This article is an analysis of legal admissibility of performing the office of a village administrator by a catholic priest. Despite the fact that this theme has already been a subject of doctrine’s interest, this study distinguish itself from other studies because it is based on a case that took place in practice. That means, obviously, a choice of the Archbishop Sławoj Leszek Głódź for a village administrator of Piaski. Considerations are conducted from three perspectives – commonly applicable law, The Concordat itself and the canonic law. Comparative legal perspective provides a citation of relevant regulations existing in chosen countries. There are also introduced regulations referring to the status of a village administrator in Polish legal order. Conducted considerations allow to conclude that in spite of the fact that Polish commonly applicable law and the Concordat itself strongly emphasize the principle of autonomy and mutual independence of the state and churches and other religious unions, they do not provide for a prohibition of taking over public offices by priests. This case is differently regulated by the Code of Canon Law which directly forbids priests to execute offices connected with performing of public authority. Such offices should involve office of a village administrator, what determines the inadmissibility of performing the office of village administrator by catholic priest.

Unrestrained concentration of public authority is undesirable for the essence of democracy, society counteracts it the harmful effects through a variety of constitutional and legal instruments, a special place in this regard has the principle of incompatibility of public offices. Domestic legislation enacted this principle at all levels public authority also in the community, and particularly it relates the monocratic executive organs and members of municipal councils, not to mention anything about village administrators. In practice local self-government, there are often cases of mergers of public trust mandates, which may be a source of unnecessary controversy. Clarification of these problems seems to be a complex matter, the solution could find in municipal autonomy granted to the community to shape their own internal system.

Artykuł porusza problematykę funkcjonowania w jednostkach pomocniczych jakimi są sołectwa organu wykonawczego, czyli sołtysa. Zagadnienie to zostanie przedstawione na podstawie analizy przepisów ustawy o samorządzie gminnym. Samo omówienie regulacji ustawowych było by jednak niewystarczające, bowiem wskazywało by tylko założone przez ustawodawcę rozwiązania, które w różnym stopniu są stosowane przez poszczególne gminy. Stąd też w artykule przedstawiono rozwiązania dotyczące sołtysa w wybranych statutach gminnych.

The article covers issues concerning the functioning of village administrator - the village executive organ. The problem will be looked at through the prism of Commune Self-government Act regulations. However, a mere analysis of the regulations would not be sufficient, as it would only point to the solutions proposed by the legislator and applied by particular communes. For this reason, the article draws from regulations concerning the village administrator in the statutes of selected communes.

Статья посвящена вопросам функционирования вспомогательных единиц, которыми являются солтысовства как исполнительный орган, т.е. солтыса. Этот вопрос обсуждается на основе положений Закона о местном самоуправлении. Просто обсуждение нормативных актов, однако, будет недостаточным, потому что свидетельствовало бы то лишь о законодательных решениях, которые используются в различной степени каждым сельсоветом. Таким образом, документ представляет решения для председателя сельсовета в отдельных уставах сельсовета.
