Ustanowienie funduszu ratunkowego dla strefy euro, czyli Europejskiego Mechanizmu Stabilności, wymagało zmian traktatowych. Państwa członkowskie na szczycie 25 marca 2011 r. podjęły jednogłośnie decyzję 2011/199/ UE o zmianie art. 136 Traktatu o funkcjonowaniu Unii Europejskiej według procedury uproszczonej (art. 48 ust. 6 Traktatu o Unii Europejskiej - tzw. procedura kładki). Procedurę tę można stosować, gdy wprowadzona zmiana dotyczy części trzeciej TFUE i nie zwiększa kompetencji UE przyznanych w traktatach. Wejście w życie decyzji 2011/199/UE wymaga zatwierdzenia przez państwa członkowskie zgodnie z ich porządkiem konstytucyjnym, zasadniczo przez parlamenty. W artykule omówiono procedurę kładki, kontrowersje związane z ratyfikacją decyzji Rady Europejskiej nr 2011/199/UE zwykłą mniejszością głosów w polskim Sejmie, a także w niemieckim Bundestagu po decyzji Federalnego Trybunału Konstytucyjnego.

Establishment of the rescue fund for the Eurozone, that is the European Stabilisation Mechanism, needed the amendment of Article 136 TFEU. The European Council of 25th March 2011 following the procedure of Article 48(6) TEU adopted a decision 2011/119/EU aiming at the amendment of Article 136 TFUE. Article 48.6 procedure is applicable to all amendments of Part III of the TFEU - internal policies of the EU - as long as the proposed amendments do not imply an increase of EU competences. The European Council's decision can only be enacted after its approval by each Member State in accordance with their own constitutional requirements, mainly vote of approval by the national parliament. The article discusses the simplified treaty revision procedure, controversies connected with the ratification of the Decision 2011/199/EU by minority voting in the Polish Sejm, and in the German Bundestag after the ruling of the Federal Constitutional Court.
