Transitional justice in the post-communist countries of Eastern Europe concentrates on the problem of the lustration of former secret service officers and their clandestine collaborators and on the question of access to files created by the communist political police. The aim of the article is to present the Polish experience in this field in view of the theoretical framework available in transitional justice literature. Thus, the text begins with definitions of some basic notions connected with dealing with the past. The article also proposes three basic models of transitional justice. The third part offers an account of Polish lustration and public disclosure measures and assigns those instruments to the models of transitional justice. The final section presents some concluding remarks on the evolution of Polish lustration.

Sprawa lustracji od wielu lat w Polsce wywołuje wiele emocji i jest ściśle związana z procesem dekomunizacji. W dziejach III Rzeczypospolitej lustracja była przyczyną poważnych kryzysów politycznych, czego przykładem było odwołanie rządu Jana Olszewskiego. Przełomowym wydarzeniem było przyjęcie ustawy lustracyjnej w 1997 r., która stworzyła podwaliny do rzetelnego podjęcia problemu lustracji w Polsce. Pomimo upływu lat i nowelizacji przepisów nadal wydają się konieczne zmiany w prawie w celu przestrzegania konstytucyjnych praw, takich jak: prawo do należytego procesu, prawo do wysłuchania czy prawo do obrony i domniemanie niewinności. Artykuł jest próbą wskazania problemów związanych z lustracją oraz zasygnalizowania zmian na przykładzie lustracji Kazimierza Kujdy.

The issue of vetting has for many years stirred up much emotion in Poland and is closely related to the process of decommunization. In the history of the Third Republic of Poland, lustration was the cause of serious political crises, an example of which was the dismissal of the government of Jan Olszewski. A breakthrough event was adopting the lustration law in 1997, which laid the groundwork for a reliable approach to lustration in Poland. Despite the passage of years and amendments to the regulations, it still seems necessary to amend the law to comply with constitutional rights, such as the right to due process, the right to be heard, the right to defense, and the presumption of innocence. The article indicates the problems related to vetting and reports changes on the example of vetting by Kazimierz Kujda.

The article deals with the expiry of the mandate of a Member of Parliament (a Deputy or Senator) in relations to the “termination” of the mandate for reasons other than the end of the term of the Chamber in the statutorily prescribed date. The author describes the preconditions for the expiry of the MP’s mandate, specifi ed in Article 247 § 1 and § 2, Article 279 § 1 and § 2 of the Electoral Code. These preconditions are: the death of an MP; loss of eligibility or lack of it on the election day; deprivation of the mandate of a fi nal and valid decision of the Tribunal of State; waiver of the mandate; holding on the election day a position or function, which pursuant to the provisions of the Constitution or statutes is incompatible with the seat of an MP; appointment during the term for the position or assignment of functions which — pursuant to the provisions of the Constitution or statutes — is incompatible with the seat of deputy or senator, as well as being elected during the term of parliament to the offi ce of Member of the European Parliament.

Psy, film z 1992 r. w reżyserii Władysława Pasikowskiego z biegiem lat stał się legendą polskiego kina, a także źródłem wielu cytatów i przedmiotem swoistego kultu. Psy, pozostając atrakcyjne komercyjnie, zarysowują także wiele problemów związanych z transformacją ustrojową, otwierając dyskusję dotyczącą przeprowadzonej wówczas weryfikacji oficerów SB. Akcja filmu rozgrywa się w 1990 roku, w okresie przemian ustrojowych w Polsce po upadku komunizmu. Zanim na pierwszy plan wysuwa się czysto sensacyjna akcja, film w dużej mierze opowiada o reformie MSW i SB, procedurze weryfikacji ich oficerów, a także o ich losach podczas próby odnalezienia się w nowej rzeczywistości. Film pokazuje przy tym, że niezwykle trudno jest przeprowadzić reformy jednocześnie na wielu płaszczyznach: politycznej, gospodarczej i społecznej, i że może to być źródłem kryzysu. Celem artykułu jest przedstawienie Psów Władysława Pasikowskiego jako filmu ukazującego praktyczne problemy jednego z mechanizmów stosowanych w ramach sprawiedliwości tranzycyjnej, jakim jest procedura weryfikacji. Film, jako artystyczna prezentacja sytuacja poszczególnych funkcjonariuszy poddanych weryfikacji jest punktem wyjścia do refleksji nad sprawiedliwością tranzycyjną i problemem rozliczeń z niedemokratycznym systemem. Artykuł koncentruje się na ogólnym zarysie filmu, ze szczególnym uwzględnieniem komisji kwalifikacyjnych i ich wykorzystania w ramach sprawiedliwości tranzycyjnej. Przedstawiając normatywny model weryfikacji oficerów SB i zestawiając go z obrazem przedstawionym w filmie, autor ukazuje podstawowe problemy moralne i społeczne związane z tego typu mechanizmami.

Pigs, a 1992 movie directed by Władysław Pasikowski, has become an iconic picture over the years, growing into a source of quotes and becoming a cult classic. The film, while remaining commercially attractive, outlines many problems within transitional justice and opens a discussion regarding the vetting of the SB officers carried out at that time, including the selected model. The plot of the film takes place in 1990, the period of political transformation in Poland after the fall of communism. Before the purely sensational action comes to the fore, the movie is largely about a reform of the MSW and the SB, about vetting of its officers and their fate while trying to find themselves in the new reality. It also shows that it is remarkably difficult to carry out reforms simultaneously in many fields: political, economic and social, and that it may be the source of a crisis. The aim of this article is to present Pasikowski’s Pigs as a film that demonstrates the practical issues related to one of the mechanisms used in the framework of transitional justice, namely the vetting process. The movie as an artistic representation of individuals subjected to vetting opens discourse on transitional justice and the problem of dealing with undemocratic system. The paper concentrates on a general outline of the movie, paying attention to the vetting committees and their function within the framework of transitional justice. While presenting the normative model of officers’ vetting and juxtaposing it with the image shown in the film, the author displays basic moral and social problems related to the vetting.
