In Make It 16 Incorporated vs. the Attorney-General, 21 November 2022, the Supreme Court of New Zealand ruled that existing legislation that does not allow people to vote in elections before the age of 18 is discriminatory because it is inconsistent with the New Zealand Bill of Rights Act 1990, which guarantees citizens freedom from age discrimination after the age of 16. The New Zealand Supreme Court has issued a declaration of incompatibility in this regard. However, this does not oblige either the government or parliament to lower the voting age.
The article deals with the performance of canvassing in the course of the so-called information actions within pre-campaigning in elections of local self-governing bodies, which directly precedes an offi cial electoral campaign. It seems that, under the existing state of law, there is a loophole relating to that type of activities which are beyond the scope of supervision which are beyond the scope of supervision covered by electoral bodies.
Recently, the issue of intercultural relations between immigrants and the host society has been widely discussed. Taking into account the increasing spatial mobility of non-EU foreigners, it seems highly important to examine their relations with the host community on the local level. This article presents the results of the qualitative study conducted in the first quarter of 2014 in the Lesznowola municipality (Mazowieckie province, Piaseczno district) in Poland. It aims at analysing the situation of the Vietnamese community and its engagement in the local life of the municipality and examine attitudes of both Vietnamese and Poles towards prospects for granting local voting rights to migrants in Poland. Through several years of successful business and social cooperation, the Vietnamese immigrants have become a recognisable part of the social landscape of the municipality. The degree of social and political participation at the local level on the part of the Vietnamese community has also increased, which can be observed, for example, through such practical indicator as cooperation with local educational institutions. Therefore, we can argue that the Vietnamese community has been transforming itself from a marginalised and self-sufficient homogeneous group into more and more self-aware and active socio-political group of actors.
The debate as to whether Slovak post-socialist agricultural cooperatives are cooperatives or not represents one of the focal points of their post-1989 development. The answer to this question determined and/or legitimized the rationale for the legislative framework concerning their post-socialist transformation. This analysis draws mainly on data from the parliamentary debates that preceded the enactment of three pivotal laws. In comparing the debates in 1991/1992 and 1995, the examination focuses on the shift in the argumentation put forward by representatives speaking on behalf of cooperative farms. A dramatic shift in reasoning about the character of cooperative enterprises and appropriate voting rights is interpreted as a pragmatic, effect-oriented action. It is argued that both delicate work with the hybrid nature of post-socialist cooperative farms as well as the initial withholding of cooperative principles contributed to the preservation of the specific kinds of agricultural cooperative, and consequently also large corporate farm, which now exist in Slovakia.
The text examines the challenges and opportunities presented by new formats of general meetings held by public limited companies. These were brought about by a recent amendment to Law 6404/76, regulated by the Brazilian Securities and Exchange Commission – CVM, which allows the holding of a digital meeting (everyone participates exclusively by videoconference) or a hybrid format (some participate in person and some by videoconference). These new formats create an opportunity to bring shareholders closer to the corporate life of companies, as it enables online participation in debates and voting on matters of relevance and interest to the company. The text makes comments on the procedures laid out in CVM the regulations to be adopted by companies before, during and after the creation of these new formats and addresses some of the main challenges, such as the possibility of opposition to the digital format by minority shareholders, as a way to mitigate any possible abusive use of these new meeting formats and any loss of the minority shareholders’ right to participate and vote.
The purpose of this paper is to verify the thesis that the right to vote is one of the most significant fields of Indigenous Peoples Rights’ violations. History of the U.S. relations with Native tribes is a history of broken treaties and promises, including these pertain- ing to voting. It is vital to keep track of issues related to voting rights, not only because of the constantly increasing number of court cases related to this issue, but also several legal initiatives proposed in Congress with the aim to make the right to vote more ap- plicable. The first part of the paper enumerates the main reasons for the denial of In- dian Voting Rights. It is followed by the explanation how these limitations were imple- mented. The third part of the work describes how the Indigenous Americans struggled to receive the right to vote. However significant the moment of gaining the right was, it did not put an end to their struggle for equal treatment. On the contrary, a list of court cases based on Voting Rights Act violations is still extending, which is described in the fourth part of the paper. The fifth part examines contemporary issues regarding the Na- tive Americans’ right to vote.

