In the article the author analyzes the implementation of the media right to criticize the government. This regulation faces in practice considerable difficulties. Regardless of the widely accepted and constitutionally guaranteed freedom of speech, there are many barriers for the journalistic freedom of expression. It is all about the legal and ethical barriers. The concept of material freedom of the media was not in fact implemented by the legislation of the European states. In the author’s opinion, the threat of criminal liability for the abuse of freedom of expression, does not limit the right of citizens to criticize the government, but it makes the right to criticize much more effective if is accompanied by a responsibility for word.

W świecie zachodnim mocno zakorzeniło się przekonanie, że wolność słowa i mediów jest jednym z najważniejszych, nienaruszalnych i mających jedynie pozytywne implikacje praw człowieka. W dobie Internetu, podmiot tej wolności uległ jednak poszerzeniu, możliwość publikacji treści ma bowiem obecnie niemal każdy człowiek. Skutkiem tego niektóre podmioty polityczne, ekonomiczne czy społeczne zaczęły wykorzystywać wolność mediów do własnych celów. W takiej sytuacji należy postawić pytanie, czy wolność słowa i mediów ma w dzisiejszych czasach jedynie pozytywne znaczenie, czy raczej może stanowić też zagrożenie dla bezpieczeństwa państwa: jego ludności, władzy, terytorium oraz rozwoju.

Modern societies, especially those from the Western hemisphere, strongly believe in the idea that freedom of expression, one of the most important human rights, has only positive eff ects. It is however worth to mention that in the Internet era the subject of this freedom has broaden and includes now almost every person capable of creating and publishing content. As a result, some political, economical or social actors start to take advantage of freedom of expression. Therefore, it is necessary to fi nd out whether freedom of expression has only positive eff ects or whether it can pose a threat to the security of state.

Komunikaty urzędowe stanowiły od zawsze i stanowią nadal instrument ograniczający wolność mediów. Dlatego powinno się dążyć do ich całkowitego wyeliminowania, a przynajmniej znacznego ograniczenia. Analiza polskiego ustawodawstwa świadczy natomiast o tendencji odwrotnej. Obecna regulacja jest bardzo restrykcyjna, dotyczy mediów (a nie tylko prasy codziennej). Niedawne zmiany jeszcze ją zaostrzyły, znacznie poszerzając krąg podmiotów uprawnionych do publikacji tych komunikatów. Przygotowywany projekt nowelizacji zdaje się nie dostrzegać żadnego problemu i w dalszym ciągu utrzymuje odpowiedzialność redaktorów naczelnych za uchylanie się od publikacji komunikatów urzędowych.

Freedom of the media is considered to be one of the imperatives of the policy of democratic countries. This principle, expressing general values, sets constitutional boundaries within which the process of establishing and executing the law, including the administration of justice in courts, is the source of the obligation of the state apparatus to weigh goods and implement constitutional norms. The pillars freedom of the media are: freedom of speech and the right to information about state organs. This freedom cannot be considered absolute, therefore it is often subject to certain limitations. Such limitations are sometimes necessary in the area of judiciary power exercised in courts, due to the implementation of the constitutional principles of the independence of courts and of judges. The judiciary is obliged to make fair individual decisions in accordance with the applicable law.

