Artykuł przedstawia zagadnienia prawne powstające w przypadku, gdy organ regulacyjny po ustaleniu w drodze decyzji stawek opłat hurtowych, ustala następnie nową decyzją nowe stawki, których okresy obowiązywania pokrywają się z ustalonymi w poprzedniej decyzji. Omówiono możliwości stwierdzenia wygaśnięcia decyzji oraz zmiany lub uchylenia takiej decyzji. Przeanalizowano skutki wygaśnięcia decyzji dla postępowania odwoławczego.

Article presents legal problems arising in case of regulatory decision fi xing wholesale rates, which is superseded by new decision, covering the period of validity of preceding decision. Discussed are problems concerning the declaration of expiry of a decision as well as repeal of such decision. Analyzed are consequences of the expiry of a decision for the appeal procedure.

Umowy o dostępie telekomunikacyjnym powszechnie występują w profesjonalnym obrocie go-spodarczym. Stanowią one przedmiot regulacji prawa cywilnego (prawa prywatnego) i prawa telekomunikacyjnego (prawa publicznego). W konsekwencji wymóg zachowania pisemnej formy umów tego rodzaju należy oceniać zarówno w świetle regulacji prywatnoprawnej, jak i publiczno-prawnej. Obowiązek zachowania pisemnej formy umowy dostępowej ustawodawca wprowadził w przepisie art. 31 ust. 1 P.t. W związku z tym, że umowy o dostępie telekomunikacyjnym mają charakter cywilnoprawny do oceny wymogu zachowania ich formy pisemnej należy stosować przepisy K.c. Zachowanie formy pisemnej umowy o dostępie telekomunikacyjnym jest istotne za-równo w stosunkach pomiędzy ich stronami, ale także ma znaczenie dla relacji pomiędzy wszyst-kimi przedsiębiorcami prowadzącymi działalność telekomunikacyjną oraz w relacjach pomiędzy przedsiębiorcami telekomunikacyjnymi i Prezesem UKE.

Telecommunications access agreements are commonly applied on the telecoms market. Since such agreements contain conditions of telecommunications access and on related cooperation, they are of high importance to telecommunications activity. The Polish Telecommunications Act provides the obligation to conclude such agreements in a written form. Whether the appropriate form is observed, and the consequences of not observing the duty to conclude such agreements in a written form, should be assessed in the light of the provisions of the Polish Civil Code.

This article presents the difficulties associated with the implementation of the regulatory goal of promoting investment and innovation within the area of sector specific regulation in telecoms. The encouragement of efficient investment is one of the major goals reflected in the EC and domestic legal rules on telecoms access as well as price- and rate of return regulation. The law and the interplay of the interests of incumbents and alternative operators create a fertile soil for the emergence of various regulatory concepts of stimulating investment and facility-based competition. Considered here are the concepts most frequently referred to in this context including: the notion of new and emerging markets, the ladder of investment theory, sunset clauses and dynamic pricing policies. However, most of these concepts had little influence on regulatory practice so far, seeing as telecoms regulation is mostly directed at service competition and effective utilisation of existing infrastructures. This fact is the result of national regulators balancing their various regulatory goals in the existing technical and economic environment of the sector. The approach of the Polish regulatory authority towards these concepts constitutes an example of this reality. The urgent need to establish a new policy for next generation networks and access, bringing new technologies and business models to the sector, will have to induce more recognition for some concepts presented in this article.
