Celem artykułu jest identyfikacja najistotniejszych problemów związanych z funkcjonowaniem systemu ochrony własności intelektualnej w warunkach gospodarki XXI w. oraz wskazanie rozwiązań, których wprowadzenie pozwoliłoby ograniczyć skalę ich występowania. Ze względu na ograniczone możliwości związane z wprowadzaniem zmian o charakterze legislacyjnym, najbardziej obiecującym kierunkiem działań może okazać się wykorzystanie odpowiednio dobranych instrumentów polityki innowacyjnej oraz doskonalenie praktyk menedżerskich w zakresie zarządzania własnością intelektualną.

The aim of this article is to identify the most import ant problems connecting with the system of intellectual property protection in the twenty-first century economy and to indicate solutions leading to decreasing scale of such problems. As the most promising direction of actions the author indicates the use of properly selected instruments of innovation policy and improving management practices in the field of intellectual property.
