The article focuses on the issue of the legal status of a non-profit organization, whose statutory purpose is to protect animals in the administrative proceedings under Art. 7 (3) of the Polish Animal Protection Act, which is the subject of discrepancy of interpretations in the jurisprudence of administrative courts. The institution of temporary collection of an animal regulated in Art. 7 (3) of the Polish Animal Protection Act is of fundamental importance for humanitarian protection of animals in Poland. In theory it consists of taking away the mistreated animal from its owner and subsequent confirmation of that fact through the administrative decision issued by the executive body of the municipality. The study deals with the problem of its legal interest in the proceedings and, as a consequence, it analyses its position as a party or entity as a party in the proceedings. Determining the status of a non-profit organization in proceedings is crucial for resolving another problem raised in the article, namely the mode in which proceeding under Art. 7 (3) of the Polish Animal Protection Act is being initiated.

Artykuł dotyczy zagadnienia statusu prawnego organizacji społecznej, której statutowym celem działania jest ochrona zwierząt w postępowaniu uregulowanym w art. 7 ust. 3 ustawy o ochronie zwierząt. Problem ten jest przedmiotem rozbieżności interpretacyjnych zarówno w orzecznictwie sądów administracyjnych, jak i w doktrynie. Określona w powyższym przepisie procedura ma podstawowe znaczenie dla humanitarnej ochrony zwierząt w Polsce, a polega na interwencyjnym odebraniu maltretowanego zwierzęcia właścicielowi i następczym potwierdzeniu tego faktu poprzez wydanie decyzji administracyjnej przez organ wykonawczy gminy. Opracowanie traktuje o kwestii posiadania przez organizację interesu prawnego bądź obowiązku w przedmiotowym postępowaniu, w konsekwencji przeprowadzono analizę pozycji organizacji w postępowaniu jako strony lub podmiotu na prawach strony. Przesądzenie o statusie organizacji społecznej w postępowaniu jest kluczowe dla rozstrzygnięcia kolejnego poruszonego w artykule problemu, a mianowicie sposobu, w jaki wszczynane jest postępowanie uregulowane w art. 7 ust. 3 ustawy o ochronie zwierząt, co również jest kwestią sporną zarówno w orzecznictwie, jak i w działalności organów administracyjnych.

The aim of the article is to discuss the crimes of killing and abusing animals set out in the Animal Protection Act. The characteristics of the subjective side of the analyzed acts were analyzed. Attention was drawn to the problem related in particular to the subject of the crime of animal abuse. The positions of the representatives of the criminal law doctrine and views appearing in the jurisprudence, especially of the Supreme Court, were presented.

Celem artykułu jest podjęcie tematyki przestępstwa znęcania się nad zwierzętami, określonego w ustawie o ochronie zwierząt. Poddane analizie zostały znamiona strony podmiotowej omawianego przestępstwa. Przedstawiono stanowiska przedstawicieli doktryny prawa karnego oraz poglądy występujące w orzecznictwie, szczególnie Sądu Najwyższego.
