W dniu 1 stycznia 2012 r. na Węgrzech weszła w życie nowa Ustawa Zasadnicza, która wprowadziła m.in. istotne zmiany w zakresie samorządu lokalnego. Przedstawiona analiza odnosi się do węgierskiego ustroju samorządu terytorialnego i zawiera ocenę skutków zmian w zakresie kompetencji organów samorządu terytorialnego, ich struktury organizacyjnej oraz środków nadzoru. Zasady dotyczące samorządu lokalnego są uregulowane w ustawie organicznej, której zmiana wymaga większości 2/3 głosów w Zgromadzeniu Krajowym. Jest to ustawa organiczna CLXXXIX z 2011 r. o samorządzie terytorialnym Węgier.
The hereby paper takes up the analysis of the constitutional position of the Finnish parliament Eduskunta from the moment of its establishment and as a result of its development during the centuries, with a special attention paid to the present normative state and on the basis of the hitherto constitutional practice. It aims at deriving the origin and presenting the evolution of this authority at the Finnish lands, which in consequence leads to reliable conclusions in the scope of determining its current constitutional position in the system of the supreme state authorities of Finland. The subject of the paper focuses on the analysis of the beginnings of Eduskunta’s formation and Finnish parliamentarianism, its further evolution, current composition, internal structure, functions and competences presented on the basis of the exegesis of the provisions of the binding basic law of 1999 and the parliament’s rules of procedure. The constitutional principles referring to the parliament and the analysis of Eduskunta’s relations with the other supreme state authorities, which determine the state’s form of government, seem to be of particular significance in this context, as they contribute to a more precise definition of Eduskunta’s constitutional position, as well as to pointing out its originality and dissimilarity regarding other contemporary democratic states.
Niniejsze opracowanie zawiera analizę pozycji ustrojowej parlamentu finlandzkiego Eduskunty, ze szczególnym uwzględnieniem obecnego stanu normatywnego i dotychczasowej praktyki ustrojowej. Artykuł ma na celu ukazanie genezy oraz przedstawienie ewolucji tego organu, co pozwoli na ustalenie jego obecnej pozycji ustrojowej w systemie naczelnych organów państwowych Finlandii. Przedmiot opracowania stanowi analiza początków kształtowania się Eduskunty oraz parlamentaryzmu finlandzkiego, jego ewolucja, a nade wszystko aktualny skład, organizacja wewnętrzna, funkcje i kompetencje przedstawione w oparciu o egzegezę postanowień obowiązującej ustawy zasadniczej z 1999 roku oraz regulaminu parlamentu. Szczególnie istotne w tym kontekście wydają się zasady konstytucyjne odnoszące się do parlamentu oraz analiza relacji Eduskunty z innymi naczelnymi organami państwowymi, determinujące formę rządu państwa, co w konsekwencji przyczynia się do ustalenia i bardziej precyzyjnego określenia jej pozycji ustrojowej, a także wykazania jej oryginalności oraz odmienności względem innych współczesnych państw demokratycznych.

The hereby paper undertakes the analysis of the genesis and evolution of the Finland’s Parliament Eduskunta from the moment of its establishment till nowadays, including the characteristics of its present constitutional position, being a result of its development during the centuries, with paying special attention to the current normative state and made on the basis of the hitherto constitutional practice. The article aims at deriving the origin and presenting the development of this organ in Finland, which in consequence leads to reliable conclusions in the field of determining its current constitutional position in the system of the supreme state authorities of Finland. The subject of the paper particularly focuses mostly on the analysis of the beginnings of Eduskunta’s formation and Finnish parliamentarianism, as well as its further evolution during different periods of its history, i.e. the time when Finland was included into the Kingdom of Sweden, the period when it was incorporated into the Russian Imperium and after it gained independence in 1917. The work also concentrates on the analysis of Eduskunta’s current constitutional position, its composition, internal structure, functions and competences presented on the basis of the exegesis of the provisions of the binding Basic Law of 1999 and the Parliament’s Rules of Procedure. The constitutional principles referring to the Parliament also seem to be of particular significance in this context, for they contribute to a more precise definition of Eduskunta’s constitutional position, as well as to pointing out its originality and dissimilarity regarding parliaments of other contemporary democratic states.

