W przedstawionym artykule ukazano wybrane aspekty sytuacji penitencjarnej osób z niepełnosprawnością intelektualną w Polsce. Rozważania uwzględniają rys historyczny, dotyczący ewolucji nie tylko systemu więziennictwa w tym zakresie, lecz także podejścia do osadzonych z tego rodzaju dysfunkcją. Ponadto omówione zostały kwestie związane z odbywaniem kary pozbawienia wolności przez osoby z niepełnosprawnością intelektualną w systemie terapeutycznym, uzupełnione danymi statystycznymi, które ukazują liczbę osadzonych w tym trybie w latach 2008–2016.

The article presents selected aspects of the penitentiary situation of persons with intellectual disabilities in Poland. The considerations take into account the historical outline of the evolution of the prison system in this respect and the approach to prisoners with this kind of dysfunction. In addition, issues related to the imprisonment of persons with intellectual disability in the therapeutic system were also discussed, which were supplemented with statistical data showing the number of intellectually disabled prisoners in 2008–2016.
Being remanded in custody is a preventive measure which was already known in the Polish law of old. However, during the entire period of the existence of the Polish-Lithuanian Commonwealth, there was no regulation concerning the grounds for applying this measure, authorized entities or the admissible term of detention without a sentence of the court. Similarly, it was exceedingly rare to encounter separate places designated for temporarily holding people in custody. First concepts of principles concerning the execution of provisional detention only appeared in the second half of the 18th century. The final period of the Kingdom of Poland brought about practical reforms in the organization of the prison system also including reforms in the field of execution of pre-trial detention. Polish penitentiary scientists, who were under the influence of the European trends of the Age of Enlightenment, had a quite significant input in this field. One of them was Fryderyk Skarbek and thanks to him a modern detention centre, called Pawiak, which was designed to hold detainees during the investigation, was opened in Warsaw in 1835. The article presents the rules and regulations concerning the functioning of the Main Inquisitorial Prison which were based on the order issued on 26th of November/8 of December 1835 as well as on the comments to it which can be found in a document of the 11th/23rd of June 1858 in “Archiwum Główne Akt Dawnych” [The Central Archives of Historical Records].

Środek zapobiegawczy w postaci tymczasowego aresztowania znany był już w dawnym prawie polskim. Jednak przez cały okres istnienia I Rzeczypospolitej nie było regulacji dotyczących podstaw stosowania tego środka, uprawnionych podmiotów czy dopuszczalnego czasu pozbawienia wolności bez wyroku sądowego. Podobnie do rzadkości należały odrębne miejsca służące do przetrzymywania osób tymczasowo aresztowanych. Dopiero w drugiej połowie XVIII w. pojawiły się koncepcje zasad wykonywania tymczasowego aresztowania. Ostatecznie czasy Królestwa Polskiego przyniosły praktyczne reformy organizacji więziennictwa, także w zakresie zasad wykonywania aresztu tymczasowego. Niemały wkład w to wnieśli polscy penitencjaryści pozostający pod wpływem europejskich prądów oświeceniowych, a jednym z nich był Fryderyk Skarbek, dzięki któremu w 1835 r. uruchomiono nowoczesne więzienie śledcze w Warszawie zwane Pawiakiem. W artykule przedstawiono zasady funkcjonowania Głównego Więzienia Inkwizycyjnego w oparciu o wydaną 26 listopada/8 grudnia 1835 r. instrukcję oraz uwagi do niej zawarte w odnalezionym w Archiwum Głównym Akt Dawnych w Warszawie dokumencie z 11/23 czerwca 1858 r.
The subject of the presentation are the so-called dangerous prisoners in the Polish penitentiary. The number of such prisoners (remand and sentenced prisoners) is continuously changing, now in the whole system there are approximately 400 persons (347 as of 31 May 2005, the whole population was 82,867 prisoners). Dangerous prisoners are qualified into this group by the prison administration on an ex lege basis (those who committed very serious crimes) or for an extremely negative behaviour of the prisoner at the time of his/her isolation. The author describes the group of dangerous prisoners from the sociological, legal and especially human rights points of view. He discusses the methods of their treatment and the issue of the penitentiary learning to deal with such prisoners.