Wolność mediów jest postrzegana jako za jeden z imperatywów polityki państw demokratycznych. Zasada ta, wyrażając ogólne wartości, wyznacza granice konstytucyjne, w obrębie których przebiega proces stanowienia i wykonywania prawa, w tym sprawowania wymiaru sprawiedliwości w sądach, jest źródłem zobowiązania aparatu państwowego do ważenia dóbr i wdrażania norm konstytucyjnych. Filarami wolności mediów są: wolność słowa i prawo do informacji o organach państwa. Wolność ta nie może być uważana za absolutną, toteż doznaje niejednokrotnie pewnych ograniczeń. Takie ograniczenia bywają konieczne w przypadku realizowania dziennikarstwa w obszarze władzy sądowniczej wykonywanej w sądach, z uwagi na realizację konstytucyjnych zasad niezależności sądów i niezawisłości sędziów. Państwo zobowiązane jest zatem ważyć konkurujące ze sobą dobra i podejmować indywidualne decyzje w zgodzie z obowiązującym prawem.
Swoboda informacji i wolność mediów mają zasadnicze znaczenie dla funkcjonowania systemów demokratycznych. Jednak ostatnie dziesięciolecia przyniosły szereg zjawisk zagrażających wolności mediów. Autorka przeanalizowała zagrożenia dla wolności mediów i bezpieczeństwa dziennikarzy nawiązując do uchwały 2317 (2020 r.) Zgromadzenia Parlamentarnego Rady Europy. Ważne jest, aby wszystkie państwa członkowskie Rady Europy skutecznie gwarantowały dziennikarzom bezpieczeństwo, tworzyły środowisko sprzyjające wolności mediów i zapobiegały nadużywaniu praw lub przepisów normatywnych, które mogą mieć wpływ na tę wolność, bez której nie ma demokracji. Należy zagwarantować prawo dziennikarzy do ochrony swoich źródeł; należy potępić policyjną przemoc wobec dziennikarzy, a sankcje za wszelkie naruszenia wolności mediów muszą być odstraszające. Uchwała ZPRE, choć ma tylko charakter „miękkiego prawa”, może inspirować państwa członkowskie do podjęcia bardziej skutecznych działań w tym zakresie.

Free speech and freedom of the media are essential to the functioning of democratic systems. However, recent decades have brought phenomena that pose a threat to media freedom. The author analyzed threats to media freedom and journalist’s security regarding resolution 2317 (2020) of the Parliamentary Assembly of the Council of Europe. All Council of Europe Member States must effectively guarantee the safety of journalists, create an environment conducive to freedom of the media and prevent the misuse of laws or normative provisions that may affect this freedom, without which there is no democracy. The right of journalists to protect their sources must be guaranteed; police violence against journalists must be condemned, and sanctions against any infringement of the freedom of the media must be dissuasive. Although it is only “softlaw”, the PACE resolution may inspire the Member States to take more effective measures in this regard.
The purpose of the study was to identify sources of information about the migration crisis on Poland's eastern border in 2021. Since the Polish government imposed a state of emergency in the border area and banned journalists from entering it, an emergency situation arose that is particularly suitable for studying the sources and directions of information flow. The 2021 Polish-Belarusian border crisis is an example of a global problem (migration) with a local context that limited the power of online platforms and portals due to geographic location and geopolitical considerations. Research methods: the study was conducted during the crisis (September-December 2021); therefore, the ethnographic method, meta-analysis of reports on the crisis, and quantitative analysis of Facebook and Twitter accounts and websites of selected media were used. The results showed that online platforms acted as communication channels for government sources – Polish and Belarusian – during this crisis. Accounts of Polish government agencies, such as the Border Guard, had an advantage in the number of followers over accounts of NGOs such as Grupa Granica (Border Group). The Polish government's ban on journalists entering the border zone resulted in visual messages from Belarusian media and news agencies being circulated internationally (e.g., BBC and CNN online). In the case studied, online platforms were successfully used by political actors and as such acted as digital intermediaries without interfering with the flow of information.

