The principles of equality in civil law relations as stated in the article 1, section 1 of the civil law code in Russia and the principality of autonomy of the will of both sides formulated in the article 1, section 2, point 1 the civil law code of the Russian Federation are the bases for civil law subjects to profit from authorization which is vested to them. However, in order to accomplish them efficiently natural person should be equipped with a certain potential, which to great extent depends on the will of a legislator. The potential is described by the terms legal capacity and capacity for legal acts. Any ability is an inborn gift, talent which gives a human being specified powers. The legal capacity should be understood as an innate possibility of a human being to be a subject of law which exludes crediting with normative character. It is groundless to reduce the legal capacity to the category of subject law as well as admitting the possibility of setting limits. Such limits in reality may be applied to only a definite law. The capacity for legal acts in the view of a legislator, is the ability of a citizen to achieve and carry into effect his civil laws, both creating and executing his duties. Contrary to legal capacity it is restricted depending on eg. the level of physical, psychical and social maturity. The full capacity for legal acts is gained by people who come of age (eighteen years and older) as well as the people who before that age got married or were emancipated at the age of sixteen as a result of getting employed or conducting economic activity. The justified circumstances for limiting the capacity for legal acts of anybody who acquired the full capacity for legal acts is abusing alcohol, taking drugs which leads to financial difficulties of their families. In order to protect the rights of an individual in case of mental disability, the court is entitled to announce the capacity for legal acts of a given person null and void.
This article is devoted to the analysis of the relation between the institution of the ability to civil actions established by the provisions of the Civil Code and the patient’s consent provided by the Patient Rights and Patient Rights Act, as well as the Act on Doctor and Dentist Professions. The work aim is to make a detailed assessment of the status of a patient equipped with full legal capacity, deprived of this ability and having restricted legal capacity, to present discrepancies between the norms regulating the subjective conditions for effective legal actions under civil law and the provisions that determine the rules for granting consent for medical treatment.
On the grounds of post-war legislation, guardianship affected people who were not capable of independent management of their own affairs, and care for their own well-being. This first of all concerned persons with psychological conditions, mental deficiency, and ones whose psychological disorders were related to alcohol abuse, and wasteful mismanagement. The practice of guardianship was aimed at helping the people unable to manage their conduct and/or their affairs independently. Protection of personal and property interest of these people sometimes required that their capacity to legal transactions had to be limited, or else that they were entirely bereft of it. Guardianship was applied when, due to the state of their health, a person was not capable of making conscious decisions. The legislator envisaged two types of guardianship: partial, which meant that a person subjected to it concluded legal actions on his of their own, while to have them valid, a consent of the guardian was necessary. On the other hand, such a person could make decisions concerning minor life affairs on his or her own. In turn, the plenary guardianship bereft one of the possibility of performing legal transactions, and had them represented in all legal matters by the legal guardian appointed by the court.

Na gruncie powojennych przepisów ubezwłasnowolnienie dotyczyło osób, które nie potrafiły samodzielnie zatroszczyć się o swoje sprawy i dbać o własne dobro. Przede wszystkim dotyczyło osób z chorobą psychiczną, niedorozwojem umysłowym oraz tych, u których zaburzenia psychiczne związane były z nadużywaniem alkoholu lub marnotrawstwem. Instytucja ubezwłasnowolnienia miała na celu pomoc osobom, które nie były w stanie samodzielnie kierować swoim postępowaniem bądź samodzielnie prowadzić swoich spraw. Ochrona interesów osobistych i majątkowych tych właśnie osób wymagała niekiedy, by ich zdolność do czynności prawnych została ograniczona bądź też, by zostali oni jej całkowicie pozbawieni. Ubezwłasnowolnienie stosowało się wówczas, gdy osoba ze względu na stan zdrowia nie była w stanie podejmować decyzji w sposób świadomy. Ustawodawca przewidział dwa rodzaje ubezwłasnowolnienia: czę ś ciowe, które polegało na tym, że osoba ubezwłasnowolniona sama dokonywała czynności prawnych, natomiast do ich ważności potrzebowała zgody opiekuna. Natomiast decyzje dotyczące drobnych spraw życia codziennego mogła ona podejmować samodzielnie. Natomiast całkowite ubezwłasnowolnienie osoby pozbawiało ją możliwości dokonywania czynności prawnych, a we wszystkich sprawach reprezentował ją prawny opiekun, wyznaczony przez sąd.
W artykule omówiono zagadnienie postulowanej zmiany podejścia do kwestii zdolności do czynności prawnych osoby fizycznej, polegającej na zniesieniu wszelkich przejawów jej ograniczeń, będącym wymogiem, jaki nakłada na Polskę Konwencja Organizacji Narodów Zjednoczonych o prawach osób niepełnosprawnych. W ocenie przeciwników ubezwłasnowolnienia cel ten można osiągnąć wyłącznie w wyniku likwidacji tej instytucji. Autorka prezentuje poglądy przeciwników instytucji ubezwłasnowolnienia, podejmując z nimi dyskusję i wskazując, jakie szanse i jakie zagrożenia może nieść ze sobą zmiana rzeczywistości normatywnej. Zerwanie z dotychczasowymi regulacjami może bowiem prowadzić do ewentualnych negatywnych konsekwencji w postaci pozbawienia osób spełniających przesłanki ubezwłasnowolnienia oraz ich rodzin dotychczasowej ochrony, jak również godzić w pewność obrotu gospodarczego.

The article takes on the issue of the proposed change in approach to the legal capacity of a natural person by means of abolishing any forms of statutory limitations thereof, which is a requirement imposed by the United Nations Convention on the Rights of Persons with Disabilities. In the view of the opponents of incapacitation, this goal can only be achieved by the abolition of this institution altogether. The author presents the views of the opponents of legal incapacitation, and addresses them, indicating what chances and what threats may be brought about by a subsequent change in legal reality. Withdrawal from existing regulations may lead to negative consequences, depriving people who satisfy the conditions of incapacitation and their families of outstanding protection, as well as undermining the certainty of business transactions.
This study aims to address the question of impact of the loss of full legal capacity by a natural person on their ability to act as a commercial attorney and the legal consequences of the same. In particular, the analysis covers the decision on incapacitation of a commercial attorney as well as the consequences of the appointment of an interim advisor in court proceedings. In addition, the author looks at the consequences of acts in law by an attorney whose authorisation has expired due to the loss of their full legal capacity as well as discussing the above against the background of the so-called content of the legal relationship which is regarded as a causa of granted powers of attorney.

Celem niniejszego opracowania jest przedstawienie zagadnienia wpływu utraty przez osobę fizyczną pełnej zdolności do czynności prawnych na byt prokury oraz jurydycznych konsekwencji powyższego. W szczególności przeanalizowana zostanie sytuacja wydania postanowienia o ubezwłasnowolnieniu prokurenta, jak również konsekwencje procesowej decyzji o ustanowieniu doradcy tymczasowego. Ponadto artykuł porusza zagadnienie skutków dalszego działania prokurenta, którego umocowanie wygasło z uwagi na utratę pełnej zdolności do czynności prawnych, jak również odnosi powyższe do zagadnienia tzw. stosunku podstawowego będącego swoistą causą udzielonej prokury.