Celem artykułu jest zweryfikowanie tezy, według której czynne prawa wyborcze są jedny- mi z najczęściej łamanych praw przysługujących ludności rdzennej. Historia stosunków USA z plemionami Indian Ameryki Północnej charakteryzuje się szeregiem zerwanych traktatów i niedotrzymanych obietnic, w tym dotyczących praw wyboru przedstawicieli na poszczególnych szczeblach władzy. O ważkości opisywanych zagadnień świadczy nie tylko systematycznie rosnąca liczba spraw sądowych dotyczących praw wyborczych, ale także szereg inicjatyw prawnych zaproponowanych w amerykańskim Kongresie w celu lepszego ich egzekwowania. W pierwszej części artykułu wymieniono główne przyczyny pozbawiania Indian czynnych praw wyborczych. Następnie wyjaśniono, w jaki sposób ograniczenia te zostały wdrożone. W trzeciej części autorzy wskazali na najważniejsze etapy, jakie musieli pokonać rdzenni Amerykanie w procesie ubiegania się o zagwaran- towanie prawa do głosowania. Ostateczne uzyskanie czynnych praw wyborczych nie za- kończyło walki rdzennych Amerykanów o równe traktowanie. Wręcz przeciwnie, lista spraw sądowych opartych na naruszeniach Ustawy o prawie do głosowania wciąż się roz- szerza, co opisano w czwartej części artykułu. Część piąta analizuje współczesne kwestie dotyczące czynnego prawa wyborczego Indian Ameryki Północnej.
W artykule poddano krytycznej analizie regulację budżetu obywatelskiego jako wewnętrznie sprzeczną i wywołującą kontrowersje (w tym wątpliwości konstytucyjne). Wskazano na niektóre wynikające stąd paradoksy oraz rozbieżności między praktyką a orzecznictwem w zakresie rudymentarnych zagadnień: kręgu uprawnionych do udziału czy dopuszczalności wykorzystania określonych danych osobowych. Ponieważ taki stan rzeczy jest nie do zaakceptowania w demokratycznym państwie prawnym, a poddane polemice próby rozwiązań w drodze wykładni nie dają satysfakcjonujących rezultatów, zaprezentowano wybrane argumenty za nadaniem partycypacji budżetowej nowych ram prawnych. Wskazano na niektóre korzyści, mogące płynąć z uregulowania budżetu obywatelskiego w prawie wyborczym (jako odrębnego rodzaju referendum lokalnego) oraz zaproponowanych w zarysie pewnych rozwiązań szczegółowych.

The article subjected the regulation of the participatory budget to a critical analysis as internally contradictory and controversial (including constitutional doubts). It pointed out some resulting paradoxes and discrepancies between practice and jurisprudence in fundamental issues: the eligible participants and the permissibility of using specific personal data. Because such a state of affairs is unacceptable in a democratic legal state and attempts to resolve it through interpretative means have not yielded satisfactory results, selected arguments for providing participatory budgeting with new legal framework are presented. It also highlighted some benefits that could arise from regulating the participatory budget within electoral law (as a distinct type of local referendum) and proposed in an outline some specific solutions.

Obejmuje to zasady moralne, mity polityczne, przekonania i pomysły na temat tego, co tworzy dobre społeczeństwo, podczas gdy język polityki jest instrumentem specyficznego używania określonych sformułowań i słów na arenie politycznej. Można powiedzieć, że słowa są walutą władzy w wyborach. Frekwencja wyborcza jest wskaźnikiem poziomu zainteresowania i partycypacji obywatelskiej w podejmowaniu decyzji politycznych, konkurencyjnych ofert partii oraz obywatelskiego zaufania do aktorów politycznych. Celem artykułu jest analiza kultury politycznej i zachowań wyborczych w Macedonii Północnej i w Albanii. W wyniku przeprowadzonej analizy autor dochodzi do wniosku, że proces demokratyzacji w tych państwach stoi przed niezwykłymi wyzwaniami, związanymi z brakiem dłuższych tradycji demokratycznych oraz z ukształtowanymi postawami niekorzystnymi dla rozwoju demokracji. Ważne aspekty kultury politycznej obejmują wzajemny szacunek, głosowanie, stały dialog polityczny, współpracę polityczną i parlamentarną, stabilne instytucje zamiast silnych liderów, wysoki poziom uczestnictwa w wyborach i partycypację obywatelską w podejmowaniu decyzji politycznych. Political culture is a set of attitudes and practices of people that shape their political behaviour. It includes moral judgments, political myths, beliefs, and ideas about what makes a good society while language of politics is the way of using language and words in the political arena. Words are the “currency” of power in elections. Voter turnout is an indicator of the level of interest and civic participation in political decision making, competitive party offerings, and civic trust in political actors. Extensive participation, when it comes to a competitive system, significantly increases the responsibility of political actors for civic demands and concerns. The aim of the article is to analyze the political culture and electoral behaviour in North Macedonia and Albania. The author makes conclusion based on the analysis presented in the article, that the process of applying democracy in these countries would face extraordinary challenges, caused by the lack of democratic traditions, as well as by established values and attitudes unfavorable for the democracy development. Important aspects of the political culture includes mutual respect, contra voting, the constant and productive political dialogue, political and parliamentary collaboration, stable institutions instead of strong leaders, high level of participation in elections, and expanding the political decision-making area. All of these aspects are considered to be a fragile occurrence in all countries of Southeastern Europe and especially in Albania and North Macedonia.

