w trakcie tego okresu była podmiotem czynności opodatkowanych, może stać się dłużnikiem bądź wierzycielem. Tym samym, aspekty podatkowe jakie wystąpią w trakcie likwidacji mogą być dla likwidatorów największym problemem podczas całego procesu. Publikacja swoim zakresem obejmuje rozważania na temat charakteru odpowiedzialności wspólnika, członka zarządu, pełnomocnika działającego w imieniu spółki oraz możliwości obciążenia zobowiązaniami spółki w organizacji osób biorących udział w jej tworzeniu. Ponadto poddano analizie tryb wydania decyzji określającej zobowiązanie podatkowe osób trzecich (w sytuacji przekształcenia przedsiębiorcy w sp. z o.o.) oraz skutki podatkowe zbycia majątku likwidacyjnego na gruncie podatku od towaru i usług, dochodowego oraz podatku od czynności cywilnoprawnych.

Limited liability company is formed at the time of registration in the register of entrepreneurs of the National Court Register kept by the Commercial Division of the District Court. Between the moment the company is registered and the moment the foundation act is signed by the shareholders we talk about company in organization. If the Board of Directors of the company shall not make a declaration in the register of Entrepreneurs National Register of Court within six months from the time of the conclusion of the Act, the company may not be registered and must be eliminated. If an ltd. company in organization during this period undertook a taxable activity, it can become a debtor or creditor. Thus, the tax aspects which occur during the liquidation of the company may create the most serious problems for the liquidators during the whole process. The scope of the paper includes reflections on the nature of the liability of a partner, a member of the Board of Directors, a representative acting on behalf of the company and the possibility to charge liabilities on people involved in its creation. In addition, the paper explores the mode of release of a decision determining tax liability of third parties (in case of conversion of an entrepreneur into a limited company) and the tax effects of the sale of winding-up proceedings on the basis of the tax on goods and services, and income tax on civil law transactions.

The law of global economy and technological development offer increadible possibilities to taxpayers who want to decrease their tax liability. One of the instruments used to effectively avoid tax is the residency of the territory which does not regulate any taxing or limits its size to the level much lower than in any other country in the world. Such territories are known as tax havens. The following study attempts to explain the definition of tax havens, then it presents their features, types and classifications.
Several legislative measures has been adopted in Poland in order to improve VAT compliance. One of them, relat-ed to the intra-Communitarian acquisitions of fuel, imposed on taxpayers the duty to settle the respective tax within few days from the transaction. However, within this timeframe the tax may not become chargeable under the provisions of VAT Directive and, hence, there might be no tax liability. The query about the compliance of the Polish regulation with VAT Directive is pending before CJEU (Case C-855/19). The paper seeks to analyse the convergence of the terms used in Polish VAT Act in relation to the events relevant for tax compliance (such as the rise of tax liability) with the corresponding terms used in VAT Directive (chargeable event, VAT chargeability, VAT payment). Some divergences are noted.

W ramach uszczelniania VAT wprowadzono w Polsce przepisy nakładające na podatników obowiązek wcześniejszego rozliczenia podatku z tytułu wewnątrzwspólnotowego nabycia paliwa (art. 103 ust. 5a ustawy z dnia 11 marca 2004 r. o podatku od towarów i usług1). Przewidziany w tym przepisie termin zapłaty następuje, zanim podatek z tytułu danej transakcji stanie się wymagalny (wedle terminologii dyrektywy 2006/112/WE Rady z dnia 28 listopada 2006 r. w sprawie wspólnego systemu podatku od wartości dodanej2), tj. zanim w stosunku do tej transakcji powstanie obowiązek podatkowy (według terminologii polskiej ustawy). Spór w tej sprawie zawisł przed Trybunałem Sprawiedliwości Unii Europejskiej (TSUE) w sprawie C-855/193 (wyroku jeszcze nie wydano). Problem ten stał się przyczynkiem do analizy zgodności pojęć stosowanych przez polskiego ustawodawcę w odniesieniu do zdarzeń kształtujących sytuację prawną podatnika (powstanie obowiązku podatkowego, powstanie zobowiązania podatkowego, termin zapłaty podatku) z ich odpowiednikami w dyrektywie 2006/112/WE (fakt wywoławczy, wymagalność podatku, termin zapłaty podatku). Między tymi pojęciami nie zachodzi pełna konwergencja.
The essay refers to the tax liability of members of board for company’s tax arrears. Under the Polish law that kind of liability arises from decision issued in tax proceedings in which tax authorities are obliged to verify the party’s status. The regulation of the burden of proof is based on two principles: tax authority needs the evidence of party’s membership in a board, while a party needs to prove that a petition to declare bankruptcy was filed or proceedings were instituted in order to avoid declaration of bankruptcy in due time, or party is not liable for the failure to file a petition to declare bankruptcy or to institute proceedings in order to avoid declaration of bankruptcy. If the party’s membership in board is disputable, the tax authority may be obliged to request a general court to determine whether or not that kind of legal relationship exists.

