Sformułowany w polskiej teorii prawa model racjonalnego prawodawcy ma optymalizować praktykę tworzenia prawa nie tylko w płaszczyźnie językowej, prakseologicznej, ekonomicznej, ale przede wszystkim w płaszczyźnie aksjologicznej. Uznane przez prawodawcę wartości podlegają późniejszej systematyzacji ze względu na moc prawną aktu, z którego czerpią swe obowiązywanie. Dlatego wartości konstytucyjne mają wyższą pozycję w systemie od wartości ustawowych, a te ostatnie wyższą od wartości podstawowych. Różnice te są podstawą dla konstruowania przez doktrynę prawniczą zasad stratyfikacji (lub hierarchizacji) wartości. Podstawowym problemem, który jest przedmiotem ustaleń niniejszego opracowania jest pytanie, czy członkostwo Polski w UE wpływa na zmianę stratyfikacji wartości konstytucyjnych, a jeśli tak to w jakich obszarach. Niewątpliwie problem ten jest szczególnie istotny w kontekście ustalania konstytucyjnie gwarantowanych standardów ochrony praw jednostki. Wpływ integracji europejskiej na aksjologię konstytucyjną był bowiem już dostrzegany na szeroką skalę w związku z implementacją Decyzji Ramowej w sprawie ENA. Wówczas to, systemy konstytucyjne zostały skonfrontowane z koniecznością zmiany dotychczasowego standardu ochrony, polegającego na bezwzględnym zakazie ekstradycji własnych obywateli. Zróżnicowane orzecznictwo sądów konstytucyjnych dotyczące tej kwestii, wskazuje na odmienność stratyfikacji wartości konstytucyjnych w poszczególnych państwach członkowskich. Innym przykładem wpływu Decyzji Ramowej na konstytucyjnie chroniony standard prawa do sądu jest sprawa Melloni zawisła przed TS w wyniku wniesienia pytania prejudycjalnego przez hiszpański TK. Analiza treści rozstrzygnięcia TS oraz jego adaptacji do hiszpańskiego systemu prawa przez TK dowodzą również, że realny wpływ na stratyfikację konstytucyjnej aksjologii państw członkowskich może wywierać Karta Praw Podstawowych Unii Europejskiej. W opracowaniu przedstawione zostaną najnowsze orzeczenia TS dotyczące zakresu stosowania Karty w systemach krajowych (Melloni, Åkerberg, Aliyev) i ich potencjalnego znaczenia dla modyfikacji konstytucyjnych standardów ochrony praw podstawowych.

Polish legal theory has formulated a model of “rational legislator”. Its aim is to optimize the practice of law-not only on the linguistic, praxeological, economic niveau, but above all on the axiological one. The axiological system recieved by the legislaturor is a subject of a subsequent systematization due to the power of act, from which derive its validity. Therefore, constitutional values have a higher position in the system of the statute law, and the latter is higher than the value of the executive acts such as regulations. For academia these differences are the basis of a construction of principles of stratification (or hierarchy) of values. The mian issue that will be analizyed in this paper is whether the Polish membership in the EU effects changes in the stratification of constitutional values, and if so, that in which areas. Undoubtedly, this problem is particularly important in the context of setting standards of protection of constitutionally guaranteed fundamental rights. The impact of European integration on the axiology constitutional because has been widely analized in context of the implementation of the EAW Framework Decision. At that time, constitutional systems of many EU Member States were confronted with the neccessity of changing the existing standard of protection, according to which the extradition of their own citizens was absolutely forbidden. The differenciated case law of European constitutional courts on this issue, denotes variety of of constitutional values’ stratification in EU Member States. Another example of the impact of the EAW Framework Decision on the constitutional standard of right fair trial judgment is case Melloni ruled by the CJ after reference of a preliminary question by the Spanish Constitutional Tribunal. The analysis of CJ judgment and its adaptation into the Spanish legal system by the Constitutional Tribunal proves that the Charter of Fundamental Rights of the European Union may have a significant impact on the stratification of the constitutional values in national legal systems of Member States. Therefore, this paper presents the latest rulings of the CJ concerning the scope of application of the Charter in national legal systems (Melloni, Åkerberg, Aliyev) and their potential relevance to modify the constitutional standards of fundamental rights protection.
