Przedmiotem artykułu jest analiza treści i funkcjonowania porozumień o współpracy w zakresie bezpośredniej likwidacji szkód w świetle polskich i europejskich przepisów o ochronie konkurencji. Szczegółowej analizie poddano w nim umowę BLS zawartą przez polskich ubezpieczycieli pod egidą Polskiej Izby Ubezpieczeń, która weszła w życie w 2015 r. Przeprowadzona analiza uwzględnia ponadto wnioski z badań porównawczych podobnych mechanizmów likwidacji szkód funkcjonujących w innych państwach europejskich. Autorka dochodzi do wniosku, że polski model umowny bezpośredniej likwidacji szkód nie wprowadza ograniczeń konkurencji rynkowej, zakazanych przez przepisy prawa o ochronie konkurencji.

The article is devoted to an analysis of the contents and operation of agreements on the direct claims settlement in view of the Polish and European competition protection regulations. What has been subject to a detailed analysis is the DCS (BLS)48 agreement concluded by Polish insurers under the aegis of the Polish Insurance Association, which came into force in 2015. Furthermore, the analysis in question takes into account the conclusions from comparative studies of similar claims settlement mechanisms which operate in other European countries. The author concludes that the Polish contractual model of direct claims settlement does not introduce limitations of market competition forbidden by the regulations of the competition protection law.
