Using the historical and legal method, the article presents the legal and liturgical dimension of the permanent ministry of female acolytes in the Roman Catholic Church. In a condensed way, it presents the legal and liturgical history of acolyte ordination. The author discusses the origin, progress, and consequences of the reform of minor orders instituted in 1972. One of its outcomes was the introduction of a permanent ministry of acolyte for the male laity. The implementation of the reform of minor orders in Poland is set against the background of the liturgical reform carried out in accordance with the directives of the Second Vatican Council. Complementing the reform of the minor orders of Pope Paul VI, the amendment to Can. 230 § 1 of the CIC/83 made by Pope Francis in 2021 introduces a permanent acolyte ministry for female members of the Church.

Artykuł prezentuje z zastosowaniem metody historyczno-prawnej wymiar prawno-liturgiczny stałej posługi akolitatu kobiet w Kościele rzymsko-katolickim. W sposób skondensowany opisuje historię święceń akolitatu. Następnie przedstawia genezę, przebieg i skutki reformy święceń niższych przeprowadzonej w 1972 r. Jednym z jej skutków stało się wprowadzenie stałej posługi akolitatu dla wiernych świeckich mężczyzn. Proces aplikacji reformy święceń niższych w Polsce jest prezentowany w kontekście reformy liturgicznej przeprowadzanej zgodnie z dyrektywami Soboru Watykańskiego II. Nowelizacja kan. 230 § 1 KPK/83 promulgowana przez papieża Franciszka w 2021 r. wprowadza stałą posługę akolitatu dla wiernych kobiet, stanowiąc dopełnienie reformy święceń niższych papieża Pawła VI.
Wprowadzona po Soborze Watykańskim II norma zezwalająca na ustanawianie osoby świeckiej świadkiem kwalifikowanym małżeństwa zawieranego w formie kanonicznej nie została dotychczas szerzej opracowana naukowo w języku polskim. Niniejszy artykuł jest próbą zapełnienia tej luki w polskiej literaturze kanonistycznej. Pierwsza część przedłożenia poświęcona jest rozwojowi normy w prawodawstwie posoborowym przed promulgacją Kodeksu Prawa Kanonicznego z 1983 r. Następnie zostały omówione warunki umożliwiające delegowanie świeckiego do asystowania przy zawarciu małżeństwa zawarte w kan. 1112 tegoż Kodeksu: brak kapłanów i diakonów oraz delegacja biskupa diecezjalnego po uzyskaniu pozytywnej opinii Konferencji Biskupów i zezwolenia ze strony Stolicy Apostolskiej. Ostatnim zaprezentowanym zagadnieniem są obowiązki delegowanego świeckiego w związku z powierzonym mu zadaniem, do których należy przygotowanie nupturientów do małżeństwa, zweryfikowanie ich zdolności do jego zawarcia, przewodniczenie obrzędowi oraz zatroszczenie się o odpowiednie odnotowanie tego faktu w dokumentacji kościelnej.

Introduced after the Second Vatican Council, the norm permitting the lay person to be a qualified witness of marriage entered into a canonical form has not been yet further elaborated in Polish language. This article is an attempt to fill this gap in Polish canonical literature. The first part of the presentation is devoted to the development of the norm in post-conciliar legislation before the promulgation of the 1983 Code of Canon Law. The next part of this dissertation presents the conditions for delegation of lay person to assist at marriage in accordance with Can. 1112 of this Code: lack of priests and deacons, consent of the diocesan bishop with favorable vote of the conference of bishops and permission of the Holy See. The last presented issue is the duties of a delegated lay persons in connection with the task entrusted to them to prepare the nupturients for marriage, to verify their ability to conclude it, to preside over the rite and to take note of this fact in the church documentation.
Wierny to ten, który przez chrzest został włączony do wspólnoty Kościoła. W aspekcie prawnym chrzest oznacza nabycie praw i zaciągnięcie zobowiązań właściwych chrześcijanom. Prawa te i obowiązki zostały określone w Kodeksie Prawa Kanonicznego z 1983 r. Osobowości prawnej nabytej w Kościele, ze względu na jej charakter sakramentalny, nie można utracić ani jej znieść. Świeccy, odznaczający się odpowiednią wiedzą i nieposzlakowaną opinią mogą być dopuszczeni do pełnienia niektórych urzędów i zadań kościelnych. Na tego rodzaju udział Kodeks Prawa Kanonicznego z 1917 r. nie zezwalał, rezerwując całą władzę jurysdykcji dla duchownych. Wpływ na dopuszczenie wiernych świeckich do kościelnej władzy jurysdykcyjnej miały postanowienia Soboru Watykańskiego II wyrażone przede wszystkim w Konstytucji dogmatycznej o Kościele Lumen gentium oraz Dekrecie o apostolstwie świeckich Apostolicam actuositatem. Przepisy zezwalają wiernym świeckim – zarówno mężczyznom, jak i kobietom – na pełnienie wielu funkcji sądowych. Ponadto katolicy świeccy wchodzą w skład rad duszpasterskich (diecezjalnych i parafialnych), mogą brać udział w synodach diecezjalnych. Z powodu braku duszpasterzy, jeśli tego domaga się konieczność, również wierni świeccy mogą przewodniczyć modlitwom liturgicznym, udzielać sakramentu chrztu św. i Komunii św. Obserwuje się współcześnie rozwój ruchów i stowarzyszeń o charakterze religijnym, które realizują wiele inicjatyw w społeczności lokalnej. Coraz częściej misja świeckich w Kościele jest dostrzegana i uznawana.

The believer is the one who was incorporated into the Church through a baptism. In the legal aspect baptism means the acquisition of rights and incurring commitments typical for Christians. These rights and obligations are set out in the Code of Canon Law of 1983. A legal personality attained in Church, because of its sacramental character, cannot be lost or abolished. The laity, characterized by the appropriate knowledge and unblemished reputation, may be allowed to hold certain offices and ecclesiastical tasks. The Code of Canon Law from 1917 did not grant permission to this kind of participation, reserving all the power of jurisdiction for the clergy. The resolutions of the Second Vatican Council, expressed primarily in the Dogmatic Constitution on the Church Lumen gentium and the Decree on the Apostolate of the Laity Apostolicam Actuositatem, had an impact on the admission of the laity to the power of ecclesiastical jurisdiction. The regulations allow the lay people; both men and women; to serve a number of judicial functions. Moreover, lay Catholics are members of the pastoral councils (diocesan and parish) and can participate in diocesan synods. Due to the lack of priests, if necessary, the laity can preside over liturgical prayers, confer the sacrament of baptism and Holy Communion. Nowadays, there has been the development of movements and associations of a religious nature, which implements many initiatives in the local community. The mission of the laity in Church is more and more frequently perceived and recognized.
The article presents the teaching of St. Augustine on priesthood – priests, their attitudes and commitment on pastoral work. Bishop of Hippo’s commentaries on the excerpts from the Gospel of John (J 10, 1-17; J 21, 15-17) are basis for the elaboration. Bishop of Hippo indicates that every priest receives his calling from Christ, the Good Shepherd. Thus, he ought to follow Christ and have absolute trust in Him, believing that without God’s grace he can do nothing in his pastoral work. What appears to be especially interesting is St. Augustine’s proposition that even the ministry of an unworthy priest – the evangelical mercenary – can be of a great benefit to the faithful, provided that they will not follow in his footsteps, but merely fulfill the proclaimed Word of God. In the commentaries one can see St. Augustine as a sophisticated exegete, but above all as a zealous priest of the lay faithful and a formation advisor.
