Artykuł dotyczy opłaty, która jest zasadniczym elementem nowego systemu gospodarowania odpadami komunalnymi w Polsce, wprowadzanego na podstawie ustawy z 1 lipca 2011 r. zmieniającej ustawę z 13 września 1996 r. o utrzymaniu czystości i porządku w gminach. W tym systemie gminy przejmują obowiązki związane z odpadami komunalnymi od właścicieli nieruchomości, którzy dotychczas samodzielnie zawierali umowy z przedsiębiorcami odbierającymi odpady. Obowiązki właścicieli będą ograniczone do uiszczenia opłaty. Opłata jest daniną publiczną i muszą być zachowane konstytucyjne standardy obowiązujące w tym zakresie. Autor poddał krytyce znowelizowane unormowanie, analizując kwestie podmiotów zobowiązanych do uiszczenia opłaty, jej przedmiotu, podstawy, stawek i postępowania w jej przedmiocie.

The article concerns the charge, which is the fundamental element of the new system of management of municipal wastes in Poland, being introduced on the basis of the Act of 1 July 2011 amending the Act of 13 September 1996 on cleanliness and order in municipalities. In the system the municipalities will take the obligations connected with municipal wastes over from the real estate owners, who earlier independently concluded contracts with enterprises collecting wastes. The obligations of owners will be reduced to paying the charge. The charge is a public impost and constitutional standards binding in this sphere must be observed. Author criticized the amended regulations from this point of view, analyzing the questions of charge payers, subject to the charge, rates and administrative proceeding relating to the charge.
