W artykule zbadano problematykę zasady przejrzystości w polskim prawie zamówień publicznych. Analizie poddane zostały kwestie językowe związane z pojęciami przejrzystości oraz jawności. Relacje pomiędzy tymi pojęciami rzutują bowiem na prawidłową interpretację zasad przejrzystości i jawności na gruncie ustawy Prawo zamówień publicznych. W dalszej części podjęto rozważania o charakterze dogmatycznym w celu ustalenia powiązań prawnych pomiędzy wskazanymi zasadami. Umożliwiło to określenie treści zasady przejrzystości oraz jej funkcji w ramach Prawa zamówień publicznych.
Wprowadzenie 20 marca 2020 r. stanu epidemii wywołanej wirusem SARS-CoV-2 spowodowało zmiany w funkcjonowaniu polskiego sądownictwa administracyjnego w zakresie rozpoznawania spraw sądowoadministarcyjnych. Rozwiązania przewidziane w art. 15 zzs4 ustawy covidowej przewidują możliwość przeprowadzenia rozprawy sądowoadministracyjnej w trybie odmiejscowionym za zgodą strony postępowania. Istotnej modyfikacji doznają ponadto uprawnienia przewodniczącego wydziału w zakresie rozpoznawania spraw w sądach administracyjnych. Jednocześnie należy zauważyć, iż nadal ma zastosowanie przepis art. 182 p.p.s.a. odnoszący się do rozpoznawania skarg kasacyjnych przez NSA. Zagrożenie dla zdrowia i życia człowieka wywołane wirusem SARS-CoV-2 spowodowało konieczność dostosowania funkcjonowania sądów administracyjnych do zmienionej rzeczywistości w taki sposób, aby nie niwelować zagrożenie dla stron postępowania poprzez wprowadzenie możliwości przeprowadzenia rozprawy odmiejscowionej bądź rozpoznania sprawy na posiedzeniu niejawnym. Rozwiązanie umożliwiające stronom uczestniczenie w rozprawie zdalnej wpływa na realizację zasady jawności postępowania.

The introduction of the SARS-CoV-2 virus epidemic on March 20, 2020 resulted in changes in the functioning of the Polish administrative judiciary in the field of examining administrative court cases. The solutions provided for in Art. 15 zzs4 of the Covid act provide for the possibility of conducting a court-administrative hearing in a differentiated mode with the consent of the party to the proceedings. Moreover, the powers of the head of the division in the field of hearing cases in administrative courts are significantly modified. At the same time, it should be noted that the provision of Art. 182 p.p.s.a. relating to the examination of cassation complaints by the Supreme Administrative Court. The threat to human health and life caused by the SARS-CoV-2 virus made it necessary to adapt the functioning of administrative courts to the changed reality in such a way as not to eliminate the threat to the parties to the proceedings by introducing the possibility of holding a hearing in a place or hearing the case in closed session. The solution enabling the parties to participate in a remote hearing affects the implementation of the principle of open proceedings.
Wyrastający z powszechnego prawa do informacji dostęp do wiedzy publicznej stanowi podstawowe zagadnienie współczesnych czasów. Dostarcza zainteresowanym informacji o sprawach publicznych. Tworzy płaszczyznę komunikowania się jednostek oraz wspólnego decydowania o zagadnieniach istotnych dla nich samych oraz dla całego społeczeństwa. Na tej płaszczyźnie stanowi instytucję społecznego kontrolowania, która obejmuje swymi ramami także sferę udzielania zamówień publicznych. Określeniu prawnie gwarantowanych form i sposobów jego realizacji (realizacji dostępu do informacji publicznej, a tym samym i procesu kontrolowania) poświęcone jest niniejsze opracowanie.

