The paper presents an analysis of the legal nature of an agreement on the use of land for the construction and operation of renewable energy installations, especially wind farms. In particular, it focuses on the legal significance of the Supreme Court judgment of 5 October 2012 (IV CSK 244/12), which ruled that such an agreement cannot be regarded as a  lease. The author seeks to identify the possible practical consequences of this judgment and propose legislative measures to ensure the sustainability of such agreements, and thus the investments which go with them as well as to analyze the legal term fructus in the civil law in the context of this judgment.

The provisions reviewed by the Constitutional Tribunal concern the location of wind farms in Poland. The applications of a group of Deputies contained concerns regarding, inter alia, the distance between wind turbines and residential buildings, as well as the impact of these facilities on natural environment. According to opinion, the location of the power plant only on the basis of a spatial development plan does conform to the Constitution. Before the act came into force, the construction of a wind farm could also take place in an area uncovered by the spatial development plan. On the other hand, provisions regarding cancellation of initiated or unfinished proceedings regarding a decision on development conditions relating conform to the Constitution.

W obecnym obrocie gospodarczym istotne znaczenie mają inwestycje pozyskiwania energii ze źródeł odnawialnych (zwłaszcza wiatrowych). Z uwagi na krótki okres kształtowania się praktyki w tym zakresie, dają się dostrzec liczne wątpliwości jurydyczne, w szczególności kwestia kwalifikacji prawnej umowy o korzystanie z nieruchomości pod inwestycje wiatrowe. Celem niniejszego artykułu jest, po pierwsze, wskazanie na podstawowe cechy charakterystyczne analizowanej umowy. Zaprezentowano więc kwestie odnoszące się do nazwy analizowanej umowy, podmiotów występujących w ramach tworzonego przez nią stosunku obligacyjnego, jej przedmiotu, formy i czasu na jaki zostaje zawarta, podstawowych obowiązków stron oraz praw osób trzecich, wreszcie zakończenia umowy. Po drugie, poczynione rozważania posłużyć mają do podjęcia próby udzielenia odpowiedzi na pytanie o kwalifikację prawną wskazanej umowy oraz wskazania, które przepisy kodeksowe (oraz w jaki sposób) powinny znaleźć do niej zastosowanie.

In current legal turnover significant importance is attributed to investments in the field of renevable enrgy (in praticular wind energy). In this scope, regarding relatively short time of practice developement, there may be noticed a number of legal issues, especially referring legal qualification of wind contract (land lease). Therefore aim of this paper is, firstly, to point out the primary characteristic legal features of the above-mentioned contract. Thus there are presented issues regarding the cotract’s title, legal entities entering into this cotract and refered by this contract, it’s subject, form and term, principle duties of the cotracting praties, as well as rights of third parties and, finally, expiration of contract. Secondly, this consideration would be profitable towards an attepmt on determining the legal qualificaion of wind contract (land lease) along with indicating which of the civil code’s provisions shall be applicable.

Wiatr jako niewyczerpywalne źródło czystej ekologicznie energii znajduje coraz szersze zastosowanie i cieszy się coraz większym poparciem społecznym. Przekłada się to na duże zainteresowanie ze strony inwestorów w gminach posiadających odpowiednie warunki do budowy farm wiatrowych. Inwestycje w farmy wiatrowe przynoszą wiele korzyści ekonomicznych samorządom lokalnym, m.in. zwiększając ich dochody pochodzące w głównej mierze z podatku od nieruchomości. Głównym celem przeprowadzonych badań była ocena wpływu elektrowni wiatrowych na sytuację ekonomiczną gminy Korsze. Do badań wykorzystano dane wtórne pozyskane z materiałów źródłowych zgromadzonych przez działy informacyjne Urzędu Miejskiego w Korszach oraz ze statystyki Głównego Urzędu Statystycznego. Otrzymane wyniki badań wykazały, że zrealizowanie inwestycji związanej z budową farmy wiatrowej w Korszach wpłynęło na uzyskanie nowych, stabilnych źródeł dochodów i znacznie zwiększyło dochody z tytułu podatku od nieruchomości. Roczne wpływy z tytułu tego podatku już w pierwszym roku funkcjonowania farmy wiatrowej wzrosły o 48%.

Being an inexhaustible source of ecologically pure energy, wind is gaining an increasingly wider range of applications. This translates into the growing interest of investors in areas endowed with the conditions suitable for developing wind farms. An investment into wind turbines can generate many economic benefits for a local government, chiefly by ensuring higher revenues from real estate taxes. The main objective of this study has been to evaluate the impact of wind farms on the economic and financial standing of the Korsze commune. The study included secondary data obtained from the Municipal Office in Korsze and statistical data from Statistics Poland. The results showed that the implementation of the investment project consisting of building a wind farm in Korsze led to the commune acquiring new and stable sources of revenue, with distinctly higher real property tax incomes. Annually, the real estate tax revenues in Korsze in the first year after the wind farm had opened increased by 48%.

Potential ranges and effects of the planned investment will be indicated. The last element will be indicating ways to preventive measures and counteracting negative effects.

Punktem odniesienia będzie planowana elektrownia „Podborze” w okolicach Ostrowi Mazowieckiej. Wskazane zostaną potencjalne zasięgi i skutki oddziaływania planowanej inwestycji. Ostatnim elementem będzie wskazanie sposobów na działania profilaktyczne i przeciwdziałanie negatywnym skutkom.
