Polskie rozporządzenie w sprawie wykazu ras uznawanych za agresywne jest regulacją kontrowersyjną. Zgodnie z polskim prawem hodowla psów należących do jednej z ras wymienionych w rozporządzeniu podlega obowiązkowi uzyskania zezwolenia, ale na właścicieli nie nałożono żadnych dodatkowych obowiązków, takich jak choćby test wiedzy specjalistycznej. Dobór ras tworzących listę wydaje się nielogiczny, gdyż niektóre z nich nie zostały oficjalnie uznane przez Związek Kynologiczny (np. akbash dog), a inne –najpopularniejsze i potencjalnie niebezpieczne rasy – nie zostały na liście uwzględnione (np. doberman). Autorka analizuje niektóre rozporządzenia dotyczące ras niebezpiecznych psów obowiązujące w Niemczech. Każdy z niemieckich landów ma własne regulacje dotyczące tzw. psów walczących (Kampfhunde) oraz psów niebezpiecznych (gefährliche Hunde). Niemieckie regulacje są bardziej szczegółowe od polskich. Wśród ogólnych tendencji można wyróżnić: (1) niektóre rasy psów, w szczególności terriery typu bull, są uznawane za tzw. Kampfhunde, (2) inne rasy mogą zostać zakwalifikowane jako tzw. psy niebezpieczne, (3) istnieje możliwość zmiany klasyfikacji konkretnego psa – w drodze decyzji administracyjnej, (4) na właścicieli Kampfhunde i psów niebezpiecznych (takie jak test wiedzy specjalistycznej) nałożono dodatkowe obowiązki, wprowadzono także zaostrzone regulacje ostrożnościowe. Autorka reprezentuje pogląd, że polskie rozporządzenie należy zmienić, a w szczególności listę ras niebezpiecznych. Również terminologia użyta w rozporządzeniu powinna być zmodyfikowana. Należy też rozważyć, czy na właścicieli psów wpisanych na listę nie trzeba nałożyć dodatkowych obowiązków.

The Polish regulation on the list of dog breeds deemed to be aggressive constitutes a controversial piece of legislature in Poland. According to Polish law, it is required to obtain a permit for breeding a dog belonging to one of the breeds listed in the regulation, however, there are no additional obligations imposed on the owners, such as a specialized knowledge test. The choice of breeds included into the list seems to be quite illogical, since some of them are not officially accepted by the International Kennel Club (such as Akbash dog) and some of the most popular and potentially dangerous breeds have not been included into the said list (such as Doberman). The Authoress analyses some of the regulations on dangerous breeds of dogs in Germany. In general, each of the German Lands has its own piece of legislature concerning the so-called fighting dogs (Kampfhunde) and dangerous dogs (gefährliche Hunde). The German regulations tend to be more specified than the Polish ones. The general tendencies are: (1) some of the breeds, in particular bull type terriers, are deemed to be the so-called fighting dogs, (2) other breeds might be classified as the so-called dangerous dogs, (3) there is a possibility to change the classification of a particular dog – by way of an administrative decision, (4) there are additional obligations imposed on the owners of fighting or dangerous dogs, such as successful completion of a specialized knowledge test or rigorous safety regulations. The Authoress represents the opinion that the Polish regulation should be changed, in particular the list of dogs as well as the terminology used in the regulation should be modified. It should also be considered, if additional obligations should be imposed on the owners of dogs of the listed breeds.