W niniejszej glosie analizie poddane są przesłanki odpowiedzialności członków zarządu spółki kapitałowej za zaległości podatkowe tej spółki. Zasadnicza kwestia, jaka wyłoniła się w sprawie zakończonej wyrokiem, dotyczy możliwości i trybu powoływania się przez członka zarządu na wadliwości aktu jego powołania. W ocenie autora, niewytoczenie powództwa o stwierdzenie nieważności uchwały o powołaniu danej osoby w skład zarządu nie pozwala każdorazowo uznać, że pozytywna przesłanka odpowiedzialności została spełniona. To na organie spoczywa obowiązek skierowania decyzji o odpowiedzialności do osoby będącej członkiem zarządu spółki. Odwoływanie się przez organy – a w toku kontroli legalności decyzji przez sądy administracyjne – do faktu niezaskarżenia uchwały o powołaniu członka zarządu przez samego zainteresowanego, należy uznać za nieuprawnione.
Artykuł obejmuje rozważania poświęcone zobowiązaniu płatnika (zobowiązaniu płatniczemu). Celem przeprowadzonych badań jest ustalenie odrębności zobowiązania płatniczego względem zobowiązania podatkowego, a następnie określenie relacji, w jakich zobowiązanie płatnicze pozostaje względem zobowiązania podatkowego. Przeprowadzona analiza dogmatyczno-prawna przepisów ustawy Ordynacja podatkowa potwierdziła odrębność zobowiązania płatniczego względem zobowiązania podatkowego oraz pochodny i refleksowy charakter związku pomiędzy tym zobowiązaniem a zobowiązaniem podatkowym.

The article includes considerations devoted to the obligation of the withholding agent. The aim of the author’s research is – first of all – to determine whether there is an obligation of the withholding agent, or the ratio of one is not formed on the basis of tax law by which the withholding agent has the status of a party of tax liability and then to determine the relationship in which the withholding agent obligation remains with respect to the tax liability (in case of recognition the existence of the first of the indicated legal relations). The analysis dogmatic legal provisions of the Tax Law confirmed the existence of a payment obligation, whose party is a public body and the withholding agent and the derivative and the reflex nature of the relationship between this obligation and the tax liability.
The study is devoted to the problem of management board members’ liability for social insurance contributions arising during the course of proceedings with the option of concluding an arrangement based on the provisions of both the Bankruptcy and Reorganization Law and the Restructuring Law. It defends the view that a member of the management board is not responsible for liabilities under social security contributions arising during the course of proceedings with the option of concluding an arrangement, initiated in good time, conducted on the basis of the provisions of the Bankruptcy and Reorganization Law as well as on the provisions of the Restructuring Law.

