Celem opracowania jest analiza problemu nieubezpieczonych pojazdów/kierowców/posiadaczy w kontekście społecznym, jak również finansowym ze wskazaniem praktycznych skutków dla wszystkich uczestników zaangażowanych w funkcjonowanie rynku, zaś w szczególności poszkodowanych w takich wypadkach. Przedstawiono również możliwości przeciwdziałania zjawisku nieubezpieczonych pojazdów. Artykuł omawia praktykę ubezpieczeniową w tym zakresie realizowaną zarówno na płaszczyźnie narodowej, jak i międzynarodowej. Jedynym koordynatorem tych działań – na podstawie Rekomendacji nr 5 ONZ z 1949 r. oraz dyrektyw komunikacyjnych – jest Rada Biur Systemu Zielonej Karty zrzeszająca biura narodowe reprezentujące poszczególne rynki ubezpieczeniowe w Systemie Zielonej Karty, jak i poszczególne fundusze gwarancyjne, organy odszkodowawcze i ośrodki informacji ze wszystkich państw członkowskich. Jednym z istotnych zadań Rady Biur jest koordynowanie walki ze zjawiskiem pojazdów nieubezpieczonych, a co za tym idzie – ochrona interesów konsumentów, którzy są zazwyczaj ostatecznym płatnikiem.

The aim of this article is to investigate the problem of uninsured vehicles/drivers/owners in a social as well as financial context, and indicate its practical effects on all the market participants, especially on the victims of such accidents. All presented considerations reflect the insurance measures implemented at both national and international levels. The only coordinator of these activities, according to the UN Recommendation No. 5 adopted in 1949 and motor directives is the Council of Bureaux of the Green Card System associating both national bureaux representing the individual insurance markets in the Green Card System and particular guarantee funds, compensation bodies and information centres in all Member States. One of the essential tasks of the Council of Bureaux is the coordination of the fight against a phenomenon of uninsured vehicles, and consequently the protection of the interests of consumers, who are usually the ultimate payers.