Głównym celem artykułu jest prezentacja wybranych problemów towarzyszących pracy funkcjonariuszy Służby Więziennej na stanowisku wychowawcy więziennego w PRL, jakie podnoszono na łamach branżowego czasopisma „Gazeta Penitencjarna”. Analizie poddano treści artykułów z lat 1967–1970. Wybór okresu końca lat 60. podyktowany był tym, że w latach tych ugruntowaną pozycję zaznaczyła nowa dziedzina wiedzy i praktyki określana mianem pedagogiki penitencjarnej. Dało temu wyraz szereg artykułów poświeconych kwestiom „pedagogiki więziennej” na łamach omawianego czasopisma oraz eksponowana była problematyka wychowania „poprawczego” i „reedukacyjnego” z zastosowaniem rozmaitych metod oraz przypisywaniem szczególnej roli wychowawcy w organizacji tego procesu.

The aim of the paper is to identify difficulties in the rehabilitation of inmates in prisons in communist Poland as presented on the pages of the Penitentiary Gazette. The articles published between 1967–70 were analysed, as this period in time marked the growth of a new discipline of penitentiary pedagogy. A rise in interest in penitentiary pedagogy resulted in the publication of numerous articles focusing on rehabilitation and re-education of inmates, and the role of the rehabilitation officer.
The study of the prison system reform in Poland is a perfect illustration of the political changes that Poles have undergone from a system marked by Soviet totalitarianism to a society that meets the criteria of democracy Ukraine's aspirations to adapt EU solutions in the field of penitentiary reform encourage to learn about Poland's experiences due to the progress of this country in eliminating the communist legacy in the work of the prison system and the Prison Service that oversees it. This task is also valid for contemporary Ukraine and due to the deep cultural and mental ties connecting the two countries, Polish experiences seem to be extremely inspiring. When using the experience of neighbors, one should not forget about the differences. First of all, it should be noted that the period of communism in Poland was clearly shorter, compared to the 70 years of experience of Ukraine, Belarus and other Soviet Republics which, unlike Poland, did not experience full sovereignty. The key to the success of the reforms in Poland was the fact that they were carried out by new, often young people who were prepared to work on the basis of modern knowledge not related to the previous system. Poles condemned the crimes of communism and its legacy. In Ukraine, this has definitely not been done so far, and this is one of the reasons for the failure of the reforms.

Abstract The purpose of this article is to identify the attitudes of Prison Service officers towards the dignity of imprisoned people, and in particular to explore the correlations between selected determinants and the perception of the dignity of prisoners, and their implications. Material and methods This study was conducted between 2014 and 2015 among 475 Prison Service officers working with prisoners. The study had the form of a group-administered questionnaire and was carried out in Prison Service training centres. Results Officers who worked in the Security Department, had longer professional experience, and were less religious, perceived prisoners as inferior to people living on the outside. Respondents who were in a relationship and were practising believers were more likely to risk their lives to defend prisoners. Conclusions The socio-demographic characteristics that determined how Prison Service officers perceived prisoners and their dignity included the department in which they worked, their professional experience, marital status and religiosity.

Streszczenie Celem pracy jest ustalenie postaw funkcjonariuszy Służby Więziennej wobec godności osób pozbawionych wolności, a w szczególności zbadanie korelacji między wybranymi uwarunkowaniami (płcią, działem pracy, stażem zawodowym, religijnością i stanem cywilnym) i postrzeganiem godności osób pozbawionych wolności wraz z implikacjami. Materiał i metody Badania przeprowadzono w latach 2014-2015 wśród 475 funkcjonariuszy Służby Więziennej pracujących w bezpośrednim kontakcie z osobami pozbawionymi wolności. Badania zostały zrealizowane za pomocą ankiety audytoryjnej w ośrodkach szkoleń Służby Więziennej. Wyniki Funkcjonariusze działu ochrony, osoby z dłuższym doświadczeniem zawodowym i mniej religijne postrzegają więźniów jako ludzi gorszych od pozostających na wolności. Respondenci pozostający w związku i regularnie praktykujący są bardziej skłonni zaryzykować życie w obronie skazanych. Wnioski Do cech społeczno-demograficznych funkcjonariuszy Służby Więziennej różnicujących postrzeganie godności więźniów należą: dział pracy, staż zawodowy, stan cywilny i religijność. Nie wykazano natomiast istotnego zróżnicowania w zależności od płci.
