The following paper explores the problem of article 9 of the draft act on the supply of services with regard to vindication of damages claims arising from a tort. The draft act with question introduces in article 9 a ban on voluntary assignment of such claims. The author of this paper discusses the genesis of the above draft law, the overview of legislative work, the overview of the institution of voluntary assignment of claims as regulated by the Polish civil code, the role of the assignment of tort claims in the process of the redress of a damage, the scope of the regularising of the assignment of tort claims in article 9 of the draft act as well as which of the consequences of the ban on the assignment of tort claims will have on the aggrieved. Finally, the author of this paper takes a very negative view of the proposed ban on the assignment of tort claims and postulates a complete removal of this provision from the draft act.
