Istotą regulacji dostępu do urządzeń kluczowych w przemysłach sieciowych jest doprowadzenie do zaistnienia konkurencyjnego rynku świadczenia usług konsumentom. Celami tej regulacji są: rozwój konkurencji, ochrona konsumenta oraz realizacja celów społecznych i narodowych. Procesowi regulacji towarzyszy również niebezpieczeństwo polegające na tym, że z racji swej arbitralności może ona stać się dodatkowym zakłóceniem działania rynku, zwłaszcza w zakresie cen i inwestycji. Komisja Europejska oparła regulację sektorową dostępu do urządzeń kluczowych na antymonopolowej doktrynie essential facilities. Wprowadzając konkurencję w przemysłach sieciowych i przy uwzględnieniu charakterystyk poszczególnych sektorów, Komisja przyjęła za podstawę regulacji, że dostęp do urządzeń kluczowych musi być niedyskryminacyjny, przejrzysty i rozsądnie wyceniony.

The regulation of access to essential facilities in network industries should first of all introduce competition in downstream markets. Thus, the main objectives of the regulation are: creation of competition, consumer protection, and fulfilment of national and social objectives. The European Commission has based the access regulation regime on the antitrust essential facilities doctrine and has developed the access rules to essential facilities according to non-discriminatory, transparent and reasonably priced terms.
