Artykuł poświęcony przedstawieniu uwag na temat relacji pomiędzy obowiązkiem uprzed-niej konsultacji z mieszkańcami wydania rozporządzenia Rady Ministrów w sprawie utworzenia, połączenia, podziału i zniesienia gminy a ewentualnym referendum lokal-nym w przedmiotowej sprawie. Artykuł koncentruje się na wybranych aspektach tej re-lacji, które pozwolą na udzielenie odpowiedzi na kilka pytań i problemów badawczych, takich jak: jakie wnioski można wyciągnąć z drogi legislacyjnej tej konkretnej regulacji ustawowej?; jaka jest różnica w zasięgu terytorialnym konsultacji z mieszkańcami a re-ferendum lokalnym, a co za tym idzie kto faktycznie udziela opinii Radzie Ministrów przed wydaniem rozporządzenia?; czy możliwe są statutowe regulacje na ten temat oraz czy uchwała rady gminy ma jednokrotne czy wielokrotne zastosowanie?; wreszcie czy wyrażona opinia jest wiążąca dla Rady Ministrów?

The article is devoted to the presentation of remarks on the relationship between the ob-ligation of prior consultations with residents of the issue of the act of the Council of Mi-nisters regarding the creation, merger, division and abolition of the municipality and a possible local referendum in the case. The article focuses on selected aspects of this re-lationship, which will allow answering a few questions and research problems, such as: what conclusions can be drawn from the legislative path of this particular statutory regu-lation?; what is the difference in the territorial range of consultations with residents and the local referendum, and who actually gives opinion to the Council of Ministers befo-re issuing the regulation?; whether statutory regulations on this subject are possible and whether the municipal council’s resolution has single or multiple applications?; finally, whether the expressed opinion is binding on the Council of Ministers?
