Niniejsze opracowanie zawiera rozważania dotyczące negatywnego aspektu wolności zrzeszania się, analizowanego zarówno w wymiarze indywidualnym, jak i zbiorowym. Sfera negatywnej wolności znajduje podstawy w prawodawstwie międzynarodowym i krajowym, i w takim zakresie została poddana rozważaniom w treści niniejszego artykułu. Obowiązujące przepisy prawa zostały ponadto skonfrontowane z postanowieniami statutów związków zawodowych zarówno w wymiarze, w którym realizują one przepisy ius cogens, jak również te, którym nie można przypisać waloru realizacji norm prawa powszechnie obowiązującego.

This publication contains a discussion of the negative aspect of freedom of association, analyzed both in the individual and the collective. The sphere of negative liberty is no basis in international law and national level, and so far has been considerations in the body of this article. Applicable laws were also confronted with the statutes of trade unions both in terms of where they implement the rules of ius cogens, as well as those that can not be attributed to asset realization rules generally applicable law.
