W artykule przedstawiono koncepcję kontratypu sztuki oraz ocenę jej zasadności poprzez skonfrontowanie z przestępstwem obrazy uczuć religijnych. W tym celu zostały przywołane i porównane stanowiska różnych przedstawicieli doktryny – zarówno przeciwników, jak i zwolenników wprowadzenia tej konstrukcji w prawie polskim. Rozważania dotyczą konstrukcji kontratypu sztuki oraz ewentualnych skutków jego wprowadzenia. Konkluzją jest myśl, że wprowadzenie okoliczności wyłączającej bezprawność nie jest zasadne, ponieważ może się to odbyć w ramach już istniejących konstrukcji w prawie karnym, a ponadto prowadziłoby to do nieuzasadnionego uprzywilejowania artystów, w szczególności w zakresie konfliktów sztuki z wiarą, będącą jednym z najbardziej fundamentalnych praw człowieka.

Presented article depicts the concept of justification of art as well as an assessment of its validity through comparison with the offence against religious feelings. Therefore standpoints of both the supporters and opponents of introducing this particular justification concept into the Polish legal doctrine are cited and collated. The construction of the justification of art as is and potential effects of its implementation into the Polish law are being discussed as well. Ultimately, the article concludes that introduction of this particular exception excluding the unlawfulness is not justified since it could be done within the limits of already existing constructions in the penal law. Moreover, its interpolation could lead to artists’ unjustified privilege, especially in case of a conflict with religion being one of the most fundamental human rights.
