Zagadnienie funkcjonowania rządu w systemach politycznych świata jest przedmiotem badań konstytucjonalistów od kilkudziesięciu lat. Istotnym elementem wpływającym na ocenę sytuacji ustrojowej władzy wykonawczej jest pozycja ministra wewnątrz rządu jak względem pozostałych władz. Dodatkowym elementem różnicującym jest wyodrębnienie w nauce (ale także w praktyce) modeli ustrojowych wykształconych w toku ewolucji ustrojowej. Systemy te mające wspólne korzenie w ustroju parlamentarnym cechują się kilkoma elementami wspólnymi (np. zasada podziału władz). Każdy z nich wypracował odrębne podejście do kwestii pozycji ustrojowej ministra, na którą składają się wymienione wyżej relacje. Niniejszy tekst sięga także do wzorców wypracowanych przez (uznawanych w doktrynie za model oparty na jednolitości władzy) szwajcarską praktykę konstytucyjną. Aby uzyskać horyzont widzenia sytuacji ministra należy poddać analizie elementy szczególnie wpływające na tę sytuację. Jako podstawowe uznać należy relacje wewnątrz władzy wykonawczej, a więc sposób kształtowania składu rządu oraz odpowiedzialność względem premiera (Kanclerza), sposób określenia zakresu działania ministra oraz ogólną odpowiedzialność ministra (polityczną i konstytucyjną) w kontekście relacji z władzą ustawodawczą. Te ostatnie zaś jako podstawowe czynniki kształtujące ustrój w państwie (oczywiście na płaszczyźnie funkcjonalnej). Doniosłość kwestii ustroju obowiązującego w państwie jest oczywista dla każdego komu nieobce są takie pojęcia jak demokracja, wolność czy res publica.

The issue of the government in the political systems of the world is the subject of constitutionalists research for several decades. The essential factor which influences the evaluation of the political situation of the executive authority is the standpoint of the minister relations both inside the government and with other authorities. An additional differentiating feature is the separation of regime models developed in political evolution in science (but also in practice). These systems having common roots in the parliamentary system are characterized by several common elements (eg the principle of separation of powers). Each of them has developed a distinct approach to the constitutional position of the minister, which comprises the above – mentioned relationships. This text also goes to the best practices developed by (recognized in the doctrine as a model based on the unity of power) Swiss constitutional practice. In order to reach a horizon view of the minister situation it is necessary to analyze the elements specifically affecting this situation. The relationships within the executive authority should be regarded as fundamental. Here belong a way of shaping the composition of government, accountability to the Prime Minister (Chancellor), the determination of the scope of the minister competence and the minister responsibility (political and constitutional) in the context of relations with the legislature. Relationship between executive authority and legislature are the primary factors shaping the regime of the country (of course on the functional level). The importance of the political system of the country is obvious to anyone who is familiar with such concept as democracy, freedom or res publica.
In his article, the author considers whether, after the Constitution of Poland of 1997 entered into force, the relationship between the Supreme Audit Office of Poland and the lower house of the Polish Parliament, i.e. the Sejm, can be still referred to as ‘cooperation’. Analyses of the constitution show that the principle of separation and balance of powers in Poland is complemented with the requirement for them to cooperate. In this context, the practice was closely analysed: the frequency of NIK’s participation in the works of the Sejm, recommendations and suggestions as for auditing, and presentation of audit findings and de lege ferenda proposals to the Sejm. In his article, the author concludes that NIK is subordinate to the Sejm and performs the tasks that the Sejm assigns to it, and simultaneously cooperates with the Sejm, especially with regard to initiating audits in suggested areas, and considering findings of these audits. In this way, NIK supports the monitoring activity, as well as, from time to time at least, the legislative activity of the Sejm. In reality, the issue of NIK’s subordination to the Sejm and the issue of cooperation between these two institutions cannot be easily separated, because they interconnect and overlap with each other.

W artykule podjęto kwestię, czy po wejściu Konstytucji RP z 1997 r. nadal można mówić o „współpracy” Najwyższej Izby Kontroli z Sejmem. Z analizy konstytucji wynika, że zasada podziału i równowagi władz RP jest dopełniona przez wymóg ich współdziałania. W tym kontekście szczegółowo rozpatrzono praktykę: intensywność udziału NIK w pracach Sejmu, zlecenia i sugestie przeprowadzenia kontroli, przedkładanie Sejmowi wyników kontroli i wniosków de lege ferenda. W konkluzji uznano, że Najwyższa Izba Kontroli podlega Sejmowi i wykonuje nałożone przezeń zadania, lecz równolegle ma miejsce współpraca NIK z Sejmem, zwłaszcza w zakresie inicjowania kontroli i rozpatrywania ich wyników. Wspomaga to działalność kontrolną, a czasem też działalność ustawodawczą Sejmu. W rzeczywistości kwestie podległości NIK Sejmowi oraz współpracy obu organów niełatwo rozdzielić, gdyż łączą się one i nakładają.
The text presents the view that the vertical division within the executive power, determined by the principle of decentralisation, is legally instrumental in the face of the fundamental horizontal division of power (resulting from the principle of power sharing) and is not independent and separate from the principle of power sharing. It is worth defining the place of local self-government from the perspective of the division of the executive power, and in reference to the principle of power sharing, because of the importance that these arrangements may have for the concept of multi-level governance in the European Union. The system of the bodies and institutions of the European Union is not based on the principle of the separation of powers, but on institutional division and the vertical and horizontal opening of the legal systems of the Member States to the European legal order. At the same time, the above-mentioned multi-level governance is visible in the creation and implementation of European law. The principle of the separation of powers is, however, properly embedded in this multi-level governance at the level of national law, and within this local self-government is located accordingly.

W tekście prezentowany jest pogląd, że podział pionowy w obrębie samej władzy wykonawczej –determinowany zasadą decentralizacji – jest instrumentalny prawnie wobec zasadniczego podziału władzy poziomego i nie jest to podział niezależny, separowany od zasady podziału władzy. Warto określić miejsce samorządu terytorialnego z perspektywy podziału władzy wykonawczej i w nawiązaniu do zasady podziału władzy z uwagi na znaczenie, jakie mogą mieć te ustalenia dla koncepcji wielopoziomowego rządzenia w Unii Europejskiej. Ustrój organów i instytucji Unii Europejskiej nie opiera się na zasadzie podziału władzy, lecz na podziale instytucjonalnym, a także pionowym i poziomym otwarciu się porządków prawnych państw członkowskich na porządek prawa europejskiego. Jednocześnie w zakresie tworzenia i wykonywania prawa europejskiego jest widoczne wyżej wspomniane wielopoziomowe rządzenie. W tym wielopoziomowym rządzeniu na wysokości prawa krajowego jest jednak odpowiednio wpisana zasada podziału władzy, a w niej odpowiednio jest usytuowany samorząd terytorialny.
