Brak równowagi sił w relacjach kredytodawca – kredytobiorca przyczynił się do opracowania kompleksowego uregulowania kwestii prawnych dotyczących kredytu konsumenckiego na rynku polskim. Już w procesie przedakcesyjnym Polska została zobligowana do zbliżenia swojego ustawodawstwa w tym zakresie do wymogów europejskich. Unijna Dyrektywa 87/102/EWG z dnia 22 grudnia 1986 r. była pierwszym wspólnotowym aktem regulującym ochronę konsumentów w stosunkach kredytowych. Próbą uregulowania problemów związanych z kredytem konsumenckim na polskim rynku bankowym było uchwalenie ustawy z dnia 20 lipca 2001 roku o kredycie konsumenckim, która weszła w życie 19 września 2002 r. Nowy wspólnotowy porządek prawny wymuszał na tej ustawie kolejne zmiany. Nowa ustawa o kredycie konsumenckim uchwalona została w dniu 17 sierpnia 2011 r., a obowiązuje w Polsce od 18 grudnia 2011 r.

No balance in powers between the borrower and the lender has contributed to a com¬plete study regulating the legal issues concerning consumer loans in the Polish market. In the pre-accession period Poland was obliged to adjust its legislation to the European requirements. The EU Directive 87/102/EWG dated 22 December 1986 was the first EU Deed regulating protection of consumers in lending activities. Adoption of the Act on the consumer loan dated 20th July 2001 that became effective on 19th September 2002 was an attempt to solve the problems related to consumer loans. EU new legal order enforced changes to the Act. The new Act on the consumer loan was adopted on 17th September 2011 and has been in force since 18th December 2011.
