Recenzowana książka Anny Młynarskiej-Sobaczewskiej „Autorytet Państwa, Legitymizacyjne znaczenie prawa w państwie transformacji ustrojowej” dotyka ważnej kwestii jaką jest legitymizacja działania władzy w demokracji. Autorka we wstępnie, czterech rozdziałach i zakończeniu podjęła się przedstawić oraz przeanalizować od strony prawnej i politycznej wyzwania jakie stały (i są aktualne) przed państwami, w których kształtuje się demokracja. Pierwszy rozdział Autorka poświęciła analizie koncepcji sprawowania władzy oraz budowania jej autorytetu. W kolejny rozdziale Autorka poruszyła ważną kwestę jaką była legitymizacja władzy państwa komunistycznego. Następnie dwa kolejne rozdziały zostały poświęcone legitymizacji władzy w państwie transformacji ustrojowej oraz prawnym instrumentom rozliczania się z przeszłością. Temu ostatniemu zagadnienia Autorka poświęciła sporo uwagi uznając, iż prowadzenie tzw. lustracji jest najbardziej doniosłe społecznie i politycznie w państwach transformacji ustrojowej. Autorka nie odnosi się jednak wyczerpująco do czynników, które aktualnie determinują autorytet władzy. Dlatego też rozważenia wymaga przyjmowana dziś koncepcja państwa, w której obywatele są stałym uczestnikiem procesów decyzyjnych. Dlatego też omawiania książka powinna stać się jednym z elementów dyskusji o autorytecie państwa, w szczególności na poziomie lokalnym i regionalnym.

The reviewed book by Anna Młynarska-Sobaczewska The authority of the State, legitimising purpose of law in a state undergoing political transformation touches upon an important issue that is the legitimisation of the actions of democratic authorities. In the introduction, the main four chapters and the conclusion, the author provides a presentation and analysis of the legal and political aspects of the challenges that emerging democracies faced and still face. The first chapter is devoted to the analysis of the concept of governance and establishing authority. In the next chapter, the author raises an important issue that is the legitimacy of authority in a communist regime. The subsequent two chapters are devoted to the legitimacy of authority in a state undergoing political transformation and to legal instruments of settling the past. The author focused extensively on the latter, maintaining that the so-called lustration has most profound social and political effect in states that undergo political transformation. The author, however, does not provide a thorough analysis of the factors that establish the authority of the governments of today. Therefore, the up-to-date concept of the State whose citizens participate in decision-making on a regular basis needs to be considered. For this reason, the reviewed book should be one of the elements in the discourse on the authority of the state, in particular at the local and regional level.
