The article shows the negative effects for the mechanism of state power (specifi ed in the current constitution) resulting from the application of the procedure for a substitution in the offi ce of President. In his central thesis, the author argues that entrusting the function of President’s substitute to the Marshal of the Sejm or the Marshal of the Senate leads to a limitation of the scope of operation of the three constitutionally enshrined main principles of the system of government: (1) the separation of powers (the Marshal — structurally connected with the legislature — when deputizing for the President acts simultaneously as part of the executive); (2) incompatibilities (in the period of substitution the Marshal at the same time holds a parliamentary seat and performs the duties of President of the Republic) and (3) the principle of a parliamentary-cabinet system (parliament can may dismiss the Speaker, while the President cannot be held politically accountable). The aim of the author is not to criticize the regulations existing in this area. On the contrary, the fully accepts the constitutional instrument of substitution, considering it as a good and effective solution which corresponds to Polish constitutional traditions.
