Pre-state redistributive (tax) right of man became the fact of reality simultaneously with the emergence of him himself and the emergence of a human society. Its origin is caused by mutual public needs of individuals. The fundamental characteristics of pre-state redistributive (tax) right of man were his anthropogeny (human-dimensionality), constructability (constructivism) and contextuality, (conditionalism of redistributive relations due to inexhaustible specific content).

Podstawową tezą pracy jest twierdzenie, że pośród innych, wymienianych dotychczas praw jednostki można wyróżnić także redystrybucyjne (podatkowe) prawo. Takie redystrybucyjne (podatkowe) prawo jednostki ma charakter przed-państwowy, gdyż jego pojawienie się można umiejscowić już u początku istnienia samego człowieka i społeczeństwa ludzkiego. Powstanie takiego prawa jest następstwem faktu, że ludzie obok potrzeb indywidualnych mają także potrzeby zbiorowe (wzajemne i publiczne). Do zasadniczych właściwości przed-państwowego redystrybucyjnego (podatkowego) prawa jednostki należą jego antropiczność (wymiar ludzki), konstruktywistyczny charakter (jest skonstruowane – wytworzone społecznie) i kontekstowość (stosunki redystrybucyjne mają charakter warunkowy ze względu na ich nieskończenie konkretny charakter).
