Właściwe przygotowanie oferty przetargowej, zgodnej z wymaganiami zamawiającego wpływa w dużym stopniu na możliwość wygrania przetargu przez wykonawcę. Często jednak oferent ma problem z odczytaniem intencji zamawiającego jak i wyznaczeniem właściwej ceny ofertowej. Nieprecyzyjne zapisy specyfikacji istotnych warunków zamówienia (SIWZ) są powodem późniejszych problemów wykonawców z przygotowaniem oferty. W artykule uwaga zostanie skupiona jedynie na dwóch punktach SIWZ mających szczególne znaczenie przy ustaleniu podstawowego elementu oferty przetargowej, jakim jest kalkulacja ceny ofertowej. Są to „opis przedmiotu zamówienia”, gdzie zamawiający precyzuje, co będzie podlegało wycenie i „opis sposobu obliczenia ceny ofertowej”, gdzie z kolei określone są wymagania co do formy i podstaw określenia kalkulacji. W artykule przedstawiono najczęściej występujące błędy występujące w SIWZ wraz z przykładami zaczerpniętymi z dokumentacji postępowań.

Proper preparation of the tender bid meeting the awarding entity requirements determinates the possibility of winning the contract. On many occasions contractors have problems with the interpretation of the awarding entity requirements and price calculation because relevant provisions are described in the specification of the contract’s terms of reference in an imprecise way. In the paper attention will be focused on two issues essential to calculating the price: “description of the object of contract” and “description of the price calculation method”. The paper presents the most common errors made in the specification of the terms of reference of contracts related to described issues. Several examples of such errors are also shown in the paper.