The access to public knowledge, which is the result of the common right to information, is a fundamental issue of modern times. It provides interested parties with information about public affairs. It creates a place for communication and joint determination of issues that are relevant to society as a whole. On this level, it is an institution of social control, which includes the sphere of public procurement. This paper is devoted to determining legally guaranteed forms and methods of its implementation (realization of access to public information, and thus the control process).
Artykuł stanowi podsumowanie najważniejszych regulacji prawa dostępu do informacji publicznej na płaszczyznach prawa międzynarodowego, unijnego, krajowego oraz dwóch wybranych krajów – Republiki Czeskiej i Republiki Federalnej Niemiec. Porównanie regulacji dotyczących prawa dostępu do informacji publicznej jako podstawowego prawa człowieka zostało dokonane za pomocą metody prawnoporównawczej. Drugą część artykułu stanowi przedstawienie badań terenowych przeprowadzonych w wybranych jednostkach organów stanowiących administracji na obszarze całego kraju, w zakresie informacji dotyczących działalności tych organów i ich posiedzeń w czasie pandemii COVID-19 oraz wykonywania w tym czasie zasady jawności działalności organów i ich dostępności dla obywateli.

This article summarizes the most important regulations of the right of access to public information on the levels of international law, EU law, national law and two selected countries – the Czech Republic and the Federal Republic of Germany. The indicated comparison of regulations on the right of access to public information as a fundamental human right was made by means of a comparative legal method. The second part of the article is the presentation of field research carried out in selected units of bodies constituting the administration throughout the country, in the field of information on the activities of bodies and their meetings during the COVID-19 pandemic and the execution at that time of the principle of openness of the activities of bodies and their accessibility to citizens.
Przedmiotem artykułu jest problem ochrony prawa do prywatności w polskim procesie karnym w kontekście relacjonowania przebiegu rozprawy głównej przez media. Analizie zostały poddane zarówno warunki dopuszczalności relacjonowania rozprawy, przedmiot ingerencji, jak i podmioty, których prawo do prywatności może być naruszone w toku relacjonowania rozprawy głównej przez media. Prawo do prywatności jest współcześnie chronione nie tylko przez normy prawa cywilnego, ale również przez prawo konstytucyjne, stąd obowiązek przestrzegania i poszanowania prawa do prywatności ciąży także na organach prowadzących postępowanie karne. Jak wynika z zamieszonych w artykule rozważań, możliwe jest pogodzenie pozornie sprzecznych celów procesu karnego z koniecznością poszanowania prawa do prywatności, a sfera prywatna jednostek podlega ochronie również w procesie karnym. Wśród zagrożeń dla efektywnej ochrony prawa od prywatności należy jednak wskazać brak sankcji za złamanie zakazu publikacji danych osobowych czy wizerunku, którego nie przewidują ani normy prawa karnego ani prawa prasowego.

The subject of this thesis focuses on an issue of privacy protection in the light of the coverage of the court main hearing by the media in the Polish criminal proceedings. The article examines both the conditions permitting the coverage of the trial, the subject of interference and the entities whose right to privacy may be violated in the course of the trial coverage by the media during criminal proceedings. Since the right to the privacy is currently protected not only by provisions of the civil law but also by the constitutional law, the obligation to observe and respect it also burdens the authorities conducting criminal proceedings. The research concludes that it is possible to reconcile seemingly conflicting objectives of the criminal proceedings, at the same time respecting the right to privacy. It is so because the sphere of one’s privacy is also protected in the criminal proceedings. The effective protection of the right to privacy is threatened with the lack of sanctions for breaching the ban on publication of personal details or image, which is not stipulated in the criminal law or the press law.
In order to provide the funds necessary to finance and support the implementation of tasks related to counteracting COVID-19 in 2020, the COVID-19 Prevention Fund was established at Bank Gospodarstwa Krajowego. The term „counteracting COVID-19” should be understood as all activities related to combating infection, preventing its spread, prophylaxis and combating the effects, including socio-economic, of infections and infectious disease caused by the SARS-CoV-2 virus, hereinafter referred to as „COVID -19. The aim of the article is to analyze the evolution of the scope of objectives for which the Fund’s resources have been allocated over the last two years. In addition, the impact of the legal status of the COVID-19 Counteracting Fund on the basic elements of public finance in Poland was assessed, e.g. on the principle of openness, transparency, detail, unity or transparency.