The subject of the article is the prison system in Poland, functioning in the years 1945–1958. The purpose of the article is to document and analyze the functioning of the prison system in this period on the example of the Provincial Prison in Bydgoszcz. In pursuit of the purpose of the work, the author formulated a research hypothesis, according to which the expansion and functioning of the post-war prison system contributed to the sharpening and expansion of the system of repression against convicts. In order to verify the hypothesis, research methods based on the analysis of archival documents and statistical data were used.

Tematem artykułu jest system więziennictwa w Polsce Ludowej, funkcjonujący w latach 1945–1958. Celem artykułu jest udokumentowanie i analiza funkcjonowania systemu więziennictwa w tym okresie na przykładzie Wojewódzkiego Więzienia Karno-Śledczego w Bydgoszczy. Realizując cel pracy autor sformułował hipotezę badawczą, zgodnie z którą rozbudowa i funkcjonowanie powojennego systemu więziennictwa przyczyniły się do zaostrzenia i rozbudowy systemu represji wobec skazanych. W celu weryfikacji hipotezy zastosowano metody badawcze oparte na analizie dokumentów archiwalnych i danych statystycznych.
Celem autora jest ukazanie skali zainteresowania studentów problematyką przestępczości oraz zagadnieniami więziennictwa przy przygotowywaniu prac dyplomowych licencjackich i magisterskich w Wyższej Szkole Bezpieczeństwa i Ochrony im. Marszałka Józefa Piłsudskiego w Warszawie od początków jej funkcjonowania (2005) do ubiegłego roku (2018). Artykuł powstał na podstawie dokumentacji wewnętrznej uczelni, przechowywanej w dziekanatach oraz w archiwum. Zakres problemowy prac dotyczących przestępczości i systemu penitencjarnego był bardzo zróżnicowany. Jest on odbiciem głównych zjawisk w wymiarze historycznym i współczesnym. This article discusses the range of student’s interest in crime issues and the prison system in the process of preparations for the thesis – bachelor’s and Master’s degrees at The Marshal Józef Piłsudski College of Security and Protection in Warsaw. The research includes the data collected from the beginning of activity of college (2005) until last year (2018). The article is based on the internal documentation of the college kept in dean’s office and archive. Range of issue of thesis related to crime and prison system is diversified. It is a reflection of main phenomenon in terms of history and present days. Author gives and discusses the examples of subjects.
The article attempts to present the unlawful behavior and attitudes of prison officers who, in the years 1944-1956, while serving in the then province, committed criminal, unethical, sexual behavior. The victims of this type of situation were persons deprived of their liberty and, in some cases, members of their families. The perpetrators of this type of behavior used their official position, and counted on impunity and no need to incur official and criminal liability.

W artykule podjęto próbę zaprezentowania niepraworządnych zachowań i postaw funkcjonariuszy więziennictwa, którzy w latach 1944–1956, pełniąc służbę na terenie ówczesnego województwa rzeszowskiego, dopuszczali się zachowań przestępczych, nieetycznych o podłożu seksualnym. Ofiarami tego rodzaju przestępstw były osoby pozbawione wolności, a także w niektórych sytuacjach członkowie ich rodzin. Sprawcy wykorzystywali swoje stanowisko służbowe, liczyli przy tym na bezkarność i brak konieczności ponoszenia odpowiedzialności służbowej i karnej.