In this article, the authors analyse the concept of the tax liability of persons deducting income tax payments on account. The authors noted that the paying agent performs his own obligation to collect, or withhold, an amount of money from a person who is not a taxable person and to transfer that amount to the relevant tax authority. This obligation arises as a result of the occurrence of an event described in a statutory provision that imposes an obligation on the paying agent. Under the Tax Ordinance Act the paying agent is liable for his failure to withhold a tax payment or to transfer the tax withheld to the relevant tax authority, but in the opinion of the authors' the applicability of this provision to the paying agent deducting income tax payments on account after a fiscal year end is limited. The authors present the view that adjudicating on the tax liability of paying agents deducting income tax payments on account after a fiscal year end is possible only in the event that the amount paid by the taxpayer is lower than the amount of the tax due, and this understatement results from the fact that the paying agent does not take steps to collect the payments on account and transfer them to the account of the tax authority.

W niniejszym artykule autorzy analizują pojęcie odpowiedzialności płatników zobowiązanych do zapłaty zaliczek na podatek dochodowy. Prezentują stanowisko, zgodnie z którym płatnik realizuje własny obowiązek pobrania lub potrącenia kwoty zaliczki na podatek od osoby w istocie niebędącej podatnikiem i przekazania tej kwoty właściwemu organowi podatkowemu. Obowiązek ten powstaje w wyniku zaistnienia zdarzenia opisanego w przepisie ustawowym, nakładającego obowiązek na płatnika zaliczki na podatek. Zgodnie z przepisami Ordynacji podatkowej płatnik ponosi odpowiedzialność za to, że nie pobrał podatku lub nie przekazał potrąconego podatku właściwemu organowi podatkowemu, ale zdaniem autorów zastosowanie tego przepisu do płatnika pobierającego zaliczki na podatek dochodowy po zakończeniu roku podatkowego jest ograniczone. Autorzy stoją na stanowisku, że orzekanie o odpowiedzialności płatników pobierających zaliczkę na podatek dochodowy po zakończeniu roku podatkowego jest możliwe tylko w przypadku, gdy wpłacona przez podatnika kwota jest niższa niż kwota należnego podatku, zaś owo zaniżenie wynika z niepodjęcia przez płatnika czynności polegających na pobraniu należnych zaliczek i wpłaceniu ich na rachunek organu podatkowego.
The commentary is devoted to the analysis of the judgment of the Provincial Administrative Court in Bydgoszcz of August 18, 2020 (I SA/Bd 101/20). The issue is understanding of Art. 113 of the General Tax Law (1997), according to which the awareness of the person who illegally represents of taxpayer as to the purpose of activity of the latter determines its responsibility for the tax arrears. The author criticizes the interpretation of the provision by tax court, especially in the context of the facts of the case.

Legal succession in the enforcement of tax liabilities is one of the fundamental legal institutions on enforcement proceedings in administration. It is a reflection of the legal and tax succession. The content of the legal succession in the enforcement of tax liabilities is expressed in the statement that it constitutes a subjective change in the enforcement relationship, as a result of which, while maintaining the identity of the subject of enforcement, the successor of the tax obligation takes the place of or next to the current obligated entity. Enforcement succession of tax liabilities is based on the principles of continuation of enforcement proceedings with the participation of the successor and the preservation of previous enforcement activities. For the analysis of the institution of legal succession in the enforcement of tax liabilities, it is necessary to take a comprehensive look at the institution, taking into account the normative bases contained in the provisions of substantive and procedural law, both public and private law.

Następstwo prawne w egzekucji zobowiązań podatkowych stanowi jedną z fundamentalnych instytucji prawa o postępowaniu egzekucyjnym w administracji. Jest odzwierciedleniem następstwa prawnopodatkowego. Treść następstwa prawnego w egzekucji zobowiązań podatkowych wyraża się w stwierdzeniu, że stanowi ono zmianę podmiotową w stosunku egzekucyjnym, wskutek której, przy zachowaniu tożsamości przedmiotu egzekucji, w miejsce lub obok dotychczasowego podmiotu zobowiązanego wstępuje sukcesor obowiązku podatkowego. Następstwo egzekucyjne zobowiązań podatkowych opiera się na zasadach kontynuacji postępowania egzekucyjnego z udziałem sukcesora oraz zachowania dotychczasowych czynności egzekucyjnych. Dla analizy instytucji następstwa prawnego w egzekucji zobowiązań podatkowych konieczne jest kompleksowe spojrzenie na instytucję, z uwzględnieniem podstaw normatywnych, zawartych w przepisach prawa materialnego i procesowego, zarówno publicznego, jak i prywatnego.
This article shows the influence of application of general rules and new regulations on determining the inception of the income tax from received advance payments of corporate income tax and personal income tax on the liquidity of the company. Simplifying in the rules obliged since 2015 entitle taxpayers using cash registers to identify the moment of check in advance with the moment of revenue. The impact of described regulation on the formation of moment of income tax liability has been illustrated by a numerical example.