Celem przeprowadzonego badania było zidentyfikowanie źródeł informacji o kryzysie migracyjnym na wschodniej granicy Polski w 2021 r. Ponieważ polski rząd wprowadził stan wyjątkowy w strefie przygranicznej, a dziennikarzom zakazał do niej wstępu, powstała sytuacja wyjątkowa, szczególnie nadająca się do badania źródeł i kierunków przepływu informacji. Kryzys na granicy polsko-białoruskiej w 2021 r. stanowi przykład problemu globalnego (migracje) skonfrontowanego z lokalnym kontekstem, który ograniczył siłę platform i portali internetowych ze względu na położenie geograficzne oraz uwarunkowania geopolityczne. Metody badań: badanie było prowadzone w trakcie trwania kryzysu (wrzesień–grudzień 2021 r.), wobec czego wykorzystano metodę etnograficzną, metaanalizę raportów o kryzysie, a także analizę ilościową kont na Facebooku i Twitterze oraz na stronach internetowych wybranych mediów. Uzyskane wyniki wykazały, że platformy online pełniły w czasie tego kryzysu rolę kanałów komunikacji dla źródeł rządowych – polskich i białoruskich. Konta agend polskiego rządu, takich jak Straż Graniczna, miały przewagę w liczbie obserwujących nad kontami organizacji pozarządowych takich jak Grupa Granica. Zakaz wstępu dziennikarzy do strefy przygranicznej, wprowadzony przez polskie władze, spowodował, że w obiegu międzynarodowym (np. w BBC i CNN online) pojawiły się przekazy wizualne pochodzące z białoruskich mediów i agencji informacyjnych. W badanym przypadku platformy internetowe były z powodzeniem wykorzystywane przez aktorów politycznych i jako takie pełniły rolę pośredników cyfrowych, nie ingerując w przepływ informacji.
W artykule dokonano przeglądu aktywności instytucji Unii Europejskiej w kluczowych kwestiach unijnej polityki medialnej, podejmowanych w cieniu walki z pandemią COVID-19, w tym zwłaszcza planów związanych z wejściem w nowy etap strategii cyfrowej. Skutki digitalizacji w sektorze komunikacji i mediów obnażyły luki w dotychczasowych działaniach, legislacji oraz w zakresie zwalczania głównych zagrożeń. Komisja Europejska dostrzega groźny wpływ „infodemii”, negatywne skutki słabej harmonizacji prawnej oraz szkodliwe dla wolności mediów praktyki niektórych państw członkowskich, które ocenia jako podmywanie aksjologicznych fundamentów wspólnoty. Plany nowej Europejskiej Agendy Cyfrowej, europejski plan działania na rzecz demokracji oraz modernizacja dyrektywy o audiowizualnych usługach medialnych są względem siebie komplementarne. Mają one służyć „wzmocnieniu odporności demokratycznej”, podkreślając wizerunek i rolę Unii jako referencyjnego gracza nie tylko w przestrzeni rynkowej, ale także na polu globalnej walki o reguły demokratyczne.

The article reviews activities of the European Union institutions in the key issues of EU media policy, undertaken in the shadow of the fight against the COVID-19 pandemic, in particular the plans to enter a new stage of digital strategy. The effects of digitization in communication and media sectors have exposed gaps in the activities, legislation and to counter major threats in these areas. The European Commission recognizes the dangerous impact of infodemic, the negative effects of poor legal harmonization and the practices of some Member States that are detrimental to media freedom, which it views as undermining the axiological foundations of the community. The plans for the new Digital Agenda for Europe, the European Democracy Action Plan and the modernization of the Audiovisual Media Services Directive are complementary to each other. They are to “strengthen democratic resilience,” emphasizing the image and role of the European Union as a key player not only in the common market, but also in the field of global struggle for democratic rules.

Czarnogóra to stosunkowo młode, ale i aktywne państwo regionu Bałkanów Zachodnich, jakim dała się poznać od chwili uzyskania swej niezależności w 2006 roku. Prowadzona przez władze Podgoricy polityka zagraniczna od samego początku skupiona jest na zacieśnianiu więzi z NATO, Unią Europejską, jak i kształtowaniu pozytywnych relacji w regionie. Na tle pozostałych państw Bałkanów Zachodnich, Czarnogóra wypada bardzo korzystnie jeśli pod uwagę wziąć postępy i stopień realizacji stawianych przez organizacje wytycznych na rzecz akcesji. Czarnogóra to kraj o wciąż nieodkrytych możliwościach. Przyciągająca zagranicznych turystów, jak i inwestorów, stara się dorównać sąsiedniej Chorwacji. Wśród największych problemów z jakimi musi zmagać się państwo wymienia się przede wszystkim korupcję, przestępczość zorganizowaną, brak wolności mediów, czy brak poszanowania odmienności grup o innej orientacji seksualnej, dyskryminację Romów, osób niepełnosprawnych.

Montenegro is a relatively young but also very active country in the region of the western Balkans. It can be distinguished by these features since it regained its independence in 2006. The foreign politics run by the Podgorica authorities, from the very beginning, has been focused on strengthening the relations with NATO, European Union and creating the positive relations inside the region. Montenegro can be perceived in more advantageous way as compared to the other western Balkan countries when one considers the progress and the level of implementation of the guidelines issued by the organization working for the accession procedure. Montenegro is the country of the undiscovered potential. As a very attractive country for both tourists and investors, it tries to match the neighboring Croatia. Among the main problems, Montenegro must face, the following: organized crime, lack of media freedom, lack of respect for otherness of different sexual orientation groups, discrimination of Romani people and the disabled.
Freedom of speech as an important human right is diminished when speaking out for Palestinian rights. The paper examines this assertion through three case examples from Australia. These are academic freedom, media freedom and freedom of political representation and expression. To provide context to the free speech debates, an overview is presented of the conflict as well as an outline of the Boycott, Divestments and Sanctions campaign.