Przedmiotem artykułu jest papieskie rozumienie wolności religijnej więźniów i ich godności osobistej. Autor analizuje najpierw stosunek Jana Pawła II do wolności, w tym także wolności religii i sumienia, a potem kwestię podejścia papieża do zagadnień kary (także kary śmierci). Autor zwrócił uwagę na fakt, że Jan Paweł II z godności osoby ludzkiej więźniów wyprowadził ich prawo do wolności religijnej, a karę, w tym karę pozbawienia wolności, uznał za dopuszczalną, jeśli wykonywana jest z uznaniem podmiotowości więźniów. Osobne rozważania poświęcone są papieskiemu nauczaniu adresowanemu do więźniów, zwłaszcza młodych wiekiem, i personelu więziennego. Papież z ojcowską troską traktował młodocianych przestępców, którym systemy wykonawstwa kary powinny umożliwić szansę powrotu do normalnego społeczeństwa. Całość artykułu kończą uwagi o ponadczasowym wymiarze papieskiego ujęcia wolności religijnej osób pozbawionych wolności.

The present article is devoted to the subject of Pope’s understanding of freedom of religious prisoners and their personal dignity. The author first examines John Paul II’s relation towards freedom, including the freedom of religion and conscience, then the question of Pope’s approach towards the issues of punishment (including the death penalty). The present author drew attention to the fact that John Paul II from the human dignity of prisoners derived their right to religious freedom, whereas the punishment, including imprisonment, declared admissible if it is done with the recognition of prisoners’ subjectivity. Separate considerations are devoted to the Papal teaching addressed to prisoners, especially those young ones, and prison staffs. The Pope, with fatherly care, treated juvenile offenders to whom the penalty performance systems should allow a chance to return to normal society. The whole article is summarised by remarks on a timeless dimension of Papal recognition of the religious freedom of people who were deprived of their liberty.
In the nineteenth century, the penalty of imprisonment becomes a basic punishment in many European penal codes, which resulted in a broad discussion about the reform of the prison system, both in Europe and in the Kingdom of Poland. Radically different from the previous penitentiary policy of the authorities of the Kingdom of Poland, it focused mainly on reforms of the organization and operation of prisons. In previous scientific work, relatively little space has been devoted to research into the organization and functioning of detention centres in the Kingdom of Poland. The attention of the researchers focused primarily on theoretical considerations around the then penitentiary doctrines. Only E. Kaczyńska and M. Senkowska conducted broader research based on archival material concerning practical aspects of the functioning of prisons in the Kingdom of Poland, although these works are also fragmentary. Thus, the organization and functioning of prisons in the Kingdom of Poland is still a largely unexplored issue. This is also the future analysis of administrative regulations, in particular from the second half of the nineteenth century and extensive source material preserved in the files of the Governmental Commission of Internal Affairs, voivodship authorities, powiat authorities and municipal documents, which have been preserved in the Central Archives of Historical Records in Warsaw, as well as other state archives.

W wieku XIX kara pozbawienia wolności stała się w wielu europejskich kodeksach karnych karą podstawową, co zrodziło szeroką dyskusję o reformie organizacji więziennictwa w całej Europie – również w Królestwie Polskim. Radykalnie odmienna od dotychczasowej polityka penitencjarna władz Królestwa Polskiego skupiała się głównie wokół reform organizacji więzień. W pracach naukowych stosunkowo mało miejsca poświęcono dotąd badaniom nad funkcjonowaniem ośrodków pozbawienia wolności w Królestwie Polskim. Uwaga badaczy koncentrowała się przede wszystkim na teoretycznych rozważaniach wokół ówczesnych doktryn penitencjarnych. Jedynie E. Kaczyńska i M. Senkowska prowadziły szersze, oparte na materiale archiwalnym badania naukowe dotyczące praktycznych aspektów funkcjonowania więzień w Królestwie Polskim, choć i te prace wykorzystują zaledwie fragmenty materiałów źródłowych. Organizacja i funkcjonowanie więzień w Królestwie Polskim pozostaje zatem nadal zagadnieniem w dużym stopniu niezbadanym. Przed nami analiza przepisów administracyjnych, w szczególności z II połowy XIX w., oraz obszernego materiału źródłowego zachowanego w aktach Komisji Rządowej Spraw Wewnętrznych, władz wojewódzkich, władz powiatowych oraz dokumentach miejskich (zgromadzonych w Archiwum Głównym Akt Dawnych w Warszawie i inne archiwach państwowych).
