Po wejściu w Życie ustawy z dnia 28 listopada 2003 r. o zmianie ustawy o gospodarce nieruchomościami oraz o zmianie niektórych innych ustaw , tj. po dniu 22 września 2004 r., Skarb Państwa i jednostki samorządu terytorialnego zostały zobligowane do Żądania zwrotu bonifikaty, udzielonej od ceny sprzedaży lokalu mieszkalnego, jeżeli nabywca lokalu przed upływem 5 lat od jego nabycia sprzedał go lub wykorzystał na inne cele niż uzasadniające jej udzielenie. Przepis art. 68 ust. 2 ustawy z dnia 21 sierpnia o gospodarce nieruchomościami , w wersji obowiązującej przed 22 września 2004 r., dopuszczał możliwość wystąpienia z Żądaniem zwrotu bonifikaty. Aktualnie, zgodnie z jego dyspozycją, właściwy organ jest zobowiązany do wystąpienia z Żądaniem zwrotu udzielonej bonifikaty, gdy nabywca lokalu dokona jego zbycia z naruszeniem wyartykułowanych w nim ograniczeń.

The article analysed the problem of the repayment of deductions in price made after the Act of the 28th November of 2003 on the Amendment of the Act on the Real Property Management and the Amendment of Some Other Acts came into force. After the 22nd September of 2004 the State Treasury and territorial self-government units have been obliged to claim a deduction in price back made from the selling price of the residential premises if the purchaser of the premises, within 5 years from the purchase, sold or used the premises for other purposes than those which justify its granting.