W niniejszym opracowaniu przeprowadzono analizę genezy i ewolucji parlamentu finlandzkiego – Eduskunty: od chwili jego ustanowienia do czasów współczesnych, w tym – na podstawie dotychczasowej praktyki ustrojowej – dokonano charakterystyki obecnej pozycji ustrojowej tego parlamentu, będącej wynikiem jego rozwoju na przestrzeni wieków, ze szczególnym uwzględnieniem aktualnego stanu normatywnego. Artykuł ma na celu ustalenie źródeł powstania oraz przedstawienie rozwoju tego organu w Finlandii, co w konsekwencji prowadzi do wiarygodnych wniosków w zakresie określenia jego obecnej pozycji ustrojowej w systemie naczelnych organów państwowych Finlandii. Przedmiot pracy koncentruje się przede wszystkim na analizie początków Eduskunty i parlamentaryzmu fińskiego, a także dalszej ewolucji Eduskunty w różnych okresach, tj. w czasach, gdy Finlandia była włączona do Królestwa Szwecji, funkcjonowała w obrębie Imperium Rosyjskiego oraz po uzyskaniu przez nią niepodległości w 1917 r. Opracowanie koncentruje się też na analizie obecnej pozycji ustrojowej Eduskunty, jej składu, organizacji wewnętrznej, funkcjach oraz kompetencjach przedstawionych na podstawie egzegezy postanowień obowiązującej ustawy zasadniczej z 1999 r. oraz regulaminu parlamentu. Zasady konstytucyjne odnoszące się do parlamentu również wydają się mieć w tym kontekście szczególne znaczenie, ponieważ przyczyniają się one do dokładniejszego zdeterminowania pozycji ustrojowej Eduskunty, a także wskazują na jej oryginalność i odmienność w stosunku do parlamentów innych współczesnych państw demokratycznych.
Artykuł zawiera rozważania o idei władzy ustawodawczej narodu oraz o istocie konstytucji jako materialnym jej ucieleśnieniem. Analizie poddano kluczowe momenty współczesnej konstytucyjnej historii Ukrainy: przyjęcie Traktatu Konstytucyjnego 8 czerwca 1995 r., uchwalenie Konstytucji Ukrainy 28 czerwca 1996 r. oraz przyjęcie Ustawy Ukrainy “O zmianach do Konstytucji Ukrainy” począwszy od 8 grudnia 2004 r. Z punktu widzenia koncepcji władzy ustawodawczej zbadano orzeczenia Sądu Konstytucyjnego Ukrainy od 30 września 2010 r. oraz działalność “Zgromadzenia Konstytucyjnego” utworzonego w 2012 r. Zanalizowane zostały kwestie konstytucyjności i prawomocności procedury odnowienia pierwotnego tekstu Konstytucji Ukrainy od 8 grudnia 2004 roku, w tym podczas rewolucji godności 2014 roku.

The article discusses the concept of the legislative power of Ukrainian people and their constitution as a material embodiment of this idea. The author analyzes such key moments of the modern constitutional history of Ukraine as the adoption of the Constitutional Treaty of June 8, 1995, the Constitution of Ukraine of June 28, 1996, and the Amendments to the Constitution of Ukraine Act of December 8, 2004. In terms of the concept of legislative power, the Decision of the Constitutional Court of Ukraine of September 30, 2010 and the activity of the Constitutional Assembly formed in 2012 by Viktor Yanukovych are investigated. The article also considers the issue of the constitutionality and legitimacy of the procedure for modifying the wording of the original Constitution of Ukraine of December 8, 2004 in 2014 during the Revolution of Dignity.
Konstytucja Rosji z 1993 r. była wielokrotnie zmieniana. Największa nowelizacja została przeprowadzona 14 marca 2020 r. Nie jest to jednak rewizja ustawy zasadniczej. Nowelizacja zawiera zmiany wzmacniające pozycję konstytucyjną Prezydenta FR, korygujące ustrój federalny oraz status prawny dwuizbowego parlamentu i Rządu FR. Wprowadzono nowy organ konstytucyjny Radę Państwową FR oraz po raz pierwszy zapis o wierze w Boga. Zapisano prawo Rosji do nieuznawania orzeczeń i decyzji organów międzynarodowych sprzecznych z Konstytucją FR oraz prawo wspierania rodaków mieszkających za granicą w wykonywaniu ich praw w celu zapewnienia ochrony ich interesów. Nowelizacja Konstytucji FR ma zasadnicze znaczenie dla prowadzonej polityki i realizowania strategii bezpieczeństwa narodowego Rosji.

