In the issues of terrorist threats, which constitute one of the most serious threats to national security, numerous state organs and institutions are involved, and the effectiveness in combating terrorism depends to a large extent on the coordination of their activities. Increasingthe competence of state bodies in this area can notlead to disproportionate restrictions in exercising freedoms and rights by citizens. The Anti- Terrorism Act enacted by the Parliament in June 2016 does not provide forsuch guarantees. The article analyses the adopted solutions and indicates regulations that raise the greatest doubts.

W kwestii zagrożeń terrorystycznych, stanowiących jedno z najpoważniejszych zagrożeń dla bezpieczeństwa narodowego, włączone są liczne organy i instytucje państwowe, a skuteczność w zwalczaniu terroryzmu w dużej mierze zależy od koordynacji ich działalności. Zwiększenie kompetencji organów państwowych w tym obszarze nie może prowadzić do nieproporcjonalnych ograniczeń w korzystaniu z wolności i praw przez obywateli. Ustawa antyterrorystyczna uchwalona przez parlament w czerwcu 2016 r. nie przewiduje takich gwarancji. Artykuł analizuje przyjęte rozwiązania i wskazuje regulacje wywołujące największe wątpliwości.

Terrorism has been threatening modern societies for many decades. Legislative response to this issue includes creating various definitions and classifications of terrorist acts on one hand and introducing „repressive” counterterrorism laws on the other. This is not a new phenomenon, however, in the history of fight against terrorism there has been many „counterterrorism acts” which did not succeed in resolving the issue – which is illustrated in the article with appropriate cases of XIX century’s terrorist acts. Appropriate, evidence based counterterrorism methods should be sought rather than repressive methods relying mainly on the society’s fear of terrorism.

The article presents Russian and Chinese experiences in the fight against terrorism and a joint venture, which is the Regional Anti-Terrorist Structure of the Shanghai Cooperation Organization. The article has been divided into several thematic parts in which I analyzed terrorism in Russia, as well as legal and organizational regulations for its control. Then I characterized terrorism in China and their legal solutions. Two subsequent parts of the article present the issue of combating terrorism within the SCO and the functioning of the Regional Anti-Terrorist Structure of the SOC.

W artykule przedstawiono rosyjskie i chińskie doświadczenia w walce z terroryzmem oraz wspólne przedsięwzięcie, jakim jest Regionalna Struktura Antyterrorystyczna Szanghajskiej Organizacji Współpracy. Artykuł został podzielony na kilka tematycznych części, w których kolejno analizowano terroryzm w Rosji oraz regulacje prawne i organizacyjne jego zwalczania. Następnie scharakteryzowano terroryzm w Chinach oraz rozwiązania prawne zaproponowane przez to państwo. Dwie kolejne części artykułu przedstawiają problematykę zwalczania terroryzmu w ramach SOW oraz funkcjonowanie Regionalnej Struktury Antyterrorystycznej SOC.