Educational activities in prisons at the time of the Kingdom of Poland were the consequence of the nineteenth-century change of views related to purposes and conditions concerning serving custodial sentences. The idea of teaching inmates in the Kingdom of Poland began to form in the ’30s of the 19th century and is precisely connected with Fryderyk Skarbek, who founded the first school for juvenile offenders in Warsaw Dom Kary i Poprawy. First resolutions established at the same time by Komisja Rządowa Spraw Wewnętrznych i Duchownych ordered prison authorities to found Sunday schools where adult prisoners could be taught writing and reading. Unfortunately, recommendations of central governmental bodies were not enthusiastically received by lower-level administrative authorities. Eventually, seeing little interest shown by province governments in founding educational establishments for juvenile offenders, Komisja Rządowa Spraw Wewnętrznych i Duchownych authoritatively formed schools in four prisons in 1860 (Warszawa, Kielce, Lublin, Płock) where juvenile off enders were conducted from the whole country. Unfortunately, we do not know how the establishments functioned in reality. Th e issue of teaching adult prisoners is alike. The first establishment was formed in a prison in Kielce just in 1853 despite the fact that Komisja Rządowa Spraw Wewnętrznych i Duchownych had already issued a regulation in 1833 recommending running Sunday schools for adults. It is known that such establishments also functioned in prisons in Sandomierz and Radom.

Działalność oświatowa w więzieniach Królestwa Polskiego była konsekwencją XIX-wiecznej zmiany poglądów na cele i warunki wykonywania kary pozbawienia wolności. Idea nauczania osadzonych przestępców na ziemiach Królestwa Polskiego zrodziła się w latach 30. XIX w. i nierozerwalnie wiąże się z osobą Fryderyka Skarbka, który powołał do życia pierwszą szkółkę więzienną dla nieletnich przestępców w warszawskim Domu Kary i Poprawy. Z tego samego okresu pochodzą pierwsze rozporządzenia Komisji Rządowej Spraw Wewnętrznych i Duchownych nakazujące władzom więziennym zakładanie szkółek niedzielnych, gdzie nauczani pisania i czytania mieli być dorośli więźniowie. Niestety zalecenia centralnych organów rządowych nie były entuzjastycznie przyjmowane na niższych szczeblach władz administracyjnych. Ostatecznie Komisja Rządowa Spraw Wewnętrznych i Duchownych, widząc małe zainteresowanie rządów gubernialnych tworzeniem placówek oświatowych dla nieletnich przestępców, w roku 1860 odgórnie powołała do życia szkółki w czterech więzieniach (Warszawie, Kielcach, Lublinie i Płocku), do których mieli być kierowani nieletni z terenu całego kraju. Niestety nie wiemy, jak w rzeczywistości wyglądało funkcjonowanie tych placówek. Podobnie przedstawiała się kwestia nauczania więźniów dorosłych. Mimo rozporządzenia Komisji Rządowej Spraw Wewnętrznych i Duchownych z 1833 r., zalecającego prowadzenie w więzieniach szkółek niedzielnych dla dorosłych, pierwsza taka placówka powstała w więzieniu kieleckim dopiero w 1853 r. Wiadomo, że takie ośrodki działały jeszcze w więzieniach w Sandomierzu i Radomiu.