W celu zapewnienia środków finansowych niezbędnych na finansowanie i wsparcie realizacji zadań związanych z przeciwdziałaniem COVID-19 w roku 2020 w Banku Gospodarstwa Krajowego utworzono Fundusz Przeciwdziałania COVID-19. Przyjmuje się, że pojęcie „przeciwdziałanie COVID-19” to wszelkie czynności związane ze zwalczaniem zakażenia, zapobieganiem rozprzestrzenianiu się, profilaktyką oraz zwalczaniem skutków, w tym społeczno-gospodarczych, zakażeń i choroby zakaźnej wywołanej wirusem SARS-CoV-2. Celem artykułu jest analiza ewolucji zakresu celów, na które środki Funduszu – na przestrzeni ostatnich dwóch lat – zostały przeznaczone. Ponadto ocenie poddano wpływ statusu prawnego Funduszu Przeciwdziałania COVID-19 na podstawowe elementy finansów publicznych w Polsce, m.in. na zasadę jawności, przejrzystości, szczegółowości, jedności czy transparentności.
The Constitutional Tribunal is called a “court of law”. The proceedings before that body of law must meet the requirements of a fair procedure. Guarantee of a fair trial is its openness and transparency. Openness and transparency is implemented for example by public hearing or through the publication of decisions of this body in the appropriate set of official. The principle of openness is implemented by justify rulings of Constitutional Tribunal which contain specific reasons of taking the decision. Justification of a ruling protects against arbitrary action of the Constitutional Tribunal. A justification of a ruling is an admissible voice of Constitutional Tribunal in the public debate. Openness and transparency implemented by justification of decisions of the Constitutional Tribunal allows to build the authority of that body in the country. Matters which are in the judgments can be informative and educational. Way of describing the issues in the justifications of rulings can also trendsetting understanding of certain bodies of constitutional law in a democratic state ruled by law.
Overviewing the peculiarity of the public procurement procedure, including the matter of primate rules designating standards of the procedure itself, plays an important role in the context of public entities’ activity. The closer look at the essence of mutual relations between the principle of transparency and its restrictions enables to designate a catalogue of terms that justify the granting of protection for entrepreneur’s interest. By characterizing both the need to proper verification of the validity of the limitations over its effectiveness and participants roles in the proceeding, the purpose of the paper is to explore the specificity of the public procurement procedure. The following article provides the basic summary of the most crucial information constituting determinants for an entrepreneur who participates in the proceeding.