Niniejszy artykuł przedstawia wpływ stosowania zasad ogólnych oraz nowych regulacji prawnych dotyczących ustalania momentu powstania przychodu podatkowego od otrzymanych zaliczek w podatku dochodowym od osób prawnych oraz osób fizycznych na płynność przedsiębiorstwa. Uproszczenie w przepisach obowiązujących od początku 2015 roku uprawnia podatników stosujących kasy rejestrujące do utożsamiania momentu ewidencjonowania zaliczki z momentem powstania przychodu. Na przykładzie liczbowym zilustrowano wpływ opisanych regulacji na kształtowanie momentu obowiązku podatkowego w podatku dochodowym oraz wykazano, iż wybór sposobu ustalania tego momentu dla otrzymanych zaliczek od osób fizycznych może stanowić narzędzie strategii podatkowej przedsiębiorstwa.
Jedną z dominujących form tak zwanego oporu podatkowego jest unikanie opodatkowania polegające na wykorzystywaniu legalnych metod minimalizacji obciążenia podatkowego. Z punktu widzenia podatnika działaniem racjonalnym jest zachowanie, które prowadzi do minimalizacji obciążenia podatkowego. W konsekwencji uwaga ustawodawców skupia się na przeciwdziałaniu opisanym tendencjom poprzez wykorzystywanie uregulowań międzynarodowego prawa podatkowego, jak również w drodze wprowadzania wewnętrznych przepisów mających na celu przeciwdziałanie unikaniu opodatkowania. One of the dominant forms of so-called tax resistance is tax avoidance, involving the use of legal methods to minimise the tax burden. From the taxpayer’s point of view, rational behaviour is behaviour that minimises the tax burden. As a consequence, the attention of the legislators focuses on counteracting the above described trends by using the regulations of international tax law, as well as by introducing internal regulations aimed at counteracting tax avoidance. The purpose of the article is to present the regulations regarding additional tax liability in value added tax and in Tax Ordinance known as tax sanctions, whose primary purpose is to prevent tax avoidance.
The article presents the institution of tax base estimation described in the Tax Ordinance Act, outlining its significance and the conditions of its application as well as estimation methods used by tax authorities. The article describes the broad spectrum of judgments of administrative courts on the tax base estimation, and brings attention to overly general legal regulations.

Celem niniejszego artykułu jest omówienie odpowiedzialności małżonka za zobowiązania podatkowe współmałżonka. Główną przesłanką odpowiedzialności małżonka jest istnienie pewnego związku ekonomicznego między nim a podatnikiem. W zależności od istnienia konkretnych okoliczności zakres tej odpowiedzialności jest różny. Najszerszy zakres omówionych odpowiedzialności dotyczy odpowiedzialności małżonka pozostającego z podatnikiem w ustroju wspólności ustawowej. Odmiennie kształtuje się odpowiedzialność za zobowiązania podatkowe w sytuacji ustanowienia rozdzielności majątkowej między małżonkami. Ostatnim omówionym w treści artykułu rodzajem odpowiedzialności podatkowej jest odpowiedzialność po śmierci jednego z małżonków. Małżonek będący spadkobiercą wstępuje wówczas w miejsce spadkodawcy, stając się podatnikiem, co jest podstawową cechą różniącą ten rodzaj odpowiedzialności od pozostałych. Szczególny charakter przedstawionego zagadnienia wynika z faktu, że odpowiedzialność za zobowiązania podatkowe ponoszą osoby nie będące podmiotami żadnych obowiązków wynikających z prawa podatkowego związanych z poborem podatków. Istnienie tej odpowiedzialności oznacza dla wierzyciela poszerzenie kręgu podmiotów, od których może żądać wykonania zobowiązania, które to zobowiązanie ciążyło pierwotnie wyłącznie na podatniku.