The 1993 Russian constitution has been amended many times. The largest amendment was carried out on March 14, 2020. However, this is not a revision of the Constitution. The amendment includes changes strengthening the constitutional position of the President of the Russian Federation, correcting the federal system and the legal status of the bicameral Parliament and the Government of the Russian Federation. A new constitutional body was introduced, the State Council of the Russian Federation, and, for the first time, a provision on faith in God was introduced. Russia’s right not to recognize rulings and decisions of international bodies contrary to the Russian Constitution and the right to support compatriots living abroad in the exercise of their rights to protect their interests were enshrined. The amendment to the Russian Constitution is of fundamental importance for the policy pursued and the implementation of Russia’s national security strategy.
The legal status of the independent Pridnestrovian Moldavian Republic, which in 1990 seceded from Moldavia being then a part of the USSR, still remains unclear. Although over a quarter of the century has passed since its creation, it is still a de facto state, for it has not been recognized by the international community. In the lights of the international law Transnistria is treated as a Moldavian autonomous region of a special status. The hereby paper is the next publication out of the series, undertaken within the wider research over Transnistria’s legal status. It comprises the fragmentary results of the further research phase, which aims at analysing its binding basic law and the assumptions of its constitution- al system. The subject of the work is the shape and content of the independent Transnistria’s constitution of 1995, which has been revised several times and is still in force. The results of this research contributes to more precise determination of the region’s legal status.

Status prawny niepodległej Naddniestrzańskiej Republiki Mołdawskiej, która w 1990 roku dokonała secesji od Mołdawii, będącej wówczas jeszcze w składzie ZSRR, wciąż pozostaje niejasny. Mimo że od chwili jej powstania minęło już ponad ćwierć wieku, jest państwem faktycznym, gdyż dotąd nie zostało uznane przez społeczność międzynarodową. W świetle prawa międzynarodowego Naddniestrze jest traktowane jako jednostka autonomiczna Mołdawii o statusie specjalnym. Niniejsze opracowanie stanowi kolejną publikację z serii szerzej zakrojonych badań nad statusem prawnym Naddniestrza. Zawiera cząstkowe wyniki ich następnego etapu, mającego na celu analizę obecnie obowiązującej naddniestrzańskiej ustawy zasadniczej i założeń systemu konstytucyjnego. Przedmiotem opracowania jest kształt i treść konstytucji niepodległego Naddniestrza z 1995 roku, która była wielokrotnie nowelizowana i obowiązuje do dziś. Wyniki tych badań stanowią przyczynek umożliwiający bardziej precyzyjne określenie statusu prawnego regionu.

Концепції повного відокремлення костелу від держави, яку представляло ліве крило, протиставлялася концепція правого крила з перспективою римо-католицького костелу як правлячого. У прийнятій березневій Конституції знайдено компромісну формулу, спрямовану на збереження принципу рівності віросповідань, підкреслюючи при цьому особливе становище католицького костелу. Запровадивши поділ державою на прийняті та невизнані конфесії, у першій групі, Конституція по-різному визначила автономію католицького костелу. Детальний обсяг повноважень костелу мав регулюватись конкордатом зі Святим Престолом. Серед інших конституційних рішень, що стосуються моделі світської держави принцип свободи совісті та віросповідання, а також рівності незалежно від віросповідання. У березневій конституції постулат правого крила про те, що посаду президента повинен займати лише поляк-католик, також не було реалізовано. Статтю про конфесійну школу до Конституції не було внесено, але обов’язковість релігії в державних і місцевих школах збережено. Результатом конституційних дебатів 1919–1921 рр. став ідеологічний і системний компроміс – у конституційному законі, ухваленому 17 березня 1921 р., не домінували ні праві, ні ліві. Ця ситуація стала джерелом численних політичних конфліктів і зусиль щодо перегляду березневої Конституції.