Omówienie właściwości postępowania o udzielenie zamówienia publicznego, w tym materii dotyczącej naczelnych zasad wyznaczających standardy procedury zamówień publicznych, stanowi niezwykle ważny aspekt w kontekście działalności podmiotów publicznych. Przybliżenie istoty wzajemnych relacji pomiędzy zasadą jawności a ograniczeniami w zakresie jej stosowania umożliwia wyznaczenie katalogu przesłanek uzasadniających przyznanie ochrony interesowi przedsiębiorcy. Zarówno wskazanie na potrzebę weryfikacji zasadności zastrzeżenia pod kątem jego skuteczności, jak i wyjaśnienie roli uczestników postępowania dodatkowo przybliża specyfikę postępowania. Artykuł zawiera podstawowe zestawienie informacji stanowiących wyznacznik dla przedsiębiorcy uczestniczącego w postępowaniu o udzielenie zamówienia publicznego.
The article analyses the rights and duties of a social representative in criminal proceedings (article 90 Code of Criminal Procedure). Participation in court proceedings may be declared, before the commencement of judicial examination, by a representative of a community organisation, if there is a need to defend a social interest or an important individual interest within the statutory purposes of such an organisation, especially in matters pertaining to the protection of human rights and freedoms. The representative of a community organisation who has been admitted to participate in court proceedings may participate in the trial, express their points of view and make statements in writing. The court shall admit a representative of a community organisation if it finds this to be in the interests of justice. This person shall not be allowed to ask questions to person questioned by the court, he has no right to make a complaint with the court, can`t submit motions for evidence and are not entitled to participate in a session or in an investigation. The author emphasizes the importance of participation by the citizenry in the administration of justice principle and the right to a fair and public hearing of his case. In article they were also discussed old draft bills in the position of social representative in criminal cases, and in particular the advantages and disadvantages of amending article 90 c.c.p. Amendment of 10 June 2016. The author argues that the changing of position will not increase the participation of the public in the proceedings, because the legislature did not admit procedural rights.
The Constitution of the Republic of Poland and Act of 6 September 2001 on access to public information ensures the right to information about the activities of public authority organs as well as subjects performing public tasks. Political parties are obligated by the Act to provide information about their funding. Furthermore, according to the Supreme Administrative Court of Poland there is no doubt that a political party fulfils a public role (case no. I OSK 513/13), which results in an obligation to disclose information on their activity and finances to the public. The case law of administrative courts brings many additional rules: the definition of an official document of the Code of Civil Procedure does not apply under the Act; the sphere of public information contains all kinds of data on party finances, including paid invoices and contracts of civil law, as well as information and documents about how to determine the amount of membership fees. Parties are also obligated to disclose resolutions of the Management Board and other documents produced by the party organs, unless these documents are of a general organizational nature and they do not provide any additional information. Political parties do not however, have such obligation regarding information and documents relating to the meetings of their leaders, as well as other information on the methods and means of action of the party.

Konstytucja Rzeczypospolitej Polskiej oraz Ustawa z 6 września 2001 r. o dostępie do informacji publicznej gwarantują prawo dostępu do informacji dotyczącej działalności organów władzy publicznej oraz podmiotów wykonujących zadania publiczne. Partie polityczne są zobowiązane ustawą do udostępniania informacji dotyczących ich finansowania. Co więcej, jak orzekł Naczelny Sąd Administracyjny, nie ma wątpliwości, że każda partia polityczna spełnia funkcje publiczne (OSK 513/13). Rezultatem tego stanowiska jest zobowiązanie partii do udostępniania informacji dotyczących ich aktywności oraz finansów. Judykatura uzupełnia regulacje ustawowe o wiele dodatkowych reguł, m. in. definicja dokumentu urzędowego z Kodeksu Postępowania Cywilnego nie ma zastosowania na gruncie omawianej ustawy; sfera informacji publicznych obejmuje wszelkiego rodzaju dane dotyczących wydatkowania przez partię środków finansowych, w tym opłaconych przez nią faktur i zawartych umów cywilnoprawnych jak również informacje dotyczące sposobu ustalania wysokości składek członkowskich oraz dokumentów, na podstawie których ta składka jest ustalana. Partie są także zobowiązane do ujawniania uchwał zarządu oraz innych dokumentów wytworzonych przez struktury partyjne, chyba, że mają one charakter ogólny i nie zawierają żadnych dodatkowych informacji. Nie posiadają natomiast takiego statusu informacje i dokumenty dotyczące spotkania liderów partii politycznych, jak również inne informacje o metodach i środkach działania danej partii.
In the paper considerations are presented on the meaning of access to environmental information as one of the key institutions that guarantees public participation in environmental matters. It should also be combined with the principle of openness of public authority and the sustainable development. The analysis of the legal nature of the institution of access to information on the environment and the process of its protection can be considered as one of the fundamental human rights guaranteed by international and the European Union law system. Whereas in light of national legal system right to information on the environment must be regarded as constitutionally guaranteed individual right. Despite its apparent public origin, you can also find the civil aspects of this legal institution.
