W dniu 18 stycznia 2015 r. weszła w życie rozległa nowelizacja ustawy z 19 lutego 2007 r. o ochronie konkurencji i konsumentów. Za sprawą nowelizacji ustawa została wzbogacona o nowe instytucje, nastąpiło udoskonalenie rozwiązań dotychczas funkcjonujących, usunięto także dostrzeżone luki prawne i nieścisłości. Najważniejsze spośród wprowadzonych zmian, na których skupia się niniejszy artykuł, to: wprowadzenie odpowiedzialności osób zarządzających za naruszenie zakazu karteli przez przedsiębiorcę, rozbudowanie instytucji leniency, wprowadzenie możliwości dobrowolnego poddania się karze pieniężnej, wprowadzenie instytucji środków zaradczych, przyspieszenie procedur w sprawie kontroli koncentracji oraz zwiększenie skuteczności kontroli i przeszukań prowadzonych przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów.

On 18 January 2015 an extensive amendment to the Act of 16 February 2007 on competition and consumer protection entered into force. As a result of this amendment new institutions have been introduced, the solutions functioning so far have been improved and legal loopholes and inconsistencies have been removed. The most important modifications, being the focus of this article are the following: the introduction of the responsibility of managers for the infringement of the prohibition of cartels by the entrepreneur, the development of the leniency institution, the introduction of the possibility of voluntary surrender to the monetary penalty, the implementation of remedial measures, the acceleration of procedures to control concentration and increased effectiveness of inspections and searches carried out by the President of the Office of Competition and Consumer Protection.