Концепциям левого крыла полного отделения церкви от государства правые противопоставляли перспективу Римско-католической церкви как правящей силы. В принятой Мартовской Конституции была найдена компромиссная формула, направленная на сохранение принципа равноправия конфессий, но при этом подчеркивающая особое положение Католической церкви. Вводя разделение на конфессии, принятые государством, и конфессии, не принятые государством, Конституция особо определила автономию Католической церкви в первой группе. Подробный объем прав Церкви должен был регулироваться конкордатом со Святым Престолом. Конституционные решения, относящиеся к модели светского государства, включали принцип свободы совести и религии, а также равенства независимо от религии. В Мартовской Конституции не был реализован постулат правых о том, что только поляк-католик должен занимать пост президента. Статья о религиозных школах не была внесена в Конституцию, но обязательность религии в государственных и местных школах была сохранена. Конституционные дебаты 1919–1921 годов привели к идеологическому и политическому компромиссу – ни правые, ни левые группировки не доминировали в Основном законе, принятом 17 марта 1921 года. Эта ситуация стала источником многочисленных политических конфликтов и попыток пересмотра Мартовской Конституции.

During the constitutional debate in 1919–1921, religious issues provoked a great deal of discussion and controversy. The concept of the left wing of the complete separation of the Church from the state was contrasted by the right wing with the formula of the Roman Catholic Church as ruling. In the adopted March Constitution, a compromise formula was found, aimed at preserving the principle of equality of faiths, while emphasizing the special position of the Catholic Church. By introducing the division into accepted and unrecognized denominations by the state, the constitution defined the autonomy of the Catholic Church differently in the former group. The detailed scope of the Church’s powers was to be regulated by the concordat with the Vatican. The constitutional solutions referring to the secular state model include, inter alia, the principle of freedom of conscience and religion as well as equality regardless of religion. The right wing’s postulate that only a Pole-Catholic would hold the office of president was not implemented in the March Constitution. An article about a denominational school was not introduced into the constitution, but the obligation of religion in state and local government schools was maintained. The result of the constitutional debate in 1919–1921 was an ideological and systemic compromise – neither right-wing nor left-wing groups dominated the constitutional law passed on 17 March 1921. The above situation was a source of numerous political conflicts and efforts to revise the March Constitution.

Podczas debaty konstytucyjnej prowadzonej w latach 1919–1921 szczególnie wiele dyskusji i kontrowersji wywoływały kwestie wyznaniowe. Koncepcjom lewicy całkowitego oddzielenia Kościoła od państwa prawica przeciwstawiała perspektywę Kościoła rzymskokatolickiego jako panującego. W uchwalonej Konstytucji marcowej znaleziono formułę kompromisową, zmierzającą do zachowania zasady równouprawnienia wyznań, przy podkreśleniu szczególnej pozycji Kościoła katolickiego. Wprowadzając podział na wyznania przez państwo akceptowane i nieuznane, w tej pierwszej grupie Konstytucja odmiennie określiła autonomię Kościoła katolickiego. Szczegółowy zakres uprawnień Kościoła miał uregulować konkordat ze Stolicą Apostolską. W rozwiązaniach konstytucyjnych nawiązujących do modelu państwa świeckiego znalazły się m.in. zasada wolności sumienia i wyznania oraz równouprawnienia bez względu na wyznanie. W Konstytucji marcowej nie zrealizowano też postulatu prawicy, aby urząd prezydenta piastował tylko Polak-katolik. Do Konstytucji nie wprowadzono artykułu o szkole wyznaniowej, ale utrzymano obowiązek religii w szkołach państwowych i samorządowych. Efektem debaty konstytucyjnej z lat 1919–1921 był kompromis ideowo-ustrojowy – ani ugrupowania prawi-cowe, ani lewicowe nie zdominowały uchwalonej 17 marca 1921 r. ustawy zasadniczej. Sytuacja ta stanowiła źródło licznych politycznych konfliktów i dążeń do rewizji Konstytucji marcowej.