The purpose of this article is to review the spouse’s liability for tax liabilities of his/her spouse. The main premise for the spouse’s liability is the existence of an economic relationship between the spouse and the taxpayer. Depending on the existence of specific circumstances, the extent of this liability varies. The widest scope of the presented liability concerns the liability of the spouse who has the statutory matrimonial property regime with a taxpayer. The liability for tax obligations in the case when separation of property is established between spouses is different. The last type of tax liability discussed in the article is the liability after the death of one of the spouses. The spouse, who is the heir, then replaces the testator and becomes a taxpayer. That is a fundamental feature that distinguishes this type of liability from the others. The specific nature of the presented issue results from the fact that liability for tax obligations lies with persons who are not subject to any obligations arising from tax law related to the collection of taxes. The existence of this liability means that the creditor extends the circle of persons from whom the creditor may demand the execution of the obligation which was originally the sole liability of the taxpayer.
The article concerns the liability of members of the management board of companies for tax arrears of company. It presents how these provisions are interpreted and applied by tax authorities and administrative courts in specific cases. It also analyses mistakes made in such proceedings and violations of the rights of management board members as entities jointly and severally liable with companies for the tax arrears. At the same time, the correct model of adjudicating the liability of management board members for such arrears is described, taking into account the principle of trust in tax authorities.

Artykuł dotyczy odpowiedzialności członków zarządu spółek kapitałowych za ich zaległości podatkowe. Przedstawiono w nim sposób interpretacji i stosowania tych przepisów przez organy podatkowe i sądy administracyjne w konkretnych sprawach. Dokonano także analizy błędów popełnianych w tego typu postępowaniach oraz naruszeń praw członków zarządu jako podmiotów solidarnie odpowiedzialnych ze spółkami za ich zaległości podatkowe. Jednocześnie opisano prawidłowy model orzekania odpowiedzialności członków zarządu za takie zaległości, z uwzględnieniem zasady zaufania do organów podatkowych.
Limitation of tax liabilities is ineffective form of the expiry of tax liability. The article deals with the issues of liability and prescription and its time limits, as well as the concepts of suspension and interruption of the limitation period. The effects and, what is more, data showing the amount of tax arrears in Poland in the years 2014–2017 were presented. The consequence of the statute of limitation is the inability to collect payment by the tax authority and the arrears of tax arrears affecting the state budget.

