This article aims to present an overview of the current rights and obligations of religious ministers in cases when they are the injured party in ordinary criminal proceedings. First, the concepts of the injured party and religious minister are explained. The main part of the study deals with the rights and obligations that are connected with the general status of the religious minister. Special attention is devoted to the possibility of applying the statutory rules of criminal proceedings, taking into account the constitutional and international principle of respect for the autonomy and independence of the Church and the state in their own spheres.

W przedmiotowym artykule przedstawiono w uporządkowany sposób aktualne prawa i obowiązki osoby duchownej wynikające z bycia przez nią pokrzywdzonym w postępowaniu karnym zwyczajnym. Wyjaśniono w tym kontekście wpierw pojęcia pokrzywdzonego i osoby duchownej. Jednocześnie sprecyzowano te prawa i obowiązki, które mają szczególny związek z ogólnym statusem osoby duchownej, mając na uwadze możliwość odpowiedniego stosowania procedury karnej uregulowanej aktem normatywnym rangi ustawowej, z uwagi na konstytucyjną i międzynarodową zasadę poszanowania autonomii i niezależności Kościoła i państwa każdego w swoim zakresie.

Summary The article discusses the issue of succession of rights of the injured party in criminal proceeding in case of transformation of the legal entity into another entity. The first part of the article focuses on the definition of the injured party. The further part contains several examples of transformations of legal entities and related to the transformation – problem of succession of rights in criminal process. The author analyzes in detail the different variants of the transformation of legal persons and other organizations in order to solve recent problems in determining the subject entitled to exercise the rights of the injured party, for example, in case of disposal of the company or its transformation. Moreover, the author provides consequences of the transformation that is dependable on the way of transformation – whether the transformation was based on the universal or singular succession of the rights. The final part contains de lege ferenda demands and general principles that may be useful to court and law enforcement entities in determining the entity which should be given the status of the injured party, if it is not a natural person.

Streszczenie Artykuł omawia problematykę sukcesji praw pokrzywdzonego w postępowaniu karnym w razie przekształceń podmiotów niebędących osobami fizycznymi. Pierwsza część artykułu skupia się na definicji pokrzywdzonego. Dalsza część artykułu została poświęcona omówieniu szeregu przykładów przekształceń podmiotowych oraz związanej z nimi sukcesji praw pokrzywdzonego w postępowaniu karnym. Autorka szczegółowo analizuje różne warianty przekształceń osób prawnych i innych jednostek organizacyjnych chcąc wyjść naprzeciw współczesnym problemom w określaniu podmiotu uprawnionego do wykonywania praw pokrzywdzonego np. w razie sprzedaży przedsiębiorstwa czy przekształcenia spółki. Autorka podnosi nadto konsekwencje przekształceń podmiotowych i sukcesji praw pokrzywdzonego w zależności od tego czy przekształcenia dokonano na zasadzie sukcesji uniwersalnej, czy syngularnej. W końcowej części pracy zawarte są wnioski wraz z postulatami de lege ferenda oraz sformułowanymi zasadami ogólnymi, które mogą okazać się przydatne organom ścigania i sądowi przy określaniu podmiotu, któremu należy nadać status pokrzywdzonego, jeśli nie będzie to osoba fizyczna.