Th is article has review character. Its analysis concentrates on selected programmes of social rehabilitation of prisoners which are realized in polish prisons. Th ese programmes are formed by penitentiary personnel and usually have original project. Th ey allow to overcome the barriers to social rehabilitation of prisoners. Th e author analyses the programmes and projects which are realized in two penitentiary institutions in Podkarpackie Voivodship – in prison for women functioning in Remand Prision in Nisko and in prison for men in Rzeszów-Załęże. Th e starting point of discussion are in this article the main problems of prisoners that hinder them eff ective social rehabilitation and therefore there are the barriers of proper functioning in society aft er leaving the prison. Such problems include fi rst of all the broken or disturbed relationships with family, insuffi cient education, qualifi cations and professional experience, social skills defi cit, passivity and helplessness in the implementation of daily aff airs, abuse of alcohol and drugs, inability to control negative emotions, inability to cope with stress and frustration, inability to build positive relationships with others and on the other hand reluctance to prisoners and their stigmatization in society.

Niniejszy artykuł ma charakter przeglądowy. Ukazuje wybrane programy z zakresu społecznej readaptacji więźniów realizowane w zakładach karnych. Są to programy autorskie, tworzone przez kadrę penitencjarną w odpowiedzi na problemy skazanych, stanowiące bariery ich efektywnej resocjalizacji. Analizie poddano programy i projekty realizowane w dwóch jednostkach penitencjarnych w województwie podkarpackim: w zakładzie karnym dla kobiet funkcjonującym na terenie aresztu Śledczego w Nisku oraz w zakładzie karnym dla mężczyzn w Rzeszowie-Załężu. Punktem wyjścia rozważań uczyniono wiodące problemy, utrudniające społeczną readaptację więźniów, stanowiąc tym samym bariery ich bezkonfl iktowego włączania się w życie społeczne po opuszczeniu zakładu karnego. Do takich problemów zaliczyć należy przede wszystkim: zerwane lub zaburzone więzi z rodziną, niski poziom wykształcenia, brak kwalifi kacji i doświadczenia zawodowego, defi cyt umiejętności społecznych, bierność i bezradność w realizacji spraw życia codziennego, skłonność do uzależnień (nadużywanie alkoholu i zażywanie środków odurzających), brak umiejętności kontrolowania negatywnych emocji, radzenia sobie ze stresem w sytuacjach trudnych, nieumiejętność budowania pozytywnych relacji w otoczeniu społecznym, a z drugiej strony niechęć społeczeństwa i stygmatyzacja osób karanych w środowisku społecznym.
I. The paper has been based on literature, on empirical data included in studies and reports in particular. The basic factors that determine the development and the present state of the prison system in the Polish. People's Republic have been indicated. The aim has been to consider the desirable directions of further transformations of the prison system which would guarantee its development according to the principles of humanism and the rule of law. This is important also because amendments are presently discussed' i.a. of the Code of Execution of Penalties. II. Among the important factors that have determined the hitherto development of the prison system in the Polish People's Republic, the following have been mentioned. 1.Legal provisions in force, issued by authorities of different levels, and international documents which influence them to some degree. Attention has been drawn to the incoherence of legal provisions scattered in legal acts of various importance and the society's unacquaintance with them due to their not being published. Immediate tasks the authorities impose upon the machine of execution of penalty. Such activites are aimed at correcting the prison system and frequently have harmful effects (e.g. closing of secondary schools in the early seventies). Traditions of the prison system and the hitherto existing practice, particularly the one developed after World War II when a new political system was introduced in Poland. The traditions are both good and bad. Among the favourable ones, the estimation of the importance of education in the treatment of offenders can for instance be mentioned, among the bad ones-e.g. the tendency to use disciplinary methods of treatment or a certain isolation -of the prison system from the society. 4.Experiences of other countries, scientific views and conclusions from scientific research. The above-mentioned factors are treated in a selective way, i.e. some experiences are chosen for practical application according to the penal policy fulfilled at the moment. III. Among the factors that characterize the present state of the prison system, the following should be mentioned: During the last thirty years, the average yearly number of prisoners was about 90 thousand. The number of the imprisoned persons in Poland I very large as compared with the respective numbers in other countries (if those where such data are published are taken into account). At the same time, it should also be mentioned that the numbers of prisoners in the postwar period were by 50% larger on the average as compared with those before 1939, and that there is overpopulation in prisons as a rule, i.e. the number of inmates is larger than tire prison capacity. This situation is the result of the penal policy which is too repressive according to scientists and which leads to sentencing a considerable part of offenders to long prison terms. Among the basic categories of prisoners in the Polish People's Republic, the following should be mentioned: first offenders (over 40% of the total number of prisoners on the average); recidivists (somewhat of the total number of prisoners on the average); recidivist (somewhat less than 40% on the average); young adults aged under 20 (the group which has recently diminished: less than 10% of the total number of prisoners); women (less than 3%). It should also be mentioned that about 27% of all persons deprived of liberty in the recent years have been those remanded in custody. As regards other categories of prisoners, we lack precise, methodical