Przedmiotem artykułu jest analiza statusu autora raportu o oddziaływaniu na środowisko w ramach postępowania w sprawie wydania decyzji o środowiskowych uwarunkowaniach, obejmująca ustalenie, czy podmiot ten powinien legitymować się szczególnymi kwalifikacjami na potrzeby wykonywania takich raportów. Zagadnienie to zostało rozpatrzone na podstawie zarówno krajowego, jak i unijnego porządku prawnego. Analizą objęto ponadto charakter procesowy raportu o oddziaływaniu przedsięwzięcia na środowisko oraz uprawnienia podmiotu wnioskującego o wydanie decyzji o środowiskowych uwarunkowaniach w zakresie samodzielnej modyfikacji raportu. Sformułowano też wnioski de lege ferenda, obejmujące postulat wprowadzenia do polskiego porządku prawnego regulacji przewidującej obowiązek legitymowania się urzędowym poświadczeniem kwalifikacji merytorycznych w przypadku sporządzania raportów o oddziaływaniu na środowisko przedsięwzięć o najwyższym stopniu szkodliwości.

The subject matter of this article is an analysis of the position taken by the author of the environmental impact statement (EIS) concerning the proceedings for the issuance of environmental conditions. The analysis includes a determination whether the entity in question should possess particular qualifications for creating this brand of reports. The aforementioned issue was determined according to the domestic, as well as the EU legal framework. The analysis included the procedural character of the EIS, as well as the authority of the entity filing for a decision regarding the environmental conditions to unilaterally modify the EIS. Conclusions de lege ferenda were formulated within the confines of this article. They included a postulate for the incorporation into the Polish legal framework a regulation which would mandate the possession of an official confirmation of qualifications based on merit in case of preparing EIS for undertakings with the greatest degree of harm.