W artykule przeanalizowano powyższe twierdzenie na podstawie trzech przykładów przypadków z Australii. Są to: wolność akademicka, wolność mediów oraz wolność reprezentacji politycznej i wypowiedzi. W celu zapewnienia kontekstu debatom na temat wolności słowa przedstawiono przegląd konfliktu, a także zarys bojkotu oraz kampanii sankcji.
Opracowanie dotyka kwestii pluralizmu, własności medialnej, koncentracji i struktury kapitałowej mediów, prezentując uregulowania dotyczące tego zagadnienia w UE.

This study analyses regulatory solutions at the level of the European Union, and Poland in particular. This issue is variously regulated in the national laws of many member states of the European Union. The fundamental objective of such restrictions should be the intention to ensure pluralism in the media. It is not the phenomenon of media concentration that poses a threat to freedom of expression but it is its scale.
Zasada subsydiarności powoduje, że polityka na rzecz ochrony wolności i pluralizmu mediów pozostaje w gestii państw członkowskich. Niemniej jednak Unia Europejska podejmuje ważne inicjatywy w celu wspierania wolności i pluralizmu mediów oraz ograniczenia koncentracji rynkowej. W tej kwestii można zaobserwować niejednokrotnie odmienne podejście Parlamentu Europejskiego i Komisji. Artykuł przedstawia najważniejsze dokumenty oraz analizuje aktualnie realizowane działania w tym obszarze unijnej polityki medialnej.

The principle of subsidiarity in the EU refers to the principle that the Member States defi ne the ways to protect media freedom and pluralism. However, the European Union has taken important initiatives to promote freedom and pluralism of the media and the reduction of market concentration. In that regard, different approaches of the European Parliament and the Commission can be sometimes observed. This article presents the most important documents and analyzes the current actions in that particular area of EU media policy.
Celem artykułu jest przedstawienie efektów rozwoju kursu, które zaowocowały zmianami w zakresie krytycznej umiejętności korzystania z mediów. W pierwszej części artykułu przedstawione zostały źródła naukowe wspierające rozwój kursu medioznawstwa w kontekście nauczania międzykulturowego. Po tej części dostępne są szczegóły dotyczące badania percepcyjnego sprzężenia zwrotnego i jego mieszanej metodologii. Zgodnie z wynikami, krytyczna umiejętność korzystania z mediów przez studentów została poprawiona dzięki naukowym źródłom mediów społecznościowych w analizie, regionalnym studiom przypadków w kontekście międzykulturowym, oraz technikom sprawdzania faktów w konsumpcji wiadomości. Ostatecznym rezultatem było głębsze zrozumienie wartości stojących za wolnością mediów. Ponadto, poziom wiedzy w dziedzinie historii i polityki wzrósł, a etnocentryczna perspektywa załamała się w międzykulturowym środowisku. W końcowej części artykułu podsumowano kluczowe ustalenia oraz wkład w rozwój kursu wraz z rekomendacjami. Głównym przesłaniem badania jest znaczenie studium przypadku opartego na międzykulturowym i historycznym podejściu w studiach nad mediami dla poprawy krytycznej umiejętności korzystania z mediów w szkolnictwie wyższym.

The goal of the paper is to present the effects of the course development resulting in changes in critical media literacy. The first part of the paper outlines the academic sources supporting the course development of media studies in the context of intercultural teaching. After this section, details of perceptual feedback research and its mixed methodology are available. According to the findings, critical media literacy of students has been improved due to the academic social media sources in analysis, regional case studies in an intercultural context, and fact check techniques in news consumption. The ultimate result was a deeper understanding of the values behind media freedom. Moreover, the level of knowledge in historical and political fields has increased, and the ethnocentric perspective has collapsed as the interculturalenvironment. The closing section of the paper summarizes the key findings and the contribution to the course developments with recommendations. The main message of the study is the importance of the case study based on the intercultural and historical approach in media studies to improve critical media literacy in higher education.