information due to the lick of properly developed penitentiary diagnostics (this concerns e.g. prisoners-alcoholics, those with mental disorders etc.). However, there are estimations of the numbers of prisoners of these categories to be found in research studies. Moreover, also the material and organizational conditions in which the prison system functions are by no means good. Only a few prisons were built after the war. Many are old buildings, and some date from as long ago as the 18th century. They need repairs and modernization. In the country's present economic situation, development of the prison building cannot possibly be postulated. Irrespective of the lack of space in prisons, there are also other difficulties in providing the proper living conditions for the inmates. As far as the adequate basis for organization of the prisoners, leisure time is concerned, the state of prison libraries, and the universal radiophonic installations are favourable in comparison with the existing difficulties (lack of rooms and proper equipment). Also the prison. staff is an important element of the penitentiary system. The level of education of the staff keeps increasing. However the proportion of prisoners per one staff member is much less favourable than in many West-European countries. The basic means of penitentiary treatment in the Polish People’s Republic are: employment, education and cultural activities. For many years now, there has been nearly full employment of prisoners in Poland universal: the index of employment amounted to over 90% in the seventies and over 80% in the eighties. Among those not working, only a slight percentage were unemployed due to a lack of work. The reasons for being out of work were most frequently the so-called justified reasons such as e.g. poor health, awaiting transfer, etc. Among the employed prisoners, a considerable part were working in the conditions of freedom, outside prisons (in some years, there were over 45% of those who worked in these conditions). At the same time, the vast majority of them were employed against payment (over 8o%), though their wages were lower as a rule than those earned by outside workers in analogous professions. The weak points of the prisoners' The weak employment were: excessive trend towards its economization (i.e. gaining profits even at the cost of the resocializing treatment), and its insufficient use for the prisoners' better professional training and social readaptation. A considerable number of prisoners learn in elementary schools and in elementary vocational schools. Besides, a small number of prisoners learn 'in -secondary vocational schools and at various courses which, however, do not secure a certificate of a qualified worker as a rule. The results of the prisoners' education are most favourable if measured both by the marks at school and by the adjustment to living in the freedom conditions after release. All the studies carried out in Poland which took this problem into account show that the higher the education the prisoners have achieved, the less frequent their relapse into crime. However, the majority of prisoners who have had no profession fail to learn one during their prison sentence. The organization of the prisoners' leisure time has many faults: aside from reading books which are easily accessible, other forms were underdeveloped during the recent dozen or more years as compared with the needs, or revealed regress as compared with the sixties. IV. In the years 1980--1981, new factors emerged which favourably influenced the development of the prison system in Poland. Among them, the most marked trend towards a prison reform should be mentioned which was initiated by independent social movements, scientific centres and the prisoners them - selves (the surge of group protests and riots which on certain days inc1uded tens of thousands of inmates). In 1981, prison reform was started, among other things through the introduction of amendments into the so-called temporary prison rules (the most repressive provisions removed, such as those concerning the so-called fasting penalty or the absolute strict regime for recidivists), and through the admission by means of a separate legal act of universal accessibility of religious practices, including the admittance of chaplains into prisons. At the same time, the functioning of two associations was legalized the activity of which was to consist in coming to the prisoners' and their families' asistance. The associations started operating in l98l; however, they were suspended after the introduction of the martial law and then dissolved. At the same time, the campaign for social aid to prisoners convicted for acts committed or noncriminal motives was organized within the framework of charitable ministry of the Catholic Church. The problem of the prison reform is still a live issue in the Polish People's Republic; moreover, the reform is indispensable. However, its continuation will depend on the future general trends of the State’s policy. V. In the present article, postulates have also been formulated concerning the future amendments of the Code of Execution of Penalties. Here the most important of them: 1. The prisoners rights and duties should be defined precisely and included in a statute instead of in statutory instruments, thus making their informal changes impossible. It is necessary to introduce a separate status of offenders convicted for acts committed for ideological motives. It is indispensable to define in the legal provisions the minimum and untraversable standards of the prisoners material existence, and the index of the maximum capacity of prisons. It is desirable to abandon the formal classification of prisoners and the so-called regimes of execution of penalty the aim of which is first and foremost repression. Also the expansion of resocializing measures is important, as well as increase of the educational character of such penitentiary measures as e.g. employment. In order to give deprivation of liberty a more prosocial character, it is necessary to legalize and render possible the functioning of independent associations assisting the prisoners and their families.
