The note concerns the impossibility of treating the 2023 judgement of the Court of Justice of the European Union in the case of L.G. v. Krajowa Rada Sądownictwa concerning the power of the adjudicating panel of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court to refer requests to the Court of Justice of the European Union for a preliminary ruling as a basis for the Marshal of the Sejm’s refusal to apply a decision of the Chamber in a case not materially related to European Union law.