Przedawnienie zobowiązań podatkowych jest nieefektywną formą wygaśnięcia zobowiązania podatkowego. W artykule poruszone zostały kwestie zobowiązania oraz przedawnienia i jego terminów, a także rozróżniono pojęcia zawieszenia i przerwy biegu terminu przedawnienia. Zaprezentowano skutki, a co więcej dane obrazujące wielkość zaległości podatkowych w Polsce w latach 2014–2017. Konsekwencją przedawnienia jest brak możliwości pobrania zapłaty przez organ podatkowy i powstawanie zaległości podatkowych negatywnie wpływających na budżet państwa.
Current Polish tax law was shaped by: – the reform of Polish tax system that began in 1989 in relation to economic changes that occurred in Poland – harmonisation of Polish tax law with European Union Law in terms of direct and indirect taxes. In many discussion and articles tax system is identified solely with taxes, whereas tax system comprises also of tax ordinance and other regulations, which are discussed in the final part of this article. Tax has the institutional, economic and legal aspect. Institutional aspect of taxes is connected to answering the question of how basic tax matters concerning fiscal burdens should be regulated. The fact that currently it is insufficient for the justification of taxation to rest solely on sovereignty of state and that is has become necessary to justify existing and planned expenses, lead to conclusion that they should be regulated by the constitution. Awareness of this state of affairs is high enough that in majority of constitutions in the world it has become the norm. from this perspective, constitutional principles quaranteeing the rule of law particular significance. These principles are: prohibition on retroactive laws, vacatio legis, the legal certainty in the state of law, equality. The consequence of the two first principles is that there should be no new enactments in tax law during the tax year, especially the ones that worsen the legal and economic situation of the taxpayer. It has a great significance under the market economy because arbitrariness in enacting tax legislation has a destructive effect on business. The principle of compliance with the law essentially comes down to the rule that no taxation may be introduced other than by the statute, whereas the principle of equality means identical tax rules for all subjects. The economic aspect concerns, generally speaking, the construction of the taxpayer. Imposition of any fiscal burden may result in a change of resource allocation in the economy. Thus the main problem is to propose such taxes that would not cause maximization of the lost potential profits from aborted production activities and hence economic stagnation, whilst meeting the financial needs of particular budgets. In the legal aspects, particular attention is paid to the fact that there are certain constant features that differentiate tax from other public imposts. These features are: nonequivalence, mandatoriness, monetary character, monetary character, universality and non-refundability.

Na obecny kształt polskiego prawa podatkowego wpłynęły: – reforma polskiego systemu zapoczątkowana w 1989 roku, w związku ze zmianami gospodarczymi dokonanymi w Polsce, – proces harmonizacji polskiego prawa podatkowego z prawem UE w zakresie podatków pośrednich i bezpośrednich. Podatek ma swój aspekt ustrojowy, ekonomiczny i prawny. Aspekt ustrojowy wiąże się z odpowiedzią na pytanie, w jaki sposób powinny być regulowane podstawowe kwestie dotyczące obciążeń fiskalnych. Fakt, iż współcześnie dla uzasadnienia opodatkowania nie wystarczy już sama idea suwerenności państwa i konieczne stało się usprawiedliwienie istniejących i planowanych wydatków, skłania do wysunięcia tezy, iż powinny być one objęte konstytucją. Świadomość tego stany rzeczy jest na tyle wysoka, że w większości konstytucji na świecie stała się normą. Przy takim podejściu szczególnego znaczenia nabierają zasady konstytucyjne, gwarantujące praworządność podatkową. Zasady te, to: niedziałanie prawa wstecz, vacatio legis, zaufanie do prawa i państwa, zgodność z prawem i równość. Konsekwencją stosowania dwóch pierwszych zasad powinien być zakaz wprowadzania zmian w prawie podatkowym w czasie trwania roku podatkowego. Przede wszystkim chodzi o te zmiany, które pogarszają sytuację prawną i ekonomiczną podatnika. W warunkach gospodarki rynkowej ma to ogromne znaczenie, gdyż dowolność w stanowieniu podatków wpływa destrukcyjnie na działalność gospodarczą. Zasada zgodności opodatkowania z prawem sprowadza się do tego, że nie może być ono nakładane inaczej niż ustawą, zaś zasada równości oznacza jednakowe reguły podatkowe wobec wszystkich podmiotów. Aspekt ekonomiczny dotyczy, najogólniej mówiąc, konstrukcji podatku. Ustanowienie każdego obciążenia fiskalnego może spowodować zmianę alokacji zasobów w gospodarce. Podstawowym problemem jest zatem zaproponowanie takich podatków, które zaspokajając potrzeby finansowe właściwych budżetów – nie powodowałyby jednocześnie maksymalizacji utraconego potencjalnego dochodu z zaniechanej działalności produkcyjnej, a co za tym idzie stagnacji gospodarczej. W aspekcie prawnym zwraca się uwagę na to, że istnieją pewne stałe cechy, które odróżniają podatek od innych danin publicznych. Cechami tymi są: przymusowość, nieekwiwalentność, pieniężny charakter świadczenia, powszechność i bezzwrotność.