This article provides insight on two Polish prison officers, Wladyslaw Dilaj and Franciszek Jadownicki, who were wardens of the prison located near Grodzki Court (Sąd Grodzki) in Jaroslaw. Due to a scarcity of sources on the aforementioned people, the article is based on archival sources. These sources need to be viewed through a critical lense due to the socio-political reality they were created in. After all, the years 1944–1946 are the period when the communistic system was being “introduced” to Poland. The sources mentioned earlier are quoted in extenso, which in the author’s opinion reflects the reality and the atmosphere of those very dreary times. By serving as an example, this small prison unit is a gateway to present and highlight some of the problems that prison management staff in every prison had to face. Staff shortages, drinking on the job, small intellectual capability of the prison officers, penchant for exhibiting illegal behavior, and finally the abuse of power. This article highlights the lack of competence of some prison officers. However, it focuses on the difficult situations the prison management staff near Grodzki Court found itself in when prison breaks happened. During 1944–1946 there were numerous prison breaks all over the country. The prison near Grodzki Court was not an exception in this regard.

Artykuł przybliża w pewnym stopniu postacie dwóch funkcjonariuszy polskiego więziennictwa. Władysław Diłaj i Franciszek Jadownicki, w takiej właśnie kolejności w latach 1944–1946 pełnili funkcję naczelnika więzienia (aresztu) przy Sądzie Grodzkim w Jarosławiu. Z braku innych materiałów, które dotyczyłyby wspomnianych osób, oparto się na źródłach archiwalnych. Wymagają one krytycznego spojrzenia, były bowiem tworzone w określonej sytuacji polityczno-społecznej. Lata 1944–1946 to przecież czas „instalowania” systemu komunistycznego w Polsce. Wspomniane wcześniej źródła cytowane są in extenso, co zdaniem autora dodatkowo oddaje atmosferę i rzeczywistość tamtych, bardzo ponurych przecież, czasów. Na przykładzie małej jednostki więziennej udało się pokazać niektóre problemy, z jakimi spotykały się osoby piastujące funkcje kierownicze w jednostkach więziennych. Braki kadrowe, pijaństwo na służbie, niewielki potencjał intelektualny większości funkcjonariuszy ówczesnej Straży Więziennej, skłonność do zachowań niepraworządnych, wreszcie nadużycia władzy. Ten artykuł ukazuje przede wszystkim brak kompetencji zawodowych u niektórych więzienników. W pierwszej kolejności jednak zwraca uwagę na problemy ludzi kierujących więzieniem przy Sądzie Grodzkim w Jarosławiu w kontekście licznych ucieczek więźniów. Skala tego zjawiska, zwłaszcza w latach 1944–1946, była bardzo duża. Więzienie (areszt) przy Sądzie Grodzkim w Jarosławiu nie stanowi pod tym względem wyjątku.
