W artykule poświęcono główną uwagę zagadnieniu prawnemu jakim jest umowa franchisingowa. Punktem wyjścia rozważań była próba określenia istoty oraz przedmiotu umowy franchisingowej. Analizie poddano również uwarunkowania prawne dotyczące umowy franchisingowej. Zwrócono uwagę na główny element umowy jakim jest pakiet franchisingowy. Autorka wskazała również na ograniczenia przy konstruowaniu umowy jak również na odpowiedzialność stron za jej niewykonanie lub nienależyte wykonanie oraz terminy przedawnienia.

The article’s main focus is a legal issue which is the franchise contract. The starting point of the discussion was an attempt to define the essence and the object of a franchise contract. Legal conditions concerning a franchise contract have been analysed. The principal component of the agreement was highlighted: the franchising package. The author has also pointed out the limitations while designing an agreement, as well as the parties’ responsibility for its nonperformance, improper performance and limitation periods.
