W artykule wskazano na różne funkcje umowy ubezpieczenia na życie, przede wszystkim funkcję ochronną, a także funkcję uzupełniającą w stosunku do umów kredytu lub pożyczki, czyli wykorzystanie umowy ubezpieczenia na życie jako jednej z podstawowych form zabezpieczenia wierzytelności, np. zabezpieczenia kredytu hipotecznego. Autorka omawia charakter prawny i zakres uprawnienia do wskazania uposażonego w umowach ubezpieczenia na życie. Przedstawia m.in. pojęcie osoby uposażonej, pojęcie uposażonego zastępczego, charakter prawny czynności przyjęcia przez uposażonego sumy ubezpieczenia oraz sytuację, gdy uposażony odmawia, w całości lub części, przyjęcia kwoty przysługującego mu świadczenia. Sytuacje takie nie są uregulowane w przepisach prawnych, co stanowi istotną lukę.

The article points out various features and characteristics of a life insurance contract, primarily its protective function, but also its complementary role in relation to loan or credit agreements, that is the use of life insurance as one of the basic forms of collateral, for example a mortgage collateral. The author discusses the legal nature and scope of authorisation to designate the beneficiary in life insurance contracts. She presents, among other things, the concepts of beneficiary and contingent beneficiary, the legal nature of the acceptance of the sum insured by the beneficiary and the situation when the beneficiary refuses to accept the amount of benefit in whole or in part. Such situations are not regulated by legislation, which constitutes a significant loophole. The author proposes the introduction of regulations related to the refusal to accept the sum insured and the insurer's conduct in this situation.