In the article the electoral system for the Chamber of Deputies of the Parliament of the Duchy of Warsaw is presented. Its legal bases are indicated: the Constitution of the Duchy and its supplementary decrees. The main elements of the Duchy’s electoral system are presented. Its organisational basis was a network of single-mandate electoral districts created by county assemblies and communal assemblies. Participation in them required the fulfillment of a number of criteria enabling citizens to exercise their electoral rights. The procedure for electing MPs and deputies as well as the voters’ rights are herein discussed. It is remarked that the voters could cast a single vote, an approving vote, or exercise block voting. The rule for deciding in elections is further presented. An electoral victory could result from a unanimous election or from a relative majority of votes. The electoral system of the Duchy of Warsaw is then compared to French proposals and it is demonstrated that it drew mainly from the Polish parliamentary tradition. The practical application of this system in the 1809 and 1811 elections, dominated by the desire for a unanimous election, is outlined.
Distribution of yearly profits in companies raises complex issues pertaining to the statutory framework of shareholder relationship. Under Article 191 and 347 of the Code of Commercial Partnerships and Companies the above matter is decided by the resolution passed at the annual general meeting and (as such) is left to the discretion of the controlling members. Notably, the general meeting can retain profits in the company or declare low dividends. However, in light of the Supreme Court’s decisions, the above resolution, reflecting only the interests of the majority, can be viewed as oppressive for the minority and consequently set aside in court. The consequences of the court ruling are, nonetheless, unclear, as it does not imply an obligation on the company to pay higher dividends. Some authors go as far as to argue that the ruling itself is of no value to the claimants and that the majority rule in Polish company law is unconditional and absolute.The article explores the above issue in the context of a public limited company and attempts to answer the question of whether the minority shareholders can protect their rights in the event of excessive (abusive) restrictions on profit distribution.

Podział rocznego zysku w spółce kapitałowej jest źródłem złożonych zagadnień związanych z istotą i normatywnym ukształtowaniem relacji korporacyjnej. Przepisy art. 191 i 347 Kodeksu spółek handlowych poddają powyższą kwestię kontroli większości na zgromadzeniu. Zgromadzenie może m.in. podjąć uchwałę o tezauryzacji wyniku finansowego lub wypłacie minimalnej dywidendy. Jak jednak wynika z orzecznictwa Sądu Najwyższego, powyższa uchwała, realizująca interes wyłącznie większości, może być uchylona przez sąd, jako sprzeczna z dobrymi obyczajami i mająca na celu pokrzywdzenie mniejszościowych udziałowców. Jednocześnie konsekwencje wyroku uchylającego nie są oczywiste, ponieważ nie zobowiązuje on pozwanej spółki do wypłacenia większej dywidendy. W literaturze zakwestionowano wręcz praktyczne znaczenie takiego orzeczenia, wskazując, że nie ma ono wymiernego skutku w sferze praw wspólników, a reguła rządów większości w zakresie dysponowania wynikiem finansowym ma charakter bezwzględny. Celem artykułu jest analiza powyższego zagadnienia w kontekście stosunków spółki akcyjnej oraz odpowiedź na pytanie, czy w przypadku abuzywnej praktyki ograniczania wypłaty zysku akcjonariusze mniejszościowi mogą realnie chronić swoje interesy.
