V diskusi o lidských právech se nezřídka setkáváme se zjednodušujícím pohledem: určité právo buď přiznáno je, anebo není. Analýza subjektivního práva W. N. Hohfelda poukazuje na rozdílnost modalit různých subjektivních práv: jedním výrazem se označují odlišné právní (a mezilidské) vztahy. Text přenáší tento obecný poznatek do kontextu diskusí o střetu mezi právem nenarozeného dítěte na život a svobodou ženy nakládat se svým těhotenstvím podle své volby. Ukazuje, že ani v jurisdikci, v níž bylo právo na umělý potrat povýšeno na úroveň ústavního práva, nepanuje shoda o tom, v čem toto právo spočívá. Autor představuje nejdůležitější rozhodnutí Nejvyššího soudu USA týkající se otázky přístupu k umělým potratům.

In discussions about human rights, we often face a simplistic view: a certain right is either granted or not. W. N. Hohfeld’s analysis of subjective law shows that there are differences in the modalities of diverse “rights”: one term refers to completely different legal (and interpersonal) relationships. The text transfers this general knowledge into the context of debates on the conflict between the unborn child’s right to life and the woman’s freedom to manage her pregnancy according to her choice. It shows that even in a jurisdiction in which the right to abortion has been raised to the level of constitutional law, there is no consensus on what this right consists in. The author presents the most important decision of the US Supreme Court on the issue of abortions.
