Prawa dziecka to prawa człowieka, wynikają one z godności osobowej oraz niepowtarzalności dziecka jako człowieka. Przysługują każdemu dziecku, nie można ich pozbawić czy się zrzec. Takie widzenie dziecka jako posiadacza określonych niezbywalnych praw jest jednak podejściem dość nowym, początki ruchu na rzecz praw dziecka sięgają ledwie końca XIX wieku. Artykuł przedstawia historię dochodzenia do obecnie obowiązujących praw dziecka w Polsce i na świecie, omawiając kluczowe momenty w ich rozwoju i główne dokumenty prawne, w których są zawarte.

The rights of the child are human rights, resulting from the dignity of the person and the uniqueness of the child as a human being. They apply to any child, no child can be deprived of them or renounce them. Such a vision of a child as a holder of certain inalienable rights is, however, a rather recent approach, the beginning of the movement for the rights of the child goes back to the end of the 19th century. The article presents the history of the current rights of the child in Poland and worldwide, discussing the key moments in their development and main legal documents in which they are contained.
The article deals with the practice of determining and recording a child’s ethnic origin by the bodies responsible for the social-legal protection of children in the Czech Republic when arranging substitute family care. The main focus is concentrated on the interpretation of the constitutional protection of ethnic discrimination in relation with the interpretation of “continuity of care” in the view of Article 20 para 3 of the Convention on the Rights of the Child. These issues are considered from the point of view of principle of prohibition of discrimination and issue of legitimacy of data collection. The article leads to the conclusion, that the criterion of ethnic origin should not serve as a discriminatory criterion - to exclude a child from the possibility of substitute family care.
Artykuł przedstawia wyniki prac badawczych z zakresu ochrony prawnej konstytucyjnych praw dziecka na Ukrainie. Autor koncentruje się na aspektach teoretycznych i praktycznych wdrażania przepisów i instrumentów międzynarodowych, które regulują stosunki publiczne w sferze ochrony praw i wolności dzieci do prawa krajowego.

The article presents the results of the research concerning legal support of the constitutional rights of children in Ukraine. The author focuses on the theoretical and practical aspects of the rights implementation into the domestic law as well as the implementation of the international instruments regulating public relations in the sphere of the rights and children’s freedom protection within the country law.
Children’s rights are one of the most important and challenging international and national regulations. The Convention on the Rights of the Child as well as the Polish law explicitly stipulate that the best interest of the child has to be taken as primary consideration. The scope of this principle is defined mainly by the judicatory and the doctrine. The best interest of the child principle is not only primary, but should be superior to other interests and principles. Where a conflict of interests arises, the child’s best interest should always be a priority. This article elaborates on the condition of children’s rights in Poland, with particular reference to the best interest of the child principle in the light of the Convention on the Rights of the Child and of the Polish legal system.

Prawa dziecka należą do najistotniejszych i najbardziej wymagających regulacji zarówno na arenie międzynarodowej, jak i w ustawodawstwie krajowym. Zarówno w Konwencji o prawach dziecka, jak i w prawie polskim wyrażony został nakaz kierowania się dobrem dziecka. Klauzula dobra dziecka wypełniana jest treścią przez doktrynę oraz judykaturę. Dobro dziecka stanowi wartość nadrzędną, inne dobra i interesy nie powinny mieć pierwszeństwa przed tą zasadą. W przypadku kolizji interesów dobro dziecka powinno mieć znaczenie priorytetowe. Artykuł ten ma na celu przedstawienie kondycji praw dziecka w Polsce, ze szczególnym uwzględnieniem klauzuli dobra dziecka w świetle Konwencji o prawach dziecka i polskich przepisów.
