The recent pandemic, which is affecting virtually all the countries in the world, has posed a range of formidable challenges for public authorities. One of these has involved developing legal procedures to protect the lives and health of citizens, as well as to maintain a functional State apparatus and economy. It was necessary, however, that the regulations adopted to that end did not undermine core principles, even in emergency and dangerous situations. They were meant to safeguard core democratic values, while also setting certain limitations. It was imperative that the legislation be passed in accordance with constitutional rules. And this particularly involved legal sanctions, which are the focus of this paper. The paper examines Polish Penal Code provisions in terms of their alignment with the current pandemic situation. Consideration is given to whether they require improvements, and, if so, what could be improved.

Pojęcie rzeczy świętej nie jest opisane przez prawodawcę w KPK/83 w szczegółowy sposób. Prawodawca stanowi tylko, iż kompetentny organ poprzez akt poświęcenia lub błogosławieństwa nadaje rzeczy charakter sakralny. Skutkiem takiego aktu jest wyłączenie rzeczy z użytku publicznego i nadanie jej szczególnego charakteru, a także objęcie jej ochroną. Prawo Kościoła do karania tych wiernych, którzy dopuszczają się czynów przez niego zabronionych nadane jest mu przez jego założyciela i przynależy Kościołowi z uwagi na jego społeczny charakter. Kościół może wymierzać sankcje karne tylko swoim wiernym. Człowiek staje się wiernym Kościoła i podmiotem jego praw i obowiązków w momencie przyjęcia chrztu świętego lub w momencie formalnego do niego wstąpienia. Podmiotem przestępstwa profanacji, w rozumieniu prawa kanonicznego, jest tylko osoba fizyczna, która jest poczytalna, czyli świadoma swojego czynu w chwili jego dokonania i działająca w sposób wolny. Profanacja zaś polega na użyciu rzeczy świętej do celu świeckiego lub niewłaściwego. Karą jaką prawodawca przewidział za profanację rzeczy ruchomej i nieruchomej jest kara sprawiedliwa, która ma być wymierzona przez sędziego lub przełożonego kościelnego zgodnie z zasadą proporcjonalności kary do przestępstwa. Ma ona uwzględniać również okoliczności czynu oraz indywidualne cechy sprawcy.

The concept of holy things is not described by the legislator in 1983 Code in the detailed way. The legislator only determines that the competent body through the act of blessing or sacrifices grants sacred character to the item. In effect of such an act is to exclude the thing from public use and grant it a special nature, as well as protecting it. The right of the Church to punish the faithful who are commit acts forbidden by it is granted by its founder and belongs to the Church due to its social nature. The Church can impose criminal sanctions only on its faithful. The man becomes one of the faithful of the Church and subject to its rights and obligations in the moment of accepting holy baptism, or in the moment of formal admission to it. The subject regarding the crime of desecration can only be a natural person who is sane, i.e. conscious of their act in the moment of doing it as defined in the Canon Law and acting freely way. Whereas the profanation consists in using the thing, for secular or improper acts. The penalty which the legislator has provided for desecration of mobile and fixes things is a fair punishment, which is to be imposed by a judge or ecclesiastical superior in accordance with the principle of proportionality of punishment to the crime. It also take into account the circumstances of the act and the individual characteristics of the perpetrator.
