Celem artykułu jest przedstawienie cywilnoprawnej ochrony praw własności intelektualnej w Polsce. Prawo własności intelektualnej obejmuje dział prawa cywilnego, w którym zawarta jest regulacja prawna dotycząca dóbr niematerialnych (intelektualnych), tj. prawo autorskie oraz działy regulacji dotyczących własności przemysłowej. Podstawowymi aktami polskiego prawa, regulującymi kwestie dotyczące własności intelektualnej, są: 1. w zakresie prawa własności artystycznej, naukowej i literackiej (prawa autorskiego) – ustawa z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych (Dz.U. 1994, nr 24, poz. 83) oraz ustawa z dnia 27 lipca 2001 r. o ochronie baz danych (Dz.U. 2001, nr 128, poz. 1402); 2. w zakresie prawa własności przemysłowej – ustawa z dnia 30 czerwca 2000 r. Prawo własności przemysłowej (tekst jednolity: Dz.U. 2003, nr 119, poz. 1117) oraz ustawa z dnia 16 kwietnia 1993 r. o zwalczaniu nieuczciwej konkurencji (tekst jednolity: Dz.U. 2003, nr 153, poz. 1503).

This paper is an attempt to present the protection of intellectual property by civil law in Poland. The law of intellectual property is included within this section of civil law which regulates the legal treatment of not tangible goods or properties (intellectual property), which embraces the copyright, industrial and commercial property. The basic regulations oft he Polish law regulating issues concerning intellectual property are: 1. regarding artistic, scientific and literary property (copyright) – Act of 4th July 1994 on copyright and related rights (OJ 1994. 24. 83) and the Act of 27th July 2001 on the protection of databases (OJ 2001. 128. 1402); 2. regarding industrial property rights – Act of 30th June 2000, right on idustrial property (consolidated text- OJ 2003. 119. 117) and the Act of 16th April 1993 on combating unfair competition (consolidated text OJ 2003. 153. 1503).
