Zdolność miast na prawach powiatu do zaciągania zobowiązań a zmiana limitu długu jednostek samorządu terytorialnego

Celem artykułu jest określenie skutków zastosowania nowego limitu długu jednostek samorządu terytorialnego, wprowadzonego ustawą o finansach publicznych z 2009 r., na zdolność miast na prawach powiatu do zaciągania zobowiązań. Analizy obejmują lata 1999-2011 lub 2007-2011. Na ich potrzeby określone zostały limity długu dla miast na prawach powiatu zgodnie ze starą i nową formułą. W efekcie ustalono, iż w 2007 r. nowy limit długu nie zmieniłby ich formalnej zdolności do zaciągania zobowiązań, w latach 2008-2010 zwiększyłby ją, a w 2011 r. zmniejszyłby. Jednak ze względu na częściowe tylko wykorzystywanie przez miasta na prawach powiatu limitów długu obserwowana zmiana formalnej zdolności kredytowej nie miałaby w ujęciu całego sektora wpływu na korzystanie przez miasta na prawach powiatu ze zobowiązań.

The paper attempts to define the consequences of applying a new debt threshold of territorial self-governmental units introduced pursuant to the Act on public finance from 2009 for the ability of towns with poviat rights to incur liabilities. Years of 1999-2011 or 2007-2011 have been analysed in this respect. For the purposes of the analyses debts thresholds for towns with poviat rights are defined according to the old and the new formula. As a result, in 2007 a new debt threshold would not change its formal ability to incur liabilities, over 2008-2010 it would increase it and in 2011 it would decrease it. Due to the fact that towns with poviat rights only partially use the limit of debts, the observed change to the formal borrowing ability would not influence the use of liabilities by towns with poviat rights in the entire sector.
