Niniejszy artykuł obejmuje rozważania dotyczące problematyki odnoszącej się do praw i wolności człowieka i obywatela w świetle Konstytucji RP. Celem jego jest przedstawienie powszechnie akceptowanych wartości demokratycznych, których integralnym elementem są prawa człowieka i wynikające zeń mechanizmy gwarancyjne. Na podstawie materiału w nim zgromadzonego, można zasadnie przypuszczać, że zasada wolności i praw człowieka stała się fundamentem ustroju naszego państwa i określiła istotę Konstytucji Rzeczypospolitej Polskiej z 1997 r. Wejście w życie Konstytucji RP z 1997r. wniosło do polskiego prawa systemowego unormowanie kwestii dotyczącej wolności i praw człowieka.

This article covers considerations on the issues relating to the rights and freedoms of man and citizen in the light of the Polish Constitution. It is a representation of the commonly accepted democratic values, whose integral part are human rights and their mechanisms.On the basis of the material herein, it can be reasonably assumed that the principle of freedom and of human rights became fundamental in the political system of our state and defined the essence of the Constitution of the Republic of Poland of 1997. Its introduction helped regulate issues relating to freedom and human rights in the Polish systemic law.
Wiek XIX to okres zasadniczych reform więziennictwa niemalże w całej Europie Zachodniej. Był to czas, w którym wiele europejskich ustawodawstw karnych (w tym także na ziemiach Królestwa Polskiego) przechodziło od sankcji cielesnych w kierunku kary pozbawienia wolności. Fakt ten wywołał szeroką dyskusję na temat nowej organizacji więziennictwa. Sytuacja w polskich zakładach karnych u progu XIX wieku nie odpowiadała nawet ówczesnym standardom. Pewna poprawa nastąpiła dopiero po 1818 roku, na skutek niezadowolenia cara Aleksandra I z wizytacji niektórych warszawskich zakładów karnych. Od tego momentu obserwowano istotne działania centralnych organów administracji rządowej, a także pojawienie się śmiałych koncepcji polskich reformatorów penitencjarnych. Niestety, regulacje wydane przez Komisje Rządowe nie miały charakteru ogólnosystemowego. Odnosiły się one tylko do niektórych kwestii podnoszonych w doktrynie. Brakowało niewątpliwie przepisów określających zasady opieki lekarskiej i duchowej nad więźniami, a także wytycznych co do urządzenia i utrzymania cel, jak również odpowiedniego wyżywienia osadzonych, nauki rzemiosła czy też organizacji fabryk więziennych.

The nineteenth century was a period of major reforms in the prison almost throughout Western Europe. It is a time in which many European criminal laws (including the territories of the Kingdom Polish) passes from the sanctions corporal in the direction of imprisonment. The event caused a wide discussion on the new organization of the prison. The situation in Polish prisons at the beginning of the nineteenth century, did not answer even the then standards. Some improvements after 1818, due to the discontent of Tsar Alexander I of the visit some prisons in Warsaw. From that moment on seeing meaningful action central government authorities, and the emergence of bold conception Polish penal reformers. Unfortunately, the regulations issued by the Government Commission does not have the character of system-wide. These related to certain issues raised in the doctrine. There was no doubt for the rules governing medical care and spiritual prisoners as well as guidelines for equipment and maintenance purpose as well as adequate food inmates, science, crafts, or organizations prison factories.
The article presents the discussion between the freedoms and human rights resulting from the Constitution of the Republic of Poland and the limitations related to the COVID-19 pandemic and analyzes the impact of these limitations on the physical and mental health of citizens. The article presents research conducted on a sample of 523 people on the mental and physical condition of the respondents and their relationship with the perception of limitations, hopelessness and the use of psychoactive substances. The article ends with the practical implications of the research.

Artykuł dotyczy rozważań pomiędzy wolnościami i prawami człowieka wynikającymi z Konstytucji RP a ograniczeniami związanymi z pandemią COVID-19 oraz analizuje wpływ tychże ograniczeń na zdrowie fizyczne i psychiczne obywateli. W artykule zaprezentowano badania przeprowadzone na próbie 523 osób dotyczące kondycji psychicznej i fizycznej osób badanych i ich związków ze spostrzeganiem ograniczeń, poczuciem beznadziejności oraz używaniem substancji psychoaktywnych. Artykuł zakończono implikacjami praktycznymi wynikającymi z badań.
