Pursuant to Art. 249(1) of the Act of 5 January 2011 – the Electoral Code, the termination of the mandate of the deputy shall be immediately declared by the Marshal of the Sejm by means of a decision. The decision of the Marshal of the Sejm shall be served on the deputy without delay. The provisions of the Electoral Code do not specify the procedure for serving the Marshal of the Sejm’s decision issued pursuant to Art. 249(1) of the Electoral Code. Referring to the jurisprudence of the Supreme Court, it should be concluded that it is reasonable to apply the relevant provisions of the Code of Administrative Procedure accordingly.
