Under the Polish Construction Act one can commence the use of the building after receiving the use permit. The analysis of the act reveals the diversity of the parties in the proceedings in cases of receiving the permit. Therefore if the proceeding is set directly after the realization of the building the solemn party is the investor. In the case of the extraordinary proceedings the parties of the proceedings are the investor and the subjects located in the area on which the building is affecting. The aim of the article was to characterize given situation as well as to critically evaluate current regulation.
