The law of 16 September 2011 amending the State Treasury Agricultural Land Management Act and a number of other related laws and regulations have substantially modified the regulations of the agricultural land tenancy from the Resources of the State Treasury Agency for Agricultural Property. The aim of the deliberations presented in the paper is assessment of the amendments with a view of answering whether they satisfy the underlying legislative assumptions. The author analyses the legal as well as the economic aspects of the amended regulations and concludes that they are in compliance with the Constitution. However, the new regulations are not fully consistent with the intentions of the legislature. Thus the final effects will depend on the actions taken by the Agency for Agricultural Property as well as by the tenants who will rent agricultural land from the Agency’s Resources. What is sure though, is the regional differentiation of the impact that the amended law will have throughout the country.

La legge del 16 settembre 2011, che apporta modifiche alla legge sulla gestione degli immobili agricoli del Tesoro ed anche ad alcune altre leggi, ha introdotto modifiche importanti nell’ambito della locazione di terreni agricoli gestiti dall’Agenzia delle Risorse Agricole di proprietà dello Stato. Lo scopo delle considerazioni è di valutare se e in che misura i cambiamenti effettuati mettono in atto i principi legislativi relativi alla gestione degli immobili agricoli dello Stato. L’autore prende in considerazione sia gli aspetti giuridici sia quelli economici delle soluzioni introdotte. Concludendo, egli afferma che il legislatore non ha previsto soluzioni di carattere obbligatorio, e che le norme della legge sulla locazione di terreni agricoli esaminata sono in conformità con la Costituzione della Repubblica di Polonia. Manca, tuttavia, una piena coerenza tra le nuove regolazioni e le intenzioni del legislatore. I risultati finali dipenderanno sia dalle attività intraprese dall’agenzia degli Immobili Agricoli sia dai locatari di terreni agricoli gestiti dall’Agenzia delle Risorse Agricole. Indubbia è invece la differenziazione regionale dell’impatto della legge.
