The paper analyses the way of regulating the principle of two-instance administrative proceedings in constitutional law and in administrative procedure law. The author explains what the instance control of correctness of the decision appealed against consists in, what the reconsideration of the matter in appellate proceedings consists in, what rulings may be issued in appellate proceedings, when the entities entitled to file an appeal against a decision may exercise this right, as well as if any exceptions from the principle of two-instance proceedings exist in the general administrative proceedings. Furthermore, the author considers whether and in what degree the Constitution of theRepublicofPolandguarantees the right to appeal against an administrative decision issued in the first instance to the administrative authority of higher level.

W artykule jest analizowany sposób unormowania zasady dwuinstancyjności ogólnego postępowania administracyjnego na gruncie prawa konstytucyjnego i proceduralnego prawa administracyjnego. Autor wyjaśnia, na czym polega kontrola prawidłowości zaskarżonej decyzji dokonywana w postępowaniu odwoławczym, na czym polega ponowne rozpatrzenie sprawy w postępowaniu odwoławczym, jakiego rodzaju rozstrzygnięcia mogą zapaść w postępowaniu odwoławczym, kiedy podmioty uprawnione do wniesienia odwołania mogą skorzystać z tego prawa, a także czy istnieją wyjątki od zasady dwuinstancyjności w ogólnym postępowaniu administracyjnym. Ponadto autor rozważa, czy i w jakim stopniu Konstytucja RP gwarantuje prawo do poddania sprawy administracyjnej rozpatrzeniu przez organ wyższego stopnia.
The article addresses the issue of alterations to the Administrative Procedure Code (after the most recent amendment, which went into effect on June 1, 2017) in relation to the constitutional right to appeal against decisions delivered in the course of administrative proceedings. The author presents and analyses the new regulations with emphasis on the modifications to the forms of recourse, including solutions that exclude the right to second instance proceedings (by operation of law or upon request of the parties), and introduce limitations to the right (in terms of the content of the appeal or the scope of its examination).
Przedmiotem opracowania jest analiza, a także sformułowane na jej podstawie wnioski, w kwestii skutków prawnych zaskarżenia decyzji w części, dokonana w aspekcie – stanowiących determinanty standardów demokratycznego państwa prawnego – zasad konstytucyjnych ochrony praw nabytych, dwuinstancyjności postępowania oraz praworządności. Wskazana analiza przeprowadzona została w oparciu o metodę dogmatyczno-prawną oraz prawno-porównawczą, z uwzględnieniem problematyki przymiotu oraz skutków ostateczności decyzji.

This study investigates legal effects of appealing against a decision in part in the context of the constitutional principles of the protection of acquired rights, a two-stage procedure and the rule of law, which are determinants of standards of a democratic state ruled by law, and to formulate relevant conclusions. This is done by means of an analysis of the law in force and a comparative analysis, with a focus on the subject matter of the attribute and effects of a decision’s final force.
The article aims to verify whether the principle of two-tier proceedings is infringed where in the assessment decision issued in the appeal proceedings, case facts are qualified under the law differently than in the first-instance decision - whereby the substantive legal grounds of the resolution are changed. "Tax case" resolved in the assessment decision is to fix or determine the amount of tax liability. Therefore, change in legal qualification of the case facts and, as a consequence, in the substantive legal ground of the appeal resolution, does not bring about the change of the tax case - i.e., the loss of its identity. Such decision of the appeal authority does not infringe the taxpayer's constitutional right to appeal or the principle of two-tier proceedings.

Celem artykułu jest sprawdzenie, czy przyjęcie w decyzji wymiarowej wydanej w postępowaniu odwoławczym innej kwalifikacji prawnej stanu faktycznego niż przyjęta w decyzji wydanej w pierwszej instancji, prowadzące do zmiany materialnoprawnej podstawy rozstrzygnięcia, narusza zasadę dwuinstancyjności postępowania podatkowego. „Sprawą podatkową” rozstrzyganą decyzją wymiarową jest ustalenie lub określenie wysokości zobowiązania podatkowego. W konsekwencji zmiana kwalifikacji prawnej stanu faktycznego i będąca jej konsekwencją zmiana podstawy prawnej rozstrzygnięcia odwoławczego nie prowadzi do zmiany sprawy podatkowej - tzn. utraty jej tożsamości. Taka decyzja organu odwoławczego nie narusza konstytucyjnego prawa podatnika do odwołania ani zasady dwuinstancyjności.
